HomeMy WebLinkAbout800033.tiff RESOLUTION RE: AUTHORIZATION FOR WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST CHARLES RYBERG FOR VIOLATION OF THE WELD COUNTY ZONING RESOLUTION WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Weld County Department of Planning Services has informed the Board of County Commissioners that Charles Ryberg is in violation of Section 3. 3. B of the Weld County Zoning Resolution, said violation being non-compliance with the Development Standards of Special Use Permit #410, and WHEREAS, the property on which said violation is occurring is described as Part of the Southeast Quarter of Section 24 , Town- ship 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, the Board of County Commissioners deems it advisable to bring legal action against Charles Ryberg for the above stated violation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that Thomas O. David, Weld County Attorney, be, and hereby is, authorized to proceed with appropriate legal action against Charles Ryberg for violation of the Weld County Zoning Resolution. The above and foregoing Resolution was , on motion duly made and seconded, adopted by the following vote on the 22nd day of December, A.D. , 1980. SEa Section 14, TIN, R66W of the 6th P.M., Weld County, Colorado. The property is located 1 mile north of Irnchbuie. The zoning violation is a cacanercial house moving operation in the Agricultural Zone District which is in violation of Section 3.3.B. of the Weld County Zoning Resolution. -When Chuck Cunliffe issued a violation notice on Charles Ryberg's parcel of land in April of 1977, the normal procedure was initiated to apply for a change of zone ficin A to C. Application for change of zone was received in Septanber of 1978. On February 21, 1979, the Board of County Commissioners denied the application for change of zone. Fran the date that the Commissioners denied the application for change of zone to Mr. Ryberg, constant communication and efforts on the part of the Department of Planning Services were made to resolve Mr. Ryberg's violation, all to no avail. On July 25, 1979, I brought the matter before the Board of County Commissioners recommending the Commissioners proceed with legal action against Charles Ryberg. Through the efforts of Mr. Ryberg's new attorney, John Dent, finally March 19, 1980, Special Use Permit #410 was approved by the Board of County Commissioners for storage yard for commercial house moving business. Random inspections after March 1980 showed that Mr. Ryberg did not comply with the Development Standards of said special use permit by allowing an oil treatment facility within the special use permit area. On October 24, 1980 through Mr. Ryberg's attorney, application was received to amend Special Use Permit #410 to allow an oil treatment facility. On December 16, 1980, in front of the Planning Commission Hearing, the amended Special Use Permit application was withdrawn. Therefore, the Development Standards of Special Use Permit #410 for the house moving business still are not in compliance. It is the opinion of the Department of Planning Services that legal action should immediately be initiated against Ernie Ryberg. CEG/dr a i 12/19/80 c,.Cf :TION REPORT Charles 1;. SEo Section 24, TiN, R66W Data December 18, 1980 Time 4:30p.m. I called John Dent, attorney for Ernie Ryberg advising him that the Board of County Commissioners would hear recommendation from the Department of Planning Services regarding the violation case on Monday, December 22, 1980 at 9:00 A.M. in the first floor meeting roan. John Dent explained that he would not be able to be present but he would inform his client and that he did not think Jtyberg would be present either but that he understand the action that the Planning Department is recommending that the Commissioners take - that being authorizing the County Attorney to proceed with legal action against Ryberg immediately for not complying with the Development Standards of Special Use Permit #410 for a commercial house moving and storage operation. Mr. Rybsrg is illegally operating an ail treatment facility on his property at the present time . He has four larje a31 storage tanks on his Property in addition to at least one large oil tanker truck. This facility is not in any way -covered by the special use -permit. Ws ask the county to take whatever steps are necessary to close this Tacility. in addition , Mr. RyberjI has not moved his hou-semovinj equilment to the area specified in Special Use Permit 410 ; he has not erected the chain link privacy fanc-e called for ; and he has not kept the area in a neat or orderly manner -- all conditions which were stipulated in -granting this permit.
