HomeMy WebLinkAbout20051722.tiff RESOLUTION RE: APPROVE CONTRACT FOR OMBUDSMAN PROGRAM AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Contract for the Ombudsman Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services,Area Agency on Aging, and the Victim Assistance and Law Enforcement Board, commencing July 1, 2005, and ending June 30, 2006, with further terms and conditions being as stated in said contract, and WHEREAS, after review, the Board deems it advisable to approve said contract, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Contract for the Ombudsman Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services,Area Agency on Aging, and the Victim Assistance and Law Enforcement Board be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said contract. Enclosed for Board approval is the 2005-2006 VALE contract between the Victim Assistance and Law Enforcement Board and the Weld County Area Agency on Aging. This funds help support victim assistance services that are being provided by the Weld County Area Agency on Aging's Long Term Care Ombudsman Program. The grant amount is $8,500. The effective dates of the contract are July 1, 2005 through June 30, 2006. VICTIM'S ASSISTANCE AND LAW ENFORCEMENT BOARD 19TH JUDICIAL DISTRICT CONTRACT CONTRACT between Victim Assistance and Law Enforcement Board ("Donor") and Weld County Area Agency on Aging, Division of Human Services ("Recipient"), P.O. Box 1805 Greeley, CO 80632 for the funding of Weld County Long Term Care Ombudsman Advocate/Friendly ("Grant", "Grant Application" or "Project"), as described in your Grant Application for the period commencing on July 1, 2005. The parties (Donor and Recipient) in consideration of the mutual promises contained herein agree as follows: 1. The Recipient hereby contracts to perform the services outlined in the Grant Application, as submitted to the VALE Board and incorporated herein by reference. 2. The parties acknowledge that the Grant contemplated herein is made pursuant to Colorado law and the Recipient specifically agrees to use the Grant for the purposes specified in C.R.S., 1973, S24-4.2-105, as amended. In addition, the Recipient agrees to submit to the Donor quarterly reports, including a"Grant Report Form" and a"Narrative Report." Furthermore, EIGHT (8) COPIES of quarterly reports are due October 31, 2005; January 31, 2006; April 28 2006 and July 28, 2006 which are the last working days of the month following the end of each quarter. Failure to submit quarterly reports may result in withholding of funds and/or grant termination. 3. The Grant commences on July 1, 2005, and terminates on June 30, 2006. 4. The Donor hereby grants to the Recipient the sum of$8,500 of which an initial sum of$2,125 will be paid to the Recipient on or about July 15, 2005. The projected disbursement of the balance will be paid as follows: $2,125 on or about October 31, 2005 $2,125 on or about January 31, 2006; $2,125 on or about April 28 2006 5. The Grant may be terminated by the Donor if: (a) the Recipient does not submit the required quarterly reports, or if the reports or other information does not show adequate achievement of the Grant purpose(s) as stated on the Grant Application and pursuant to C.R.S., 1973 S24-4.1-105, as amended; or, Weld Agency on Aging CONTRACT PAGE 2 (b) the Donor has insufficient funds to continue the Grant. Before termination for inadequate achievement, the Recipient shall have an opportunity to meet with the Donor. The Grant may be terminated by the Recipient at any time. 6. At the end of the Contract term, or upon Contract termination, all unspent funds shall be returned to the Donor. 7. The Contract termination date may be extended by written mutual agreement of the Donor and Recipient. The services to be provided may also be modified by written mutual agreement of both parties (Donor and Recipient). The signatories certify that we have read the Contract and are fully cognizant of our duties and responsibilities for this Project.
