RESOLUTION
RE: APPROVE AMENDMENT TO RECORDED EXEMPTION NO. 425, AN AMEND-
MEND TO MINOR SUBDIVISION NO. 19 - DENNIS KUEHL AND WALTER
COLSON
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on November 22, 1972 , the Board did, by Resolution
approve Minor Subdivision No. 19 , and
WHEREAS, Minor Subdivisions are now referred to as Recorded
Exemptions, and
WHEREAS, on October 17, 1979 , the Board did, by Resolution
approve Recorded Exemption No. 425, which was an amendment to
Minor Subdivision No. 19 , and
WHEREAS, Dennis Kuehl and Walter Colson are requesting an
amendment to said Recorded Exemption No. 425, and
WHEREAS, said amendment would adjust two internal property
lines for the efficient use of Lots A and B, continuing to divide
the property in parcels of 7 acres and 8 acres, more or less, and
WHEREAS, the parcel of land for which this request is being
made is described as part of the NE4, Section 5, Township 4 North,
Range 68 West of the 6th P.M. , Weld County, Colorado, being more
particularly described in the plat which shall be provided by the
applicants and known as Exhibit "A" , said plat to be recorded, and
WHEREAS, the Board deems it appropriate to approve the
Amendment to Recorded Exemption No. 425 for Dennis Kuehl and
Walter Colson on the above described parcel.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the above mentioned
amendment to Recorded Exemption No. 425, which was an amendment
to Minor Subdivision No. 19 , requested by Dennis Kuehl and Walter
Colson on the hereinabove described parcel of land be, and hereby
is, approved, subject to the applicant submitting a mylar plat

RE: AMEND RE #425 - KUEHL AND COLSON
to the Department of Planning Services to be recorded in the
office of the Weld County Clerk and Recorder. The plat shall be
drawn in accordance with the requirements of Section 9-2C. (4) of
the Weld County Subdivision Regulations. The plat shall be sub-
mitted within ninety days from the date of approval by the Board
of County Commissioners.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
May, A.D. , 1984.

Re: Recorded Exemption Amended RE #425 (second amendment)
Dear Commissioners:
The attached application, plat and related items are in reference to a request
from Dennis Kuehl and Walter Colson for an amended recorded exemption. The
parcel of land on which this request is being made is described as Part of the
NE14, Section 5, T4N, R68W of the 6th P.M. , Weld County, Colorado.
The property is located approximately 51 miles northwest of Johnstown on State
Highway 60. The property contains approximately 15 acres of Class I, Ile
(prime) irrigated and IIc nonirrigated soils. The parcel of land under
consideration is the total contiguous land holdings of the applicants.
The request is to divide the property into parcels of 7 acres and 8 acres,
more or less. Both property owners would like to adjust two internal property
lines for the efficient use of Lots A and B.
Based upon the submitted information and policies of the County, the
Department of Planning Services staff recommends the request be approved for
the following reasons:
1. The impact on surrounding agricultural land uses does not
appear to be any different than the original request approved
on November 22, 1972 and the first amendment approved on
October 17, 1979.
2. The request is in compliance with Section 9-2E of the Weld
County Subdivision Regulations.
The Department of Planning Services staff recommendation for approval is
conditional upon the following:
1. The applicant shall submit a mylar plat to the Department of Planning
Services to be recorded in the office of the Weld County Clerk and
Recorder. The plat shall be drawn in accordance with the requirements of
Section 9-2C. (4) of the Weld County Subdivision Regulations. The plat
shall be submitted within ninety (90) days from the date of approval by
the Board of County Commissioners.

family residence, barn, pole shed,: 2 sheds and corrals.

TO WHOM IT HAY CONCERN: .
I will grant an easement 30 feet wide for an access road
and utilities on the west boundary of my property provided the
adjacent property owner provides a similar 30 foot easement on
their east boundary. This constitutes a 60 foot total access
easement which conforms to county standards.
The total 60 foot wide easement would have a center line
beginning 811.24' west of the I.P. at the N.E. corner of Section 5,
T-4-N, R-68-6w, with a S 02°19,00" E bearing and distance of
2537.64 feet.
This easement would provide access and a location for
utilities for property owners on each side of the easement.
