In response to your letter written on behalf of Mr. Ed On, Petro-Canada
Resources(USA)Inc. does not intend to locate a well on the surface of the captioned lands. As a
result, we do not intend to enter an appearance to object to Mr. Orr's upcoming Weld County
rezoning case,Docket 2005-78.
As to royalty income claimed by it Orr relating to the Harrington 2-30 well, a
review of our files indicates that Mr. Orr has never provided us with documentation evidencing
the transfer of any mineral interests to him covering the spacing unit for such well. If Mr. On is
asserting his ownership, please provide the legal instrument of conveyance and we will reflect
such transfer.

ARCHITECTURAL GUIDELINES
FOR RESIDENTIAL CONSTRUCTION IN
ORR ESTATES PUD
Section 1. Diversity of Architectural Styles. It is the intent of these guidelines
to insure that each home remains compatible with the neighborhood as a whole,
however is diverse with individual elements. Domes, hyperbolic parabolas, mansard
roofs and flat roofs will not be permitted in Orr Estates PUD unless specifically
approved by the Architectural Review Committee.
Section 2. Minimum Square Footage and Building Height. The ground floor
finished area of any residence, exclusive of open porches, patios and vehicle garages,
shall not be less than 1400 square feet for a one-story residence; not less than 1200
square feet for the first floor of a two story residence; not less than 2200 square feet
above grade for the floor of a bi-level, tri-level or raised ranch residence. The total
square footage minimum for the main floor and upper floors of a two-story residence,
multi-level residence, bi-level, tri-level or raised ranch shall not be less than 1800
square feet. The maximum building height of any residence constructed shall be 30 feet
measured from the top of the foundation to the crest of the highest roof line (excluding
chimneys, cupola).
Section 3. Roof Pitches. The roof on any residence must be between 5/12
and 12/12. Enclosed porches may have roof pitches as low as 4/12.
Section 4. Exterior Elevations of Residences. Any residential plan should be
designed to look attractive form all four sides. Decorative elements (masonry veneer,
shutters, dormer windows, etc.) should not be limited to the front side of the residence.
Fireplaces and full height of and chimney must be full enclosed with compatible
materials to exterior siding of the residence.
Section 5. Residence Window and Door Placement. The placement of
windows and doors within the residence on flat walls should align vertically and
horizontally and should not be randomly located.
Section 6. Standards Regarding Use of Exterior Materials. The following
exterior materials are encouraged: stone, brick, masonry, or synthetic masonry. Any
alternative materials must be approved by the Architectural Review Committee.
a) Any proposed roofing material shall be submitted to and approved
by the Architectural Review Committee prior to construction. It is not the intent of the
Declarant to require a single type of roofing material on all lots in Orr Estates PUD;
however, selection of roofing materials must be compatible with other roofing materials
in housing adjacent to the house being constructed and shall be no less than 40 year
heritage or comparable. Standard asphalt shingles are not acceptable and will not be
approved in Orr Estates PUD.
b) Simulated materials require approval of the Architectural Review
Committee.
c) Window frames shall be painted wood, natural wood, painted steel,
anodized painted aluminum or vinyl cladding.
d) Foundation walls shall not be exposed, except 6" above grade at
house; 12 on sides of walkout and garden level construction.
e) All fascia shall be minimum of 8" and all soffits shall be a minimum
of 16".
ALL EXTERIOR COLORS MUST BE APPROVED BY THE ARCHITECTURAL
REVIEW COMMITTEE PRIOR TO CONSTRUCTION
Section 7. Color Exterior Materials. The color of exterior material used on the
residence must be subdued and blend with the colors of the natural landscape. Earth
tones, generally muted, are recommended. Accent colors on exterior doors, window
frames, fascias, soffits and trim, used with restraint and in manner which does not
exceed 10% of the surface of the residence, may be approved by the Architectural
Review Committee.
Roofing colors must be limited to natural material colors or earth tones.
All projections, including but not limited to, chimney flues, vents, gutters,
downspouts, utility boxes, porches, railings and exterior stairways shall match the color
of the surface form which they project and shall be approved by the Architectural
Review Committee.
Section 8. Standards Relating to Decks, Patios, Wall, Porches and House
Numbers. Decks must be within allowable building setbacks.
Decking for second floor balconies must be specifically approved by the
Architectural Review Committee. Deck columns less than 9' high must have a minimum
dimension of 51/2". Columns over 9-0" in height must have a minimum dimension of 7".
All retaining walls shall not exceed 4' in exposed height without buffering of
landscape or other material accepted by Architectural Control Committee.
Walls constructed out of brick, stone, wood, and stucco or concrete faced with
brick, stone, wood or stucco will be allowed within the building setbacks. They may be
used for retaining changes in grade.
Front porches and stoops may be constructed of brick, stone, colored or
exposed aggregate concrete or plain concrete.
House numbers must be between 3" and 7" high, brass or black. Other designs
or colors require specific approval of the Architectural Review Committee.
Section 9. Setbacks. The setbacks, which will be enforced by the Architectural
Review Committee, are the same building setbacks that are required by the County of
Weld, Colorado.
Section 10. Site Grading. Exterior grading shall be adequate for drainage
away from the house and adjacent houses; however, the grading shall not be forced to
allow basement garden level or walkout window and doors, except through the use of
area walls. Houses shall be sited to complement existing or planned houses on
adjacent sites. Grade level decks, patios and outside living area are encouraged and
large elevated decks or patios are discouraged. The fencing and screening standards
are intended to maintain an open feeling and to minimize the area enclosed or partially
surrounded by privacy fences, service yards or pet enclosures.
Section 11. Landscaping. The intent of the approval process for landscaping is
to encourage an open flowing relationship between lots. Any plan which defines a rigid
property boundary is discouraged while plan which blend one landscaped yard into
another, through the use of similar planting materials and random clumps of trees along
the property lines, are encouraged. Landscaping must be completed within eighteen
(18) months of Certificate of Occupancy of a residence. No mowing, watering, or other
unnatural action can be used on the natural areas, which remain on the lot.
Section 12. Screening and Fencing. Boundary fencing or screening fencing will
require approval from the Architectural Review Committee and must meet the following
minimum fencing standards:
a) No fence or screening material may exceed six feet (6) in height,
and no fence or screening material shall be wire or chain link.
b) All fencing or screening materials shall either match the materials
and colors used in the residence or shall be natural wood or wood simulated materials
or stone or brick.
Section 13. Standards for Exterior Mechanical Equipment. All exterior
mechanical equipment shall be either incorporated into the residence that is
constructed or be permanently enclosed by some screening material as described in
Section 13 of these Guidelines.
Section 14. Accessory Structures. Accessory structures, including dog runs
and exterior storage, television, radio, short wave receiving equipment, or transmission
equipment of any type shall be submitted to the Architectural Review Committee and
approved by the Committee prior to construction.
Section 15. Exterior Lighting Standards. The design standard for exterior
lighting shall be such that it will not interfere with the use and enjoyment of other
residential houses within the subdivision. The light source should not be visible from
adjoining dwellings; should be projecting downward rather than projecting directly to
adjoining dwellings and the location of all exterior light shall be approved be the
Architectural Review Committee. All exterior lighting shall be design compatible with the
structure and should be used for purposes such as illuminating entrances, decks,
driveways, and parking areas.
Section 16. The Architectural Review Committee Board may grant variances of
these architectural guidelines in the Review Committee's sole discretion.
