FOR A HOME BUSINESS(MANAGEMENT OF JANITORIAL CLEANING CONTRACTS
WITHIN A MOBILE OFFICE) IN THE A (AGRICULTURAL)ZONE DISTRICT - JAMES
AND GAIL SUTTON
A public hearing was conducted on December28, 2005, at 10:00 a.m.,with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 9,2005,and duly published December 14,
2005, in the Fort Lupton Press, a public hearing was conducted to consider the request of James
and Gail Sutton for a Site Specific Development Plan and Use by Special Review Permit#1530 for
a Home Business (management of janitorial cleaning contracts within a mobile office) in the
A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of
record. Wendi Inloes, Department of Planning Services, presented a brief summary of the proposal
and entered the favorable recommendation of the Planning Commission into the record as written.
She described the location of the site and surrounding land uses, and stated no conflicts were
indicated by the City of Dacono or Towns of Frederick and Erie. She stated eight agencies
responded to referrals with comments, which have been incorporated into the Conditions of
Approval and Development Standards. She stated the applicant has proposed a modular unit,
which will be used as an office, to be placed directly behind the existing house. She stated it would
be a temporary modular office structure. Responding to Commissioner Vaad, she stated the
covenants in Carmacar Ranchettes,which is an agricultural subdivision, allow this type of activity,
and four Use by Special Review Permits currently exist in the Subdivision. Responding to Chair
Jerke, Ms. Inloes explained the business is a janitorial service, therefore, use of the site will be
primarily for phone calls and management of the business,with the actual work taking place off site.
Char Davis, Department of Public Health and Environment,stated water is supplied by the Left Hand
Water District, and the septic system is already existing for the home. She stated the applicant
plans to tie the existing septic system into the mobile unit,which is allowed, although it will require
an engineer.

Peter Schei, Department of Public Works, stated there is currently dust control on Mountain View
Street,and this proposal will have very little impact to the surrounding roadways and site itself. He
stated the existing accesses will be utilized,and requested the applicant work with the Department
of Public Works for any improvements necessary for parking spaces.
Jim Sutton,applicant,stated he is planning a modular unit,which is permanently anchored,although
he would be able to remove it if the Use by Special Review Permit is ever vacated. He stated the
site will retain its residential look,with very minimal impact on the community. Mr.Sutton stated the
employees,work and supplies are all delivered to individual work sites. He also stated he currently
resides on the site and will continue to do so. Responding to Commissioner Masden, Mr. Sutton
reiterated the unit will be used as the management and administrative office, with all goods and
services delivered to customer sites.
No public testimony was offered concerning this matter.
Responding to Chair Jerke, Mr. Sutton stated he agrees with the Conditions of Approval and
Development Standards.
Commissioner Masden moved to approve the request of James and Gail Sutton for a Site Specific
Development Plan and Use by Special Review Permit#1530 for a Home Business(management
ofjanitorial cleaning contracts within a mobile office) in the A(Agricultural)Zone District, based on
the recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record. The motion was seconded by
Commissioner Long, and it carried unanimously. There being no further discussion, the hearing
was completed at 11:55 a.m.
This Certification was approved on the 4th day of January 2006.
