The Violation was initiated due to the operation of a "horse track" without the necessary permits. Prior to receipt of this application (USR-1522), the applicant submitted a "Temporary Assemblage Permit" with the intent to be permitted to operate pending completion of a Use by Special Review Permit. The"Temporary Assemblage Permit" was denied by the Board of County Commissioners. This Violation case was scheduled for an emergency violation hearing; however, since the Board advised the applicant not to operate prior to final approval of a Use by Special Review permit, the hearing was withdrawn. This Use by Special Review application, if approved, will bring the property into compliance. This soil has slight limitations for dwellings with or without basements as well as for septic absorption fields. PRIME FARMLANDS: Valent sand soil is not considered`prime farmland'. SOIL EROSION POTENTIAL: The Valent sand soil found on the proposed commercial development parcel has very high potential for wind erosion. Appropriate measures should be taken to minimize wind erosion during future construction activities, such as avoiding disturbances to large areas and preventing soil movement offsite. Developments such as race tracks with their associated facilities including parking areas result in large areas being disturbed during construction and continuing during ongoing operation. Frequent movement of vehicles,people and horses in the proposed development parcel will likely result in regular episodes of fugitive blowing dust. It is strongly recommended that at the conclusion of construction activities disturbed areas be stabilized with gravel,pavement and,perhaps,perennial vegetation in areas that will not be used on a regular basis. Should fugitive dust become a nuisance problem during operation, regular application of water to tracks,parking areas and other associated facilities to reduce the problem. The NRCS can be contacted for more information on grasses suitable for the site and instructions for planting. OTHER: Weed infestation can be a serious problem with connnercial developments such as that proposed. Should this occur the applicant can contact Tina Booton, Vegetation Weed Management Specialist with the Weld County Public Works Department at(970)304-6496 X3772 for assistance in developing a weed management plan for the facility. A building permit shall be obtained prior to the construction of any new building. 2. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Commercial Plans shall bear the wet stamp of a Colorado registered architect or engineer. Residential plans may be required to bear the wet stamp of a Colorado registered architect or engineer.Two ^ complete sets of plans are required when applying for each permit.A Code Analysis Data sheet provided by the Weld County Building Department shall be submitted with each commercial building permit application. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Mechanical Code;2003 International Plumbing Code;2003 International Fuel Gas Code;and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. Each commercial building will require an engineered foundation based on a site-specific geotechnical report or an open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a Colorado registered engineer. The foundation for the residential structure is required to be engineered based on a soils report oran open hole inspection 5. The buildings will probably be classified as: 1. A-4 (Indoor Riding Arena). An automatic sprinkler system throughout will be required. 2.A-3 (Outdoor arena)An automatic sprinkler system will be required in concession stands, retail areas, press boxes, and other accessory areas in excess of 100 square feet. 2. Bathrooms are accessory to the arenas. An occupant load of 2000 will require 13 water closets for males of which 67% may be urinals. 7 lavatories are required. Bathrooms for females will be required to have 25 water closets and 7 lavatories. 2 drinking fountains for the facility will be required. If the occupant load is phased in,the following will be required based on an occupant load of 1079. Males:7 water closets. 67% may be urinals. 2 lavatories are required. Females: 13 water closets and 4 lavatories. 1 drinking fountain for the facility will be required. All buildings will need to be accessible to persons with disabilities. If the initial arena has a seating capacity of 2000 and is not phased in, the number of bathrooms will be based on the occupant load of 2000. Service,Teamwork,Integrity,quality 6. Fire resistance of walls and openings, construction requirements, maximum building height, automatic sprinkler requirements and allowable areas will be reviewed at the plan review. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. Water Division 1,Water District 2 Dear Ms. Hatch: This referral does not appear to qualify as a"subdivision"as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this development or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The referral information states that the commercial facility will be served by a well. According to Table 1, 13.46 acre-feet of water will be required annually for sanitary use, drinking water, livestock watering, dust control, caretaker house and lawn and garden irrigation. A well permit, permit no. 62749-F, was issued on June 9, 2005 on the subject property. The well permit allows the withdrawal of up to 13.1 acre-feet of withdrawal annually from the Laramie-Fox Hills aquifer for commercial purposes. The applicants estimated annual water use requirements exceeds the quantity of water the applicant is allowed to withdraw through the subject well. Water in the Denver Basin aquifers is allocated based on a 100-year aquifer life under the provisions of C.R.S. 37-90-137(4)(b)(l). For planning purposes the county should be aware that the economic life of a water supply based on wells in a given Denver Basin aquifer may be less than the 100 years indicated due to anticipated water level declines. Furthermore, the water supply plan should not rely solely upon non-renewable aquifers. Alternative renewable water resources should be acquired and incorporated in a permanent water supply plan that provides future generations with a water supply. The permit requires that the well be constructed into the Laramie-Fox Hills formation to a depth not to exceed 410 acre-feet and a maximum discharge of 20 gallons per minute. The State Engineer reduced the annual withdrawal rate requested from 20.61 acre-feet to 13.1 acres due to a pre-213 well (permit no. 16133-F). The well's cylinder of appropriation overlapped 30 acres of the subject property. Enclosed is a copy of the permit. In order to comply with the annual withdrawal limit of 13.1 acre-feet,I have revised and enclosed my water demand. I had originally assumed that each event would require 15,000 gallons of water for dust suppression per event. This overly conservative estimate has been reduced to 12,000 gallons per event. Typical gravel mine require approximately 3 to 4 acre-feet annually for dust suppression. My revised annual estimate is 5.93 acre-feet,which is twice the volume required for gravel mines operating 260 days per year. In my opinion,the reduction of the water for dust suppression from 15,000 gallons to 12,000 gallons per day is more than sufficient to manage dust. My revised water demand shows that the annual maximum water demand will be 11.96 acre-feet. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this development or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The referral information states that the commercial facility will be served by a well. According to the applicants amended water requirement estimate, 11.96 acre-feet of water will be required annually for sanitary use, drinking water, livestock watering, dust control, caretaker house and lawn and garden irrigation. A well permit, permit no. 62749-F, was issued on June 9, 2005 on the subject property. The well permit allows the withdrawal of up to 13.1 acre-feet of withdrawal annually from the Laramie-Fox Hills aquifer for commercial purposes. Therefore, the annual amount of withdrawal allowed under proposed well no. 62749-F is adequate to serve the site, according to the applicant's water use requirements. Water in the Denver Basin aquifers is allocated based on a 100-year aquifer life under the provisions of C.R.S. 37-90-137(4)(b)(l). For planning purposes the county should be aware that the economic life of a water supply based on wells in a given Denver Basin aquifer may be less than the 100 years indicated due to anticipated water level declines. Furthermore, the water supply plan should not rely solely upon non-renewable aquifers. Alternative renewable water resources should be acquired and incorporated in a permanent water supply plan that provides future generations with a water supply. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 39 is a collector road and requires an 80-foot right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. Section Line Access: (right-of-way) To determine if a road right-of-way exists along your section line, determine the land patent date. Weld County may, if approved by the BOCC, grant a Nonexclusive License —4greement for the upgrade and maintenance of private improvement within this right-of-way. The applicant shall complete a Nonexclusive License Agreement for the Upgrade and Maintenance of Weld County Right-of-Way. (WCR 28) REQUIREMENTS: Section Line: The Weld County Public Works Department has researched the patent date through Land Title and has determined that there is only 30 feet of County right-of-way available in Section 30 only. Section 31 predates 11-8-1881 our 1889 Resolution. Therefore, we cannot claim any additional right-of-way in section 31. All of the access road should be built within Section 30 on your property. Road Improvements Agreement: WCR 28, section line road access, shall be upgraded to accommodate two-way traffic. The section line road or driveway must be constructed and maintained at a minimum as a graded and drained all-weather surface. Consideration must be given to the width of two-way traffic and weight of emergency services equipment, fire trucks, ambulances, etc., which may need to access the property. Dust Suppressant: With the maximum number of vehicles and the frequency of the use of the access road, the Weld County Public Works Department recommends magnesium or calcium chloride application to the access road. The applicant indicated that they would have a water truck available. This could be utilized for on-site dust suppressant and maintenance of the track. The applicant shall provide a detailed drawing of the intersection of WCR 39 and WCR 28 (section line access) shown either by realignment or matching the grade, type of surface, width and depth of base and asphalt, how its intersection will function to accommodate adequate turning radiuses, stop condition, drainage, and adequate sight distance in all directions. .Jacqueline Hatch, Planner JSR-1522, Alberto Loya July 28, 2005 Page 2 Off-Street Parking: The applicant is had identified the primary parking on the north side of the facility, employee and handicap parking adjacent to the future outdoor arena and track area. The secondary parking, horse trailer parking located on the south end of the facility, parking spaces, and access drives shall be surfaced with gravel, recycled asphalt, or the equivalent and shall be graded to prevent drainage problems. Circulation: The circulation throughout the site appears to be adequate. The applicant has identified pedestrian walkways. The Weld County Public Works Department recommends that the applicant either use crusher fines or recycled asphalt placed in the designated areas shown on the plat drawing for pedestrian circulation. There shall be no staging or parking of vehicles on WCR 39. Utilize on-site parking. Signs: The Weld County Public Works Department requests the applicant agree to a Nonexclusive License Agreement, which would provide a blue and white cross road sign at the intersection of WCR 39 and section line WCR 28. Also attached to the sign will be a stop sign indicating a stop condition prior entering WCR 39/WCR 28 intersection. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a __manner that it will reasonably preserve the natural character of the area and prevent property damage of the jpe generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. The applicant must take into consideration storm water capture/quantity and provide accordingly for best management practices. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facilities and shall be installed according to the Weld County Individual Sewage Disposal Regulations. 2. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 3. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 4. A stormwater discharge permit may be required for a development/redevelopment/construction site where a contiguous or non- contiguous land disturbance is greater than or equal to one acre in area. The applicant shall inquire with the Water Quality Control Division (WQCD) of the Colorado Department of Public Health and Environment at www.cdphe.state.co.us/wq/PermitsUnit if they are required to obtain a stormwater discharge permit. Alternately, the applicant can provide evidence from WQCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. The applicant shall remove, handle, and stockpile manure from the livestock area in a manner that will prevent nuisance conditions. The manure piles shall not be allowed to exist or deteriorate to a condition that facilitates excessive odors, flies, insect pests, or pollutant runoff. 2. Animal and feed wastes, bedding, debris and other organic wastes shall be disposed of so that vermin infestation, odors, disease hazards, and nuisances are minimized. Such wastes shall be removed at least weekly from the facility and disposed by a commercial hauler. 2 3. The facility shall be operated in a manner to control flies. 4. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 5. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 6. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 7. The applicant shall operate in accordance with the approved "waste handling plan". 8. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved dust abatement plan at all times. 9.
