The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 1 (County Line Road) is designated on the Weld County Road Classification Plan (FHU) as a collector
status road, which requires an 80-foot right-of-way at full build out. There is presently a 60-foot right-of-way.
The road is maintained by Boulder County. Pursuant to the definition of SETBACK in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
r'EQUIREMENTS:
Access: The applicant is indicating an existing gravel drive access to WCR 1. Utilize this access point. The
access drive shall be graveled or the equivalent and shall be graded to prevent drainage problems.
On-Site Parking/Circulation: The applicant is identifying three parking areas to accommodate employee,
visitors, and customers. These areas should have adequate gravel or grass parking. The circulation appears
to be adequate to accommodate the facility.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.

Environmental Health Services has reviewed this proposal for a kennel (80 dogs
maximum), an additional single family dwelling unit, and a recreational horse facility
(horse riding lessons and day camp). We have no objections to the proposal, however,
we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall provide written evidence to the Weld County Department of
Public Health and Environment that the applicant has contacted the Colorado
Department of Agriculture (CDA), Division of Animal Industry. This contact shall
determine if a license under the Pet Animal Care Facilities Act (PACFA), as
defined under C.R.S. 35-80-101 through 117 is required, or provide evidence that
the applicant is not subject to the PACFA requirements.
3. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
1. An individual sewage disposal system required for the large horse barn/dog barn
structure(s) and the future small residence. The system shall be installed
according to the Weld County Individual Sewage Disposal Regulations prior to
operation of the kennel or recreational horse facility.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
3. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is grater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. The applicant shall remove, handle, and stockpile manure from the livestock area
in a manner that will prevent nuisance conditions. The manure piles shall not be
allowed to exist or deteriorate to a condition that facilitates excessive odors, flies,
insect pests, or pollutant runoff. The manure storage site shall have a water-tight
surface which does not permit seepage or percolation of manure pollutants into
the ground.
2. Animal and feed wastes, bedding, debris and other organic wastes shall be
disposed of so that vermin infestation, odors, disease hazards, and nuisances
are minimized. Such wastes shall be removed at least weekly from the facility
and disposed by a commercial hauler.
3. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
4. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

5. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
6. The applicant shall operate in accordance with the approved "waste handling
plan".
7. The facility shall be operated in a manner to control flies.
8. The applicant shall comply with all applicable rules and regulations of the
Colorado Department of Agriculture (CDA), Division of Animal Industry.
9. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
10.This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
11.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
12.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
13.The facility shall utilize the existing public water supply. (Little Thompson Water
District)
14.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
15.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

A Site Specific Development Plan and special Review permit for a kennel (80 dogs maximum), an additional
single family dwelling unit, and a recreational horse facility (horse riding lessons and day camp) in the A
(Agricultural ) Zone District.
1. A building permit shall be obtained prior to the construction of any new building and change of use of any of
the existing buildings.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
required when applying for each permit. Commercial buildings require a Code Analysis Data sheet, provided
the Weld County Building Department. Automatic sprinkler requirements may be required since the square
footage of each use was not included in the USR questionnaire. The dwelling unit may require the plans to bear
the wet stamp of a Colorado registered architect or engineer. New construction will require an engineered
foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado
registered engineer. Engineered foundations shall be designed by a Colorado registered engineer.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The bam will probably be classified as an Assembly use. The kennel will probably be classified B (Business).
The buildings including the bathrooms shall be accessible to persons with disabilities. Fire resistance of walls
and openings, construction requirements, maximum building height and allowable areas will be reviewed at the
plan review. Setback and offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

Dear Jacqueline:
We have reviewed the site plan and have no conflicts with the proposal at this time and
would approve it subject to the requirements mentioned below. Eventual construction or
development will be required to meet departmental development standards. Construction
requirements for the Berthoud Fire Protection District are currently drawn from the 1997
Uniform Fire Code. From time to time these source documents are updated or amended. In
the event that there is a conflict between the requirements of this letter and updated
requirements,the newer requirements in effect at the time of building permit submittal shall
apply.
This proposal changes the occupancy usage from residential to commercial. The facility will
require periodic fire inspections once completed. The facility will be required to comply with
the 1997 Uniform Fire Code prior to issuance of any new occupancy permit. Plans for the
remodel work proposed should be submitted to the Berthoud Fire Protection District for
review and approval. This should be done with ample time to allow for review prior to
commencement of construction, so this review does not interfere with the orderly progress of
the project.
