The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area:open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts, including noise from tractors and equipment;slow-moving farm vehicles on rural roads;dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient Page 4 delivery of irrigation to fields which is essential to farm production. Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads,no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal from roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas,in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 5. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 6. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00. The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be sent to mapseco.weld.co.us. 7. The Weld County Department of Planning Staffs approval of this Recorded Exemption Application is based on satisfying the Conditions of Approval.Should an applicant be unwilling or unable to meet any one of these conditions within 60 days of approval, then this case will be forwarded to the Weld County Board of County Commissioners with a staff recommendation for denial. 8. In accordance with Weld County Code Ordinance 2005-7 approved June 1,2005,should the plat not be recorded within the required sixty(60)days from the date the Administrative Review was signed a $50.00 recording continuance charge shall added for each additional 3 month period. One of the required Conditions of Approval grants applicants sixty(60) days to submit a Mylar Plat. Should you choose not to complete the recorded exemption process and provide the required Mylar Plat, the Department of Planning Services will need to be notified in writing of your decision. If you do not formally withdraw your application and/or are unable to meet the Conditions of Approval, your case will be scheduled for a hearing before the Weld County Board of County Commissioners. Planning Staff will be recommending denial or your request at this hearing. If your application is denied by the Board of County Commissioners, the decision could affect future land development applications located on this parcel. Withdrawing applications will not generally affect future applications. Planning Services Staff is aware of the difficulty and associated delays in meeting the Conditions of Approval normally associated with land use cases, and is willing to work with you in completing your request. Rodriguez RE Application Donald, Per our conversation a site inspection was conducted on the J.Rodriguez property located at WCR 94 and WCR 33. As you requested the following items were inspected with regards to the newly constructed road: Depth of gravel —The depth of the Class 6 is unknown but J. Rodriguez claims it was placed at 6 inches. The Class 6 is in place but not compacted. There is no verification of compaction of road as a Proof Roll test was not conducted and compaction tests have not been completed. Width and Length of Road —800 feet in length and 36 feet in width, cul-de-sac not included in inspection. Street Signs—Street signs were not in place. J Rodriguez claims that the Weld County Planning Department would not allow him to place street signs at this time. Stop Sign —Stop sign was in place 25 feet from centerline of WCR 94, see attached picture. Storm Water Drainage—Ditches are cut in at a 2:1 slope on left/right sides of road. Further work is needed to allow drainage off of the property and along WCR 94. Currently there is no outlet for storm water in the ditches due to sediment piles at the end of the ditches, see attached pictures. Culvert—A 15 inch culvert has been installed along the entrance to the property. It has been recommended that straw bails be used at the base of the slope to allow the majority of sediment to settle out and not accumulate within culvert. Currently there is approximately 2-5 inches of sediment and debris deposited within the culvert, see attached pictures. Pease let me know if you have any questions or need any further information. -Kelly 03/10/2006 t. Jess Rodriguez 4-Lot Recorded Exemption Questionnaire The purpose of this proposal is a four-lot Recorded Exemption on a parcel of land located in the west half of the western half of Section 14, Township 8 North, Range 66 West of the 6th P.M., in Weld County, Colorado. The current and proposed configuration is attached in map format. The proposed configuration proposes an efficient shared access point for the benefit of Lots A, B and C. The proposed Lot configurations also allow for a clustering of the proposed Lots A — C to retain a large Lot D. The resulting parcels will be 4.5+/-, 4.5+/-, 4.5+/- and 146.5 +/- acres in size for Lots A, B, C and D respectively. Acreages are approximate and will be finalized by the plat after review. The proposal is consistent with the surrounding uses, which include rural residential and agricultural uses. Each lot will remain in agricultural zoning consistent with the surrounding properties. This proposal is consistent with application standards found in the most current Procedural Guide. Domestic and Irrigation Water Supply statements: Domestic water is proposed through individual wells. Irrigation water is not associated with the site. Sewage Disposal statement: All future septic construction shall be permitted through the Weld County Department of Environmental Health and Environment. Current Property Use: The property is being used for Range activities. A barn exists on the proposed Lot D in the southern portion of the property. Future Property Use: The future property use will be residential and those uses allowed by the existing agricultural zone district. Unique Site Characteristics: There are no characteristics unique only to this site. Building Envelope Designation: The designation of a building envelope on the proposed Lots A - C is not applicable to this application as these lots cannot further subdivide and are small in relative size. The proposed Lot D does not necessitate designation of a Building Envelope. Existing improvements are located in the southern portion of proposed Lot D. Current Land Use Permits Associated with the Property: Currently, no special land use permits are associated with either lot. 1 This proposal is consistent with the Exemption standards of Section 24-8-40 of the Weld County Code as follows: 24-8-40.A The water supply for all proposed lots is adequate in terms of quality, quantity and dependability. Wells are the proposed source of water. 24-8-40.B An adequate sewer service is available to serve the uses permitted on all proposed lots. The sewer service shall comply with the requirements of the applicable zone district and the Department of Public Health and Environment. All proposed shall be served by individual sewage disposal systems (septics) permitted through the Weld County Department of Public Health and Environment. 24-8-40.C An access is, or can be made, available that provides for safe ingress and egress to a public road. All accesses shall be in accordance with Chapter 8, Article II of this Code. Safe access is available to the proposed lots. An Existing access from Weld County Road 94 serves the property. The proposed Lots A, B and C shall share an access point. Access points shall remain as illustrated on the attached maps. This application, and support materials contained herein serve as an Access Plan for the property. Lots A — C shall share an access. The justification for the retention of all access points illustrated on the attached RE Map is due to continued and future agricultural practices on site. Due to the property length being one mile, it is imperative that two access points are available to Lot D. This will decrease the potential degradation of the existing vegetation on site. 24-8-40.D The proposed recorded exemption will comply with Chapter 23, Article V of the Weld County Code. All lots shall comply with Article V, Chapter 23 of the Weld County Code. This section of the Weld County Code stipulates regulations for development in overlay district areas. This proposal is not in the Geologic Hazard Overlay District, the I-25 Mixed Use Development District, the Greeley/Weld County Airport Overlay District or the floodplain as determined through review of documents on file with the Weld County Department of Planning Services and FEMA FIRM Community Panel #080266 0325C. A copy of this property on this map is included with application materials. The property is not within an Intergovernmental Agreement Urban Growth Boundary or a standard Urban Growth Boundary area as determined by review of current maps located in Chapter 19 of the Weld County Code. The site is located approximately 1/2 mile north of the standard Urban Growth Boundary for the Town of Pierce and approximately 3 miles south of the Town of Nunn. 24-8-40.E The proposal is consistent with the policies and goals of Chapter 22 of this Code. This proposal is consistent with the goals and policies outlined in the Weld County Comprehensive Plan, Chapter 22 of the Weld County Code. This proposal considers the current and future use of the property in determining the proposed lot 2 configuration and proposed shared access point, therefore conforming to the underlying principles of orderly development. A. Goal 3, as found in Section 22-2-60.C indicates, "Provide mechanisms for the division of land which is agriculturally zoned." The Recorded Exemption process was established to subdivide agriculturally-zoned. This application is for a four-lot Recorded Exemption. Further, A.Policy 3.3.3 as found in Section 22-2-60.C.3.c states that safe and adequate access onto County roads shall be evaluated. This proposal stipulates that proposed Lots A, B and C share one common access point with the concurrent Recorded Exemption located west of this property. Therefore, six proposed lots will share one access point. An access agreement/easement shall be noted at the sale for all future owners of these lots. The access agreement/easement shall stipulate the access will cross Lots A and B for the benefit of Lots A, B and C on both Recorded Exemption applications. R.Policy 2.4, as found in Section 22-2-190.B.4 stipulates, "Conservation of natural site features such as topography, vegetation and water courses should be considered in the project design." These exact features were considered when designing the location of all proposed lots. 24-8-40.F The proposal is consistent with any adopted intergovernmental agreement, if applicable. This proposal is not within an Intergovernmental Agreement area per Chapter 19 of the Weld County Code. 24-8-40.G The proposal has taken into consideration master plans of affected municipalities. The proposed use should not alter activities of surrounding municipalities as it is not within an Intergovernmental Agreement Urban Growth Boundary area per Chapter 19 of the Weld County Code. The site is located approximately Y mile north of the standard Urban Growth Boundary for the Town of Pierce and approximately 3 miles south of the Town of Nunn. 24-8-40.H The proposal is consistent with existing surrounding land uses. Existing surrounding land uses include agricultural and rural residential. This proposal will be consistent with surrounding land uses. 24-8-40.I The proposal is consistent with the intent of the zone district the exemption is located within as expressed in Chapter 23 of this Code. The proposed property use will be residential and uses allowed by the Agricultural zone district. 24-8-40.J The proposal is consistent with sound land use planning practices. This proposal has considered the current and future land use of the property to determine proposed property boundaries, therefore conforming to the underlying principles of orderly development. The proposed division between Lots A, B and C from D is based upon efficient and orderly use of the property. This division would 3 allow Lots A, B and C to share an access, reducing access points on the County Road network. 24-S-30.K The proposal is consistent with the Statement of Purpose as expressed in Section 24-1-30 of this Chapter. The Statement of Purpose of Section 24-1-30 details eighteen criteria used to achieve orderly and efficient development in Weld County. This application meets, exceeds, or does not impact the following criteria: 24-1-30.A Assisting orderly and integrated development. This proposal has considered the current land use of the property to determine proposed property boundaries, therefore conforming to the underlying principles of orderly and integrated development. Utilizing current land use patterns for this property in determining the Recorded Exemption lot boundaries ensures the ability for continuance of activities on site. 24-1-30.B Promoting the health, safety and general welfare of the residents of the County. Water service and sewage disposal will be accomplished by safe means as stated previously in this application. 24-1-30.C Ensuring conformance of land subdivision plans with the public improvement plans of the County and its various municipalities. The resulting parcel sizes are compatible with surrounding parcels and consistent with existing development in the area. The uses allowed on these parcels shall be those allowed by right in the agricultural zone district. 24-1-30.D Ensuring coordination with public municipal improvement plans and programs. This proposal should not affect municipalities in the area as it is not located within an Intergovernmental Agreement Urban Growth Boundary per Chapter 19 of the Weld County Code. 24-1-30.E Encouraging well-planned subdivisions by establishing adequate standards for design and improvement. The uses allowed on these parcels shall be those allowed by right in the Agricultural zone district. The proposed division is based on past and current uses of the property. The proposed and current access points follow current and proposed property uses. The proposed shared access for Lots A, B and C on two applications is efficient and orderly and follows design criteria for a well-planned subdivision. 24-1-30.F Improving land survey monuments and records by establishing standards for surveys and plats. A surveyor shall prepare final documents to be recorded with the County. Such documents shall conform to current standards of Weld County. 4 24-1-30.G Safeguarding the interests of the public, the homeowner and the subdivider. The referral and review process established by Weld County will ensure the interests of the public and the applicant will be handled in an equitable manner, therefore, safeguarding their interests. 24-1-30.13 Securing equitable handling of all subdivision plans by providing uniform procedures and standards. The referral and review process established by Weld County will ensure the interests of the public and the applicant will be handled in an equitable manner, therefore providing uniform procedures and standards for review of all applications of this nature. 24-1-30.I Preventing loss and injury from fire in wooded terrain. This is not applicable. 24-1-30.J Preserving agricultural land and promoting its most productive agrarian use. The property is classified as Prime, if they become irrigated lands. A portion of the northwestern quarter is unclassified. This information was obtained by review of the USDA Prime Agricultural Land map on file with Weld County Planning Services. The property is currently used for Range purposes. Agricultural uses will continue on portions of the property. 24-1-30.K Ensuring that irrigation water currently associated with a farm or rural unit of land will be retained for agricultural uses. This is not applicable to this application. 24-1-30.N Preventing flood damage to persons and properties and minimizing expenditures for flood relief and flood control projects. This is not applicable to this application. 24-1-30.0 Restricting or regulating building in flood hazard overlay district areas, shorelands, areas covered by poor soils or area poorly suited for building or construction. This is not applicable to this application. 5 24-1-30.P Preventing loss and injury from land slides, mud flows and other geologic hazards. This is not applicable to this application. 24-1-30.Q Providing adequate space for future development of schools and parks to serve the population. This is not applicable to this application. 24-1-30.R Ensuring the planning for and provisions of an adequate and safe source of water and means of sewage disposal. This question has been addressed elsewhere in this application in accordance with current State and County standards. 24-8-40.L The minimum size of any lot proposed with a public water supply is not less than one(1) acre net. The minimum size of any lot proposed with a well as the water supply is not less than two and one-half(2-1/2) acres net. Planning, Michelle Martin I • DATE: June 21, 2005 FROM: , EH Service Blandin COLORADO CASE: RE- 4138 APPLICANT: Jess Rodriguez Environmental Health Services has reviewed this proposal; the following conditions are recommended to be part of any approval: 1. A Weld County Septic Permit is required for the proposed home septic system(s) and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Additionally, please note the following: 1. This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 2. Topographic or physical features of the proposed lot, such as ravines, ditches, streams, etc. may limit the area available for a new or replacement septic system. Prior to recording the plat the Division recommends that the applicant review the County Code pertaining to Septic Systems to assure that any installed septic system will comply with all setback requirements found in the Code. In the event the proposed lot is not of sufficient size to allow the installation of a septic system the lot may be need to be enlarged. • • Weld County Planning Departmen GREELEY OFFICE MEMORANDUM JUN 28 2005 ' ` RECEIVED TO: Michelle Martin, Planner II DATE: June 27, 2005 FROM: Donald Carroll, Engineering Administrator ; • CSUBJECT: RE-4138, Jess Rodriguez 1 COT AIR A no The Weld County Public Works Department has reviewed this proposal. Our comments and requirements are as follows: COMMENTS: Weld County Road Classification Plan (FHU): (June 2002) WCR 94 is a local gravel road and requires a 60-foot right- of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. WCR 33 is a local gravel road and requires a 60-foot right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application with concerns on circumventing the minor subdivision process. Road Access Policy: (Policy Established Sec. 8-2-10) Direct access from a public road will be limited to one (1) per legal parcel, except as further limited or restricted by zoning or subdivision regulations. Additional accesses may be approved by the Department of Public Works or the Board of County Commissioners. This policy shall apply to all new and existing accesses within the unincorporated areas of the County. Properties within municipalities or other counties which access County roads are subject to this policy.(Lots A, B & C shall access on to the internal road system with the cul-de-sac. If a drainage culvert is required, a 15-inch corrugated metal pipe is the County's minimum size requirement. If the applicant chooses to place a larger culvert, please contact the Public Works Department to adequately size your culvert. The access shall be placed in such a location to have adequate sight distance in both directions and not below the crest of a hill or where physical obstructions are present. Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation. (Lot D) Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. The applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Section line accesses are considered private lanes with no county maintenance. In accordance with Section 24-7-50 J of the Weld County Code, Chapter 24, Article VII, the flag lot configuration will be avoided where possible. The minimum width of a flag lot is 30 feet. The right-of-way or easement shall be a graded and drained road to provide an all-weather access. pc: RE-4138 M:\PLANNING-DEVELOPMENT REVIEW\RE-Recorded Exemption\RE-4138.doc - 1 - • • Weld County Planning Denartmen`'.
