Re: Statutory Notice of Claim of Margee J. Johnson
Dear County Commissioners,
This is a legal notice of claim pursuant to C.R.S. §24-10-101 et seq. (including C.R.S. §
24-10-109).
On April 11, 2005, I was denied a promotion to Fiscal Officer, when a new-hire male started
the job, as announced during the week of April 4-8, 2005. I have been unfairly paid low
considering my workload. I complained about discrimination and fear retaliation. I have
already seen unfounded, negative comments in my performance evaluation, and I have
learned of negative comments about me. This will stifle my career.
I believe some or all of the above actions (and following actions) were taken against me
because of my sex, disability and because I complained about discrimination. They were
taken in violation of my due process and equal protection constitutional rights pursuant to the
Colorado and United States Constitutions (and 42 U.S.C. § 1983).
I am a female with birth date of March 21, 1963. I have multiple sclerosis, with a medical
record thereof, and I am medically disabled. My life's activities are limited. I am fully
capable of doing my job (Accountant I) and also the job of Fiscal Officer, to which I applied.
My employer selected an inferiorly qualified, if not non-qualified, male for the job. I had to
help tram him and do his duties. I learned about his non-qualification after he was hired. I
had been doing the duties of two or three positions and not being paid equivalently as
compared to the man who got the promotion to fiscal officer or commensurate with my
workload. I complained about discrimination on or about September 26, 2005 and since then
have received a performance review with unjustified negative comments, although the
review was generally good. I have been subjected to negative comments, also in retaliation.
I fear further retaliation will occur against me because of my complaint of discrimination.

I believe I am being discriminated and retaliated against in violation of federal and state laws
forbidding discrinunatron because of sex and disability and forbidding retaliation for
complaining about discrimination.
Ordinarily I would not equate the harm to me in terms of dollars as I am concerned about the
progress of my career, which I value very much. However, I am informed that in order for
this Notice of Claim to be valid under the pertinent statute, I must state the dollar amount of
my claim, which is $1 million. This is for lost wages and benefits, unequal pay and
emotional distress. I also understand that I am required to provide the names and addresses
of the public employees involved, as follows: Dennis Bogott and Walt Speckman.
