HomeMy WebLinkAbout20052039.tiff RESOLUTION RE: APPROVE RESUBDIVISION, RS #1096, FOR LOT LINE ADJUSTMENT IN DOS RIOS ESTATES, SECOND FILING, PHASE It -ALLELY/VIGIL/ ELLIOT/ZENK WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 18th day of July, 2005, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing the application of Joshua and Zachary Allely, 52 Vaquero Trial, Greeley, Colorado 80634;Andrew and Sandra Vigil, 55 Vaquero Trail, Greeley, Colorado 80634;Josh and Karen Elliot, P.O. Box 336447, Greeley,Colorado 80633;and Daniel and Susan Zen k,54 Vaquero Trail, Greeley,Colorado 80634, for Resubdivision, RS #1096, for a Lot Line Adjustment in Dos Rios Estates, Second Filing, Phase II, on the following described real estate, to-wit: Lots 1 through 4, Block 4, Dos Rios Estates, Second Filing, Phase II; being part of the NE1/4 of Section 34, Township 5 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, the applicant was not present at said hearing, and WHEREAS,Section 24-5-30 of the Weld County Code provides standards for review of said Resubdivision, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24-5-30.B of the Weld County Code. 2. It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24-5-30.C.3 of the Weld County Code, including specifically: a. Section 24-5-30.C.3.a -- The lot line revision complies with the approved recorded final plat. The proposed revision will allow the applicants to construct secondary buildings and structures within the areas of the lots that are located between two existing gas line rights-of-way within the Dos Rios Estates Subdivision. No other changes to the subdivision are proposed. b. Section 24-5-30.C.3.b — This revision is in compliance with the adopted rules, regulations and ordinances in force and affecting the subdivision. Any future construction within these areas will need to adhere to applicable County Code requirements. Prior to Recording the Resubdivision Plat: A. The following information shall be placed on the plat prior to recording: 1) The following note shall be added to the plat:"This resubdivision plat shall comply with Notes A-S as indicated on the plat for Dos Rios Estates, Phase II (S-385), which was recorded on April 8, 1996, under Reception #248549, Book #1541, Page #205." 2) The following note shall be added to the plat: "An Encroachment Permit shall be executed prior to any construction vehicles crossing over or performing work within the Colorado Interstate Gas Pipeline easements." 3) The following note shall be added to the plat: "This resubdivision is to allow the construction of secondary buildings and/or structures between the Colorado Interstate Gas Company easement and the Excel Energy easement on Lots 1-4, Block 1 of Dos Rios Estates Second Filing (Phase II)." 4) All plats shall be labeled RS-1096, Resubdivision of Lots 1-4, Block 1, Dos Rios Estates, Second Filing (Phase II). 5) Building envelopes for secondary structures/buildings shall be indicated between the Colorado Interstate Gas Company easement and XCEL Energy easement (indicated as the P.S. Co. 50-foot gasline easement on the S-385 plat) on Lots 1-4. 6) The plat shall indicate any existing tank battery or wellhead and the required setback as indicated in Section 23-3-50.E of the Weld County Code. 7) The resubdivision plat shall comply with sections 24-4-40.D.6 through 24-4-40.D.9 of the Weld County Code. B. The applicant shall submit two paper copies of the plat for preliminary approval to the Weld County Department of Planning Services C. The applicant shall create a digital file of all drawings associated with the Resubdivision application. Acceptable CAD formats are.dwg, .dxf,and .dgn (Microstation); acceptable GIS formats are .shp (Shape Files), Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4) ... (Group 6 is not acceptable). The applicant shall submit revised covenants for Dos Rios Estates reflecting the changes to Section C-8 of the existing covenants in regards to building envelopes for Lots 1-4, Block 1, Dos Rios Estates, along with a recording fee($6 for the first page and$5 for each additional page)to the Department of Planning Services. 2. Upon completion of Condition of Approval #1 above, the applicant shall submit a Mylar plat, along with all other documentation required as Conditions of Approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by the Department of Planning Services. The plat shall be prepared in accordance with the requirements of Section 24-4-40.D.6 through D.11 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty (60) days from the date of the Board of County Commissioners Resolution. The applicant shall be responsible for paying the recording fee. 3. In accordance with Weld County Code Ordinance 2005-7, approved June 1, 2005, should the plat not be recorded within the required sixty(60)days from the date of the Board of County Commissioners Resolution, a $50.00 recording continuance charge shall added for each additional three (3) month period. CIG has two easements that are next to each other and gives us between 90-105 feet of right of way. Dos Rios Estates Zed Filing dated January 1995 only shows our SA and SB pipeline easement which is 50 feet in width; however, CIG acquired additional right of way(50 feet)through the subdivision on October 9, 2001 and was recorded in the Weld County Clerk&Recorder's Office on October 19, 2001 in Reception#2899266. Basically,without a survey verification, CIG's right of way is 25 feet on the outside of the outer pipelines. CIG does not have a problem with having a building between its easement and Public Service of Colorado's easement. Any building or permanent structure may not be inside our easement due to safety and maintenance reasons, Prior to construction of any buildings between the two company's easements, CIG will need to review the type and weight of the construction vehicles which will need to cross our pipelines. Upon engineering review, CIG will determine if any additional protective measures(i.e.: an earthen berm over the pipelines) will be required. An Encroachment Permit will need to be executed before any vehicles can cross over our pipelines. CIG does not have a problem with having a fence cross its easements, but will need to have a gate, wide enough for construction vehicles to pass through,placed in the easement to allow CIG personnel quick and unencumbered access should maintenance or emergency repairs on the pipeline(s) be needed.. Within six months after closing of the lot, a minimum of ten (10) trees, at least three (3) inches in diameter, and vegetation cover suitable for controlling weeds over the entire lot (e.g., mixed pasture-grass) shall be planted. No weeds, underbrush or other unsightly growth shall be permitted to remain upon the lot at any time.. C-6. Outdoor Storase of Vehicles: No outdoor storage of boats, campers, recreation vehicles, etc. is allowed without fully screened fencing. C-8. Easements. Easements for installation and maintenance of utilities and drainage facilities and pipelines are reserved as shown on the recorded plat attached as Exhibit A and made a part hereof. Within these easements, no structure, planting (especially of trees or other deep-rooted plants) or other material shall be placed or permitted io remain which may damage or interfere with the installation and maintenance of the utility or pipeline, which will prohibit or restrict the use of the easement for its intended purposes, which may change the direction of flow of drainage channels in the easements, or which may obstruct or retard the flow of water through drainage channels in the easements. Now this is the story. You were to send written confirmation of approval along with a request for mylar prints and an electronic disk. They were to respond to this request from you with the prints and the disk. Can you please provide Paul Hernandez at Landmark, tel 667-6286 with whatever confirmation he requires from the county to produce the mylar plats that I need to have notarized? Can you please explicitly describe to me what I need to do to complete this process? I assume that I should retrieve the mylar plat copies and have them notarized. Do I have to have both of them notarized? More than $2,000 has been spent by me, along with dozens of hours and the difficulty of acquiring the needed notarized signatures, one of which is in Alaska (which now has to be repeated). All for what I claim is no change or deviation from the original plat. I cannot afford the time required to do this again, but am left with no choice. I most certainly cannot afford the time required to do it more than once again. ("Basin"), a Delaware corporation, and Joyce J. Allely. RECITALS A. Allely owns certain property in Weld County, Colorado that includes the NE/4 of Section 34, Township 5 North, Range 66 West(the "Property"). B. Allely has filed an application with Weld County to have the Property and other lands approved for a subdivision. C. Dos Rios, Inc., a Colorado corporation, gave an oil and gas lease dated September 4, 1981 to Transcontinental Oil Company which was recorded in the Clerk and Recorders office in Weld County at Book 950, Reception Number 1871736 (the "Lease") and which covers the Property. D. Allely succeeded to the interests of Dos Rios, Inc. in the Property and the Lease. E. Basin succeeded to the interests of Transcontinental Oil Company in the Lease and thereafter caused an oil and gas well to be drilled in the NE/4NE/4 (the "Well") on the Property. F. In addition to the Well, Basin also operates certain oil and gas production facilities that are located on the Property along the north boundary of the N/2NE/4. The oil and gas production facilities are connected to the Well by an underground flowline, all as depicted on the map attached to this Agreement as Attachment 1. The Well, flowline and oil and gas production facilities are hereinafter sometimes referred to together as the "Oil and Gas Facilities." G. Attachment 1 also reflects the location of the road that Basin has installed and that it currently uses to access the Oil.and Gas Facilities. H. The parties enter into this Agreement to set forth their agreement with respect to (1) the surface area that Basin will use to maintain and operate the Oil and Gas Facilities; (2) access to the Oil and Gas Facilities; and(3) the allocation of certain costs as hereinafter described. Surface Area for Oil and Gas Facilities a. Well Site Location: Basin shall use and maintain a 200' x 200' area surrounding the Well as depicted on Attachment 2 ("Well Site Location")for its operations; provided, however, that in the event and at any time after reasonable notice to Allely that Basin in its discretion wishes to conduct workover operations, Basin shall have the right to use as much of the Well Site Location as is necessary under the circumstances. Allely shall not construct or install or cause or permit to be constructed or installed any residence or other occupied building or any other improvement of any kind within the Well Site Location or within either 150 feet from the wellhead or any other more stringent setback imposed by Weld County or the Colorado Oil and Gas Conservation Commission("COGCC"). b. Flowline Location: Basin shall use and maintain an area of 30 feet around the flowline as depicted on Attachment 2 ("Flowline Location"). Except as hereinafter provided in paragraph 2, Allely shall not construct or install or cause or permit to be constructed or installed any residence or other occupied building or any other improvement of any kind within the Flowline Location or within either 150 feet of the Flowline Location or any other more stringent setback imposed by Weld County or the COGCC. c. Oil and Gas Production Facility Location: Basin shall use and maintain the area currently fenced surrounding the Oil and Gas Production Facility as depicted on Attachment 2 ("Oil and Gas Production Facility Location"). Allely shall not construct or install or cause or permit to be constructed or installed any residence or other occupied building or any other improvement of any kind within the Oil and Gas Production Facility Location or within either 150 feet of the Oil and Gas Production Facility Location or any other more stringent setback imposed by Weld County or the COGCC. d. Access: Basin shall remove and reclaim the current access road in compliance with COGCC rules and regulations, and Allely shall cause a new access road to be installed at the location identified on Attachment 2. The access road that Allely installs shall be at least 30 feet in width. Basin shall promptly remove the current access road only after Allely installs the new access road. 2. Access Over Flowline Location: The parties acknowledge and understand that the new access road will be installed in part over the Flowline Location as reflected on Attachment 2. They agree that the new access road will be a gravel road that will be used by both Basin and Allely and/or their representatives, agents, successors and assigns. The access road will also service residents of the proposed development. Joint Use of Access: Neither party shall unreasonably interfere with the use of the access road by the other at any time. 4. Fencing and Mitigation Measures: Upon commencement of construction of houses in the proposed development, Basin shall install the mutually agreed upon 6 foot cedar decorative fence or other mutually agreeable decorative fence around all or portions of the wellhead and the tank battery as agreed upon in the surface damage agreement dated January 5, 1993 between Basin and Allely attached to this Agreement as Attachment 3 ("Surface Damage Agreement"). Allely shall install any other type of fencing other than the agreed upon fence or any other noise or visual impact mitigation. 5. Allocation of Certain Costs: a. Access Road: Basin shall pay all costs to remove the current access road, and Allely shall pay all costs to install a new access road. Each of the parties shall promptly repair any damage in excess of normal wear and tear that it causes to the access road and shall pay for the costs of such repairs. b. Mitigation Measures: Basin shall pay the costs to install the 6 foot cedar decorative fence or other mutually agreeable decorative fence referred to in paragraph 4. Allely shall pay all costs to install fencing other than the 6 foot cedar decorative fence or other mutually agreeable decorative fence referred to in paragraph 4 and also for any and all other noise and visual impact mitigation measures at or surrounding the Oil and Gas Facilities either that she desires or that the County or any other local jurisdiction requires; provided, however, Allely shall consult with and work with Basin to construct or install fencing and all other mitigation measures and Basin may refuse to allow the installation or construction of any mitigation measure that in its opinion(with the concurrence of Weld County, the COGCC or other regulatory body or special district) may create an unsafe condition or that makes access to Oil and Gas Facilities inconvenient to Basin. c. Subdivision Plan Revision: Basin shall reimburse Allely for redrafting the subdivision plan necessary to accommodate surface use surrounding the Oil and Gas Facilities as described in this Agreement, but only to the extent and for those out of pocket costs and professional fees, including attorneys' fees (as well as such fees for the negotiation of this Agreement), that are directly associated with changes to the subdivision plan because of the provisions in this Agreement. Allely shall provide documentation to Basin to support those costs and fees which are subject to reimbursement by Basin. 6. Term: This Agreement shall continue in full force and effect for the earlier of a) so long as the Lease is in effect and for the term of any extension or renewal or new lease taken within six months of expiration of the Lease or b)for so long as the Property is included in land covered by the Lease,or any such extension, renewal or new lease. 9. Incorporation of Attachments: Attachments 1, 2,3 and 4 are incorporated into this Agreement by this reference. 10. This Surface Damages Agreement is also intended to cover all surface damages occasioned by location and use of the access road to the well, location, use and servicing of tank batteries and flow lines or gas gathering lines on the referenced lands and any other damages or claims arising out or in any way connected with entry upon the referenced lands by Basin, its successors or assigns. Prior to the commencement of drilling operations for this well, Basin agrees to pay the surface owner the sum of Two Thousand, Five Hundred Dollars ($2,500.00) as payment for surface damages relating to drilling and completion of any specific well and for the installation of the production equipment and flow line required for the production of oil and gas from that well. It is specifically understood that the $2,500.00 shall not cover any damages to existing growing crops at the drill site resulting from Basin's operations. The intent of both parties is to base any crop damages on the selling price of specific crops on a per acre basis. Two complete sets of plans are required when applying for each permit. Building plans may be required to bear the wet stamp of a Colorado registered architect or engineer. 3. CIG has two easements that are next to each other and gives us between 90-105 feet of right of way. Dos Rios Estates 2nd Piling dated January 1995 only shows our 5A and 5B pipeline easement which is 50 feet in width;however, CIG acquired additional right of way(50 feet) through the subdivision on October 9,2001 and was recorded in the Weld County Clerk &Recorder's Office on October 19, 2001 in Reception# 2899266. Basically,without a survey verification, CIG's right of way is 25 feet on the outside of the outer pipelines. CIG does not have a problem with having a building between its easement and Public Service of Colorado's easement. Prior to construction of any buildings between the two company's easements,CIO will need to review the type and weight of the construction vehicles which will need to cross our pipelines. Upon engineering review, CIG will determine if any additional protective measures(ie: an earthen berm over the pipelines)will be required. An Encroachment Permit will need to be executed before any vehicles can cross over our pipelines. CIG does not have a problem with having a fence cross its easements, but will need to have a gate, wide enough for construction vehicles to pass through, placed in the easement to allow CIG personnel quick and unencumbered access should maintenance or emergency repairs on the pipeline(s) be needed.
