HomeMy WebLinkAbout20050128.tiff RESOLUTION RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION VI#0400302 AGAINST JOHN AND GWENDOLYN NOLAND FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, John and Gwendolyn Noland, VI #0400302, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of January, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, John and Gwendolyn Noland were not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board deems it advisable to bring legal action against those individuals named above to correct said violation. The 14.7 acre parcel is also zoned I-3, and was permitted by Weld County, in 1981, to be used to outside store vajous building materials, steel pipe, equipment, and etc. Additionally, the property to the south, Is 'well as the property west, across US highway 85 are currently being used to store building materials, steel pipe, equipment, and etc. We would like to begin storing building materials, steel pipe, and equipment on this location, 12701 Weld County Road 6 1/4. The property is fenced, and has a gate that opens onto WCR 6 1/4. We would continue to use US85 as the principal access from WCR 6 1/4. In the early 1950's the property was convened from being the local Grange Hall location to being the gravel pit for Weld County's county road department, then after Weld County completed mining the property,Weld County converted it to being the Weld County Land Fill. In 1971, it was sold to Colorado Land Fill. They closed it as a land fill in 1981, then we purchased the 14.7 acre parcel from them in 1982, then in 1985, we purchased the corner 4.7 acre from Robert Frank. Due to the above, there are limited usage possibilities for this property. Even though subsidence of the property appears to have stopped, and there are methane vents around the outside borders, open storage is still the best use of this parcel.
