COLORADO DOUG IKENBERRY, CDPHE LEE MORRISON,WELD COUNTY ATTORNEYS OFFICE TREVOR JIRICEK,DIRECTOR, WCDPI E DEBRA PEARSON, COMMUNITY DEVELOPMENT, ERIE On June 24, 2005, I conducted a routine inspection of the Republic Services of Colorado, Front Range Landfill, located at 1830 WCR 5, in Weld County, Colorado. Edd Nestor and John Kendall with JBK Engineering accompanied me during the inspection. The purpose of the inspection was to inspect and assess the facility's compliance with the "Regulations Pertaining to Solid Waste Disposal Sites and Facilities" (the Regulations) as promulgated by the Solid Waste Disposal Sites and Facilities Act, Title 30, Article 20, Part 1, C.R.S., as amended, and the Development Standards as set forth in Weld County Use by Special Review Permit No. 925 (USR-925). The Standards set forth in USR-925 were adopted by the Town of Erie in Ordinance No. 504. On this date, no deficiencies were observed. Additionally, the following general observations were recorded concerning the facility on this date: 1) For the period of April 1, 2005 through June 30, 2005, a total volume of 1110 yards of materials was recovered for recycling purposes. The total volumes of recyclable materials are broken down into the following categories: 0 yards of cardboard 270 yards of metal 0 yards of plastics/aluminum/glass 840 yards of paper In accordance with the facility's Recycling Demonstration, approved in a letter dated March 22, 1999, the quantity of recyclable materials is reported in the facility's independent quarterly inspection report. 2) All routine monitoring activities (groundwater, methane, and leachate) have been conducted as required. 3) The facility continues to provide service to the Towns of Carr and Hereford as required in development standard #41. Service is not provided to the other towns because alternative trash service has become available in the recent years. 4) The facility maintains radiation detector records documenting all occasions when the -pL0841 200538b4 MIKE ACIMOVIC JULY28,2005 PAGE 2 OF 3 alarm is set-off. During the time of December 18, 2004 through March 24, 2005, the alarm did not sound off. Alpha Group of Boulder, Colorado, last calibrated the detector on July 8, 2004. According to the facility's Radioactive Waste Screening Procedures, the detectors are to be calibrated annually. 5) On this day, I observed the perimeter of the facility. I did not observed windblown debris at the perimeter of the facility. 6) The facility is currently filling in Cell VI and VII. Construction and Demolition materials are being placed in cell VI. Municipal Solid Waste is being placed in cell VII. The facility received 166,002.88 tons of waste during the period of March, 23, 2005 through June 23, 2005. 7) The facility conducted 45 random load inspections during the period of March 25, 2005 through June 24, 2005. There were two load rejections as a result of these inspections. The load was rejected because the load appeared to contain untreated infectious waste. The load rejections occurred on April 5, 2005 and April 12, 2005. The facility is required to conduct a minimum of two inspections per week. According to Mr. Nestor, the facility provides information, to any person(s) that are attempting to dispose of inappropriate household hazardous wastes, concerning Weld County Household Hazardous Waste Collection sites so that the wastes can be properly disposed. 8) The facility maintains a wind speed log. The log was reviewed as a part of the inspection. Two wind closures occurred during the months of March 25, 2005 through June 24, 2005. Those closures occurred on April 5, 2005 and April 17, 2005. 9) All surface water control features are in place and appear to be managing surface water as described in the design and operations plan as well as the temporary structures that are constructed with each individual cell. 10) The facility has provided an annual Household Hazardous Waste Program Summary, from February 2004 through February 2005, to the Town of Erie and Weld County, in accordance with the Household Hazardous Waste Information Program (the Program), approved February 23, 1999. As stated in the Household Hazardous Waste Program Summary, proper signage has been posted at the gate entrance, brochures were available on this day of inspection, the Hazardous Waste Exclusion Plan was properly maintained and on site. The public Household Hazardous Waste Presentation and Education requirements have been fulfilled for the year 2005. SUMMARY: On this day of inspection, I found the facility to be operating in substantial compliance with both the "Regulations Pertaining to Solid Waste Disposal Sites and C\Documents and Settings\vmacklin\Local Settings\Temporary Internet Files\OLKIEB\050624insp doc MIKE ACIMOVIC JULY28,2005 PAGE 3 OF 3 Facilities" and the Standards as set forth in Section 1. of the Town of Erie Ordinance No. 504. As a reminder, Section 1. of Ordinance No. 504 states: "All activities conducted on the site shall be in conformance with the Certificate of Designation and Site Specific Development Standards initially adopted by Weld County and subsequently amended by Weld County or conformed with changes in the sate and federal regulations, as the same may be modified from time to time by the Town." John Kendall of JBK Engineering prepared the construction design documents dated August 2004. The additional information and revisions, requested by the Colorado Department of Public Health and Environment, dated August 30, 2004 has also been reviewed and placed with the August 2004 report. The Report indicates Cell VII was constructed in accordance with the facility's design plans and construction specifications and Special Review Permit (USR-925) along with the recommendations and requirements of the Colorado Department of Public Heath and Environment. As a result, the Department has no concerns with Cell VII construction assurance monitoring and test results report documents as submitted. Edd Nestor accompanied me during this inspection. Windblown waste material and debris was observed to be accumulated along the eastern portion of the fence line. Operations were not conducted accordance with Development Standard No. 13 in the facility's USR — 925, and required by section 2.1.7 of the Regulations. It was also observed that six temporary employees were picking up waste material and debris at the time of the inspection. Additionally, the following general observations were recorded concerning the facility on this date: 1) For the period of September 30, 2003 through December 31, 2003 a total volume of 1390 yards of materials was recovered for recycling purposes. As mentioned above, I observed windblown debris accumulation along the eastern portion of the fence. However, windblown debris did not appear to have left the property boundaries. 6) The facility is currently filling Cell VI. The facility received 159,378.78 tons of waste during the period of September 9, through December 29, 2003. 7) The facility conducted 45 random load inspections during the period of September 9, 2003 through December 30, 2003. No loads were rejected as the result of these inspections. The facility is required to conduct a minimum of two inspections per week. According to Mr. Nestor, the facility provides information, to any person(s) that are attempting to dispose of any inappropriate items, concerning the Weld County Household Hazardous Waste Collection sites so that the wastes can be properly disposed. 8) The facility maintains a wind speed log. Comments ❑ The Public Works Department accepts the Final Drainage Study Aristocrat Ranchettes—Third Filing dated November 2003,by Pickett Engineering, Inc. ❑ The Roadway&Grading Plans submitted to the Department of Public Works are generally acceptable. The following must be included with the resubmitted(stamped, signed and dated)plans: o The applicant shall prepare a construction detail for typical lot grading with respect to drainage. Front, rear and side slopes around building envelopes must be addressed. In addition, drainage for rear and side lot line swales shall be considered. Building envelopes must be planned to avoid storm water flows, while taking into account adjacent drainage mitigation. o The number of street name signs shown on the plans is 23. A street name sign should be added at the corner of Barley Avenue and Patrick Street for a total of 24 -street name signs. The plan legend should be updated. o The number of stop signs shown on the plans is 31. The plan legend must be updated to reflect the total of 31 -stop signs. Public Works appreciates the engineers' traffic plan. o The number of speed limit signs shown on the plans is 3. The plan legend should be updated to reflect the total of 3 -speed limit signs. o The Public Works Department suggests adding five (5) - Type HI Barricades (8) at the east ends of Higgins Avenue, Casler Avenue, Lamb Avenue, Coleman Avenue, and Good Avenue. The plan legend should be updated to reflect the total of eight(8)- Type III Barricades (8). o The 5-no outlet sign locations must be shown on the plans. o Barley Avenue is aligned along a section-line road. The County does not permit direct residential access to section-line roads. As a compromise, the applicant shall plan shared residential accesses along Barley Avenue and plan access along the north/ south streets from bordering lots. The applicant should submit an access plan to Public Works. --- -nm,ww.ma�nee.a�v.m. Page 1 of 2 o The applicant will be .equired to enter into an agreement with the County to proportionately share the cost of paving Patrick Street for the full length adjacent to the proposed development, including the intersection with Barley Avenue. The typical roadway cross-section shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the Roadway & Grading Plans. The cost will be based on a proportion of the traffic generated by the development to existing traffic. The County maintains Patrick Street. The applicant must submit an agreement to Public Works. o The applicant will need to build the full roadway section for Grant Street centered on the '/4 Section Lme dedicating it to the public. The Roadway & Grading Plans must be updated to reflect building the full roadway section. • The external roadway rights-of-way shall be a minimum of 60-feet in width. The typical roadway cross-section shall be shown as two 12-foot paved lanes with 4-foot gravel shoulders on the Roadway&Grading Plans. • The applicant will be required to reimburse the County for obtaining the 30-feet of right-of-way on the east side of the 1/4 Section Lme for Grant Street an amount of$7,150.00. • The applicant will be required to construct a new fence and gate along the new right-of-way line for this project. An existing cattle guard must be removed. The fence must be four strand barbed wire with steel posts set every 16-feet and a wood post being set replacing every third steel post. ❑ A professional traffic impact analysis will not be required. This development will introduce over 1,000 daily vehicle trips from internal paved roads to the surrounding roadways. The applicant shall discuss off-site roadway impacts to vicinity infrastructure due to this proposed development and submit to Public Works. ❑ The applicant shall contact the City of Fort Lupton regarding roadway/paving requirement for Barley Avenue. The applicant must provide Public Works with written documentation. ❑ The applicant shall provide written documentation to Public Works verifying that the roadway layout is acceptable to all other referral agencies,especially the fire department of jurisdiction. ❑ A final geotechnical report must be submitted to Public Works with the final roadway and grading plans. ❑ The applicant shall enter into Improvements Agreements According to Policy Regarding Collateral For Improvements. The Weld County Board Of County Commissioners (BOCC) shall approve these agreements prior to construction, since it is understood that the County will maintain the roadways after a warranty period. The applicant must submit these agreements to Public Works.
