STEPANICK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , a Use by Special Review, Dog Kennel Operation, hearing for Michael J. Stepanick was scheduled for August 31, 1983, at 2: 00 p4m. , as stated in the Notice dated August 3 , 1983 , a copy of said Notice being attached hereto and incorporated herein by reference, and WHEREAS , at the hearing of August 31 , 1983, the Board, after consideration, deemed it advisable to continue the hearing until October 5, 1983, at 2 : 00 p.m. in order to allow the Board to further study said request. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the Use by Special Review, for a dog kennel operation, hearing for Michael J. Stepanick be, and hereby is, continued to October 5, 1983, at 2 : 00 p.m. BE IT FURTHER RESOLVED that the Clerk to the Board shall publish a notice of continuance of said hearing, a copy of said Notice being attached hereto and incorporated herein by reference. S1'EPANICK A public hearing was conducted on August 31 , 1983 at 2:00 P. M. , with the following present: Chuck Carlson Chairman John Martin Pro Tem Gene Brantner Commissioner Norman Carlson Commissioner Jacqueline Johnson Commissioner Also present: Acting Clerk to the Board, Tommie Antuna Assistant County Attorney, R. Russell Anson Planning Department Representative, Rod Allison The following business was transacted: I hereby certify that pursuant to a notice dated August 3, 1983, and duly published August 18, 1983, in the La Salle Leader, a public hearing was held for the purpose of considering a Use by Special Review for a dog kennel operation for Michael J. Stepanick. Russell Anson, Assistant County Attorney, read this request into the record. Mr. Anson stated the criteria which must be met by the applicant in order to grant this request. Rod Allison, Planning Department representative, read the recommendation for denial from the Planning Commission, and the reasons for such recommendation, into the record. Mr. Allison said several phone calls and letters had been received objecting to the visual • unsightliness, the odor, and the noise of the existing dog kennel. He said this proposal had been reviewed by the Ft. Lupton Planning Commission and their recommendation was for denial. Mr. Allison presented three photos of the operation. Mr. Allison said these photos were taken because the existing kennel is in violation. The applicant, Michael Stepanick, was present and • came forward to offer testimony. Mr. Stepanick said he had requested 100 dogs originally, but he would like to have this reduced to 50 dogs on the existing 2 acres rather than the 4 acres. He said the waste is cleaned up weekly and he has been working with a veterinarian in order to reduce the noise. The vet will operate on the voice box of the dogs. Mr. Stepanick said he has the dogs for show only, he does not sell nor board dogs. Mr. Stepanick said he presently has 30 Pit Bull dogs. Commissioner Brantner asked about the fighting nature of these doers. Mr.. Stepanick said he does not breed the dogs for this purpose. After further discussion, Jack Vaughn, Howard Jewart, and Barbara Jewart, surrounding neighbors, came forward to voice their objections to this proposal. Mr. Vaughn said he lives approximately 600 feet and he can clearly hear the dogs from his house. Mr. Jewart said he lives directly across the street from the applicant. He said that the harking by the dogs is very bad. Miller Boyles and Mary Howard offered testimony favoring this application. Mrs. Stepanick also came forward and offered comments. After further conarents by those present, the Board made several comments. Commissioner Martin moved that this 'natter be continued to October 5, 1983, at 2:00 P.M. ; that it be published again; and that it be resubmitted to the Planning Commission, along with Standards which are TAPE CHANGE to be drawn up, to be heard by them on October 4, 1983. Commissioner Brantner #83-96 seconded the notion. The notion carried by the following vote: Commissioners Martin, Brantner, Johnson and the Chairman voted Yea. Commissioner N. Carlson voted Nay.
