We will respect your wishes not to move them. Mr. Martinez tells me that yesterday, the boulders appeared to be further from the centerline of the road than they have been in the past. So perhaps that will satisfy the County's desire to clear the ROW for County Road 1. I have asked you several times since April to please to let us know the financial cost to you of maintaining the road so that the Martinez can shoulder their share of the expense, as they would like to do. I have also asked you please to let us know what the Martinez can do to help you with the road maintenance. You have not told us either what your costs are, or what we can do to help. I will be glad to receive that information from you at anytime, and then to respond to any reasonable request for assistance. The Weld County Planning Department asked us to work out a deal with you for maintaining the road, or else go to Plan B: to submit our own plan if we cannot work something out with you. I am now working on Plan B, and expect to present our proposal for contributing to the maintenance of the road within the next week. I asked you today if you noticed that Mr. Martinez had cut the weeds along the private road right of way, in order to help with the maintenance. You said that you had noticed it, and that it "ticked [you] off" and that it had been done when the ground was too wet so that it left ruts. You want people to stay off the right of way, which is your property. I will let Mr. Martinez know, and I am sure he will comply. You ended the call today by hanging up on me after I told you I would be contacting the other neighbors to ask them what the Martinez can do to contribute to the road maintenance. We talked to Chris Gatham in the latter part of August to ask if the next Commissioner's meeting had been scheduled and to ask where we were at in terms of progress regarding our private driveway being used by a business. The safety concerns and other issues from the previous meeting are still a concern. He informed us that the Martinez's still had some requirements to meet and might have to get an extension to give them additional time. I stated frustration regarding the fact that a business can use a private driveway without Permission for an indefinite period of time Then we later learned that the business was operatirtgwithout a permit. I asked what if anything, we could do to expedite the issue. He suggested another letter and that he would notify us regarding the next meeting. Since the county/commissioners have been involved, we have received a great deal of correspondence from the Martinez's and Macon Cowles. Letters, notes, phone calls etc. At times they expressed frustration because we did not respond immediately. In addition they have made attempts to "help the road". Once, they scraped the gravel &snow up into little piles, Byron had to grade it out. Recently, without asking, they mowed part of the right of way. Unfortunately, they did this when the road was wet and left ruts in the right of way. They announce these things as favors, showing that they are helping to maintain the road. The fact is Byron had already mowed the right of way (3) three times and did so again, as soon as he was able to. We have not always responded to the many phone calls and letters. The major reason is that I have been in and out of the hospital this summer, 3-4 times with major surgeries and complications. Mr. Cowles called this summer, while I was in the hospital and talked to our daughter. She is from Michigan and tried to help us handle things, while I was sick. The day I got home from the hospital, he called again. As always, they wanted meetings and resolutions. Messages were left on the machine and of course letters followed. In every case Byron had the messages and was responding, as quickly as possible. I might add that I am grateful that his priorities remained with me. We are senior citizens. We have lived here many years and always abided by the law. We have maintained the road according to the stipulations that came when we purchased the land. This whole issue is beginning to become one of harassment. An example of this is the telephone message on Wed. Aug. 25, 2004 concerning the boulders at the entrance of the driveway and the announcement that-we were likely going to be getting an extension off the culvert. and that the county had asked the Martinez's & Mr. Cowles to move the boulders that are there. They asked what we would like done and if we did not notify them,they would dispose of them as best they knew how." As soon as possible I called the county. They responded as follows, yes they would be putting in a culvert, 30 ft. long, to meet the county standards. That the boulders were not a problem, if they were in the way, they would simply move them aside and replace them. The county indicated that we did not have anything to worry about. Interestingly,the courts have already stated that the driveway is to be maintained at 12 ft. in width EXHIBIT I " . :14GWso — The Martinez's and Mr. Cowles monitor the activity of the road. Mr. Cowles told Byron that Mr. Martinez said the boulders had been moved, implying we were now meeting the requirements. The boulders have always met the requirements. Initially they were placed at 30 feet from the center line of WCR# 1. Byron moved them (2)two more feet in on our right of way, to facilitate the county placing the culvert. Their latest proposal on, Aug. 26, 2004, is that if they cannot work out a plan with us, they will go to "Plan B", and will submit their proposal,for contributing to the maintenance. Somehow, this sounds like another threat. In the past we have contacted each neighbor with a request for payment to maintain the road. This has been met with silence, except for the Martinez's,who say they did not receive a copy. One was given to someone at the residence below us. At that time we had no idea that Mr. and Mrs. Martinez did not live there. The gentleman said he would give it to them. Did they make any effort to track it down or clarify the matter with their employee? It is our belief that if the road is used for residential purposes only. we can continue as we have been. The road is rough, but that is not all bad, in terms of safety for the children who do play on it. The bumps do slow traffic. That, or we can contact some construction companies, as the court designated in 1988. We can get bids and contract with one to maintain the road and each member would pay a percentage of the cost based on use. At that time the court order stated that the cost would be shared equally among the four residents. Anyone using the easement would be personally liable and pay for any damage, caused by improper use of the easement beyond normal wear and tear. This may be the only workable solution. It is certainly one that we can pursue, but a portion of each resident's share would have to be paid up front, to cover the cost. Thank you for your patience and time in reading this letter. We had understood at the last meeting that the commissioners would discuss this and reach a resolution at the next meeting. The fencing of this area has been completed, and will reduce the force of wind events. The parking lot is now covered with crushed gravel to eliminate concerns about fugitive dust from bare dirt. Occasionally, the landowners store dirt piles of less than 5 cubic yards on a temporary basis. This occurs when they have extra soil from one of their customers, which they would store until it can be used for the next customer who needs extra soil. No wastes are generated on site. Wastes are only stored and used on site as described in sections 2 and 3 below. 2) A list of the type and volume of chemicals to be stored on site. A. Gasoline: Less than 5 gallons, stored in an appropriate container. B. New motor oil: No more than a case of 12 cans. C. Used motor oil is poured into a 55 gallon metal barrel. When it is 1/4 to 1/2 full, it is taken for recycling to the Auto Parts store listed in response to paragraph 3. D. The Martinez received a certified letter from Byron Marsh dated December 6 demanding $550 for road maintenance. A copy of the letter is attached. We have always maintained—and the Road Maintenance Agreement so provides-that we are willing to pay our fair share of the cost of maintaining the road. Here is what the Road Maintenance Plan has to say about that: • §3. Commitment to pay a fair share of the expenses of maintaining the road. Grengs, taking into consideration the use and benefit that the property owners who share the road derive from it. As far as I can tell, it seems that Jose and Natalia are the only property owners using the road who have been given a demand to pay at all. That's not reason enough for the • Martinez not to pay their fair share. But is it fair? Given the animosity shown by Mr. Marsh in the past, the amount seems more consistent with his grudge against the Martinez than it does a fair assessment of what the Martinez fairly ought to contribute as their share. This is particularly so given the fact that Mr. Marsh got very angry,in August when Jose had his workers mowing the weeds along.the road to help maintain it; and he got so furious in October when Jose paid a gentleman to grade the road on the 18th of that month that Mr. Marsh called the sheriff on Jose, Based on the history of Mr. Marsh's not cooperating or even being civil with us, I sent him the enclosed letter with today's date asking him for some additional information. I • want you to have the•attached copy so you will be completely apprised of our dealings with Mr. Marsh. We have committed to him and to the other neighbors that we will contribute a fair amount to the maintenance of the road, but we want to.feel that Mr. • Marsh is himself being fair, and not overreaching because we have a Use Review pending before the County Commissioners. They are also liable for their share of the expense for the maintenance of the road. At this time each resident was ordered to pay 20% of the cost for maintenance of the road. If there is abnormal wear and tear, or damage(i.c.. use of large trucks,trailers,or excessive numbers of cars coming and going then the percentage would be larger). The road is to be maintained at 12 ft. in width. Each resident would pay 20%of the cost for maintenance and upkeep,based on average,normal residential use. If there is abnormal wear and tear,or damage(i.e.. use of large trucks,trailers or excessive numbers of cars coming and going,then the percentage would be larger). We have for the past 13 years maintained the road with no assistance. We are sorry but you must now start paying annually for the maintenance and upkeep of the road. The extreme amount of traffic and illegal attempts of maintenance have taken their toll, Per the Weld County District Court Civil Action No. 87C V491,each resident must pay a minimum of$200.00 per year for the first three(3)cars run in normal use. There is more information that is needed, however, for us to feel that the amount that you have demanded—$550—is fair. It seems high; and it seems arbitrary. This is particularly so since we have located a man with a grader who will grade the road for $100. In fact, the Martinez paid him to grade the road, which resulted in your lodging a complaint with the Weld County Sheriff's office. In order to understand how you came up with the amount of $550, we respectfully request additional information so that we can get some insight into what you are thinking. 1. Would you kindly send us copies of the letters that you have sent to the other property owners who use the road so that we can see what amount you are demanding them to pay by January 1, 2005? 2. Would you kindly tell us how you came up with the figure? a. Perhaps you have kept track of your hours in maintenance of the road. b. Perhaps you have receipts that would help establish the reasonableness of the amount. 3. Is the $550 for the road maintenance that will occur in 2005? Or is it for past road maintenance, or what? I want to reiterate that Jose and Natalia Martinez will be glad to pay a fair share of the reasonable expenses of maintaining the road as ordered by the Court in Knibbs v. Grengs, taking into consideration the use and benefit that the property owners who share the road derive from it. We just want to make sure that what you are asking is reasonable, and well grounded in the actual use of the road. By the way, you need not trouble yourself with sending your letters by certified mail. We will be glad to respond to you directly and promptly. It is$200.00 for the residences. The Martiners' were billed$550.00 based on the residence,plus their work vehicles.This was based on the number and size of tracks and trailers that the County approved for use, at the last meeting.
