HomeMy WebLinkAbout830859.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 595 - THEO RADEMACHER WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners at a public meeting held in the Chambers of the Board, that the division into two parcels of land, as shown on the plat known as Recorded Exemption No. 595 , being the property of Theo Rademacher, described as part of the NW4, Section 26 , Township 3 North, Range 68 West of the 6th P.M. , Weld County, Colorado, being more particularly described in the plat which shall be provided by the applicant and known as Exhibit "A" , said plat to be recorded, does not come within the purview of the defini- tion of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners that the hereinabove described parcel of land owned by Theo Rademacher be, and hereby is, exempt from the definition of the terms, "subdivision" and "subdivided land" . BE IT FURTHER RESOLVED by the Board that this approval is conditional upon the following: 1) that an additional thirty-five (35) feet right-of-way along Colorado State Highway 66 be shown on the recorded exemption plat before recordation by the office of the Clerk and Recorder for the purpose of providing adequate right-of-way width to meet projected needs as outlined by the Colorado Division of Highways; 2) that any new access on to Colo- rado State Highway 66 be approved by the Colorado Division of Highways; and 3) the applicant should submit a mylar plat to the Department of Planning Services ' Office to be recorded in the office of the Clerk and Recorder. The plat shall be drawn in accordance with the requirements of Section 9-2 C. (4) of the Weld County Subdivision Regulations. The plat shall be submitted within ninety (90) days from the date of approval by the Board. The parcel of land on which this request is being made is described as part of the NWT, Section 26, T3N, R68W of the 6th P.M. , Weld County, Colorado. The property is located approximately 2.5 miles southeast of Mead; east of I-25 and adjacent to Colorado State Highway 66. The property contains approximately 21.7 acres of Class II and III irrigated soils and Class III and IV nonirrigated soils. The request is to divide the property into parcels of 11.47 acres, more or less, and 10.23 acres, more or less. This recorded exemption would correct the illegal land split on Special Use Permit #436:80:26. This parcel of ground was approved for an agribusiness and purchase of farm equipment on April 10, 1980. Based upon the submitted information and policies of the County, the Department of Planning Services staff recommends the request be approved for the following reasons: 1. The request complies with Section 9-2 C. of the Weld County Subdivision Regulations submission requirements; 2. The request complies with Section 9-2 E. of the Subdivision Regulations as follows: The proposal is in compliance with Section 1-3 of the Weld County Subdivision Regulations and the proposed land division complies with the Weld County Comprehen- sive Plan, therefore the proposed use is consistent with efficient and orderly development. 6.0959 Board of County Commissioners March 16, 1983 Page 2 - The proposal does not exist in an overlay district area. - The proposed lots meet minimum lot size requirements for land division. - The Little Thompson Water District has indicated adequate water service is available for this proposal. The proposed lots are not part of a recorded exemption within the last five (5) years. The two lots proposed will have adequate access from Colorado State Highway 66. The Weld County Health Department has indicated that both lots will have adequate sewage capacity. The Department of Planning Services staff recommendation for approval is conditional upon the following: 1. Planning C6mmissron Dear Mr. Allison: We have reviewed the Theo Rademacher application for a recorded exemption, and we ask for your consideration of the following comments. 1 . Projected traffic on State Highway 66 indicates the need for a 150-foot total right of way, 75 feet each side of the highway centerline. Since the existing width is 40 feet south of the centerline, we ask that an additional 35 feet be provided to achieve the projected width. This could be done by reservation or, preferably, dedication as permitted by local regulations. 2. It is our understanding that this property has been conveyed to the adjacent owner for use as a parking lot. The adjacent property has existing access to S.H. 66. According to the State Highway Access Code, no additional access should be anticipated as a result of this exemption or the "eventually commercial " use of this property indicated on the application.
