Water Division 1,Water District 2 Dear Mr. Ogle: This referral does not appear to qualify as a"subdivision"as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments will not address the adequacy of the water supply plan for this development or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The subject property is currently served by an existing well, permit no. 42685. The well permit was issued in August 1970 and allows the well to be used for domestic purposes. The applicant is currently seeking the ability to operate a home business that will produce wood chip products for distribution to distributors. According to the referral information no employees will be required to operate the business, other than the property owners, and there will be no customers visiting the property, since the product will be sold solely to distributors. Since the home business will not require employees, other than the property owners, and will not service customers, a commercial well permit would not required. However, if the applicant expands the use of the well to serve additional structures or add additional landscaping a new well permit may be required. This project falls primarily under the purview under the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state highways. Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional requirements that may be needed to obtain or upgrade the permit. (1-76 Frontage Road) Section Line: The south side of the property is the section line between Sections 20 and 29, Township 1 North, Range 65 West. The Weld County Public Works is verifying the status of the right-of-way adjacent to the property. "EQUIREMENTS: .ction Line Access: To determine if a road right-of-way exists along your section line, the Weld County Public Works Department will search through the title company the land patent date. This will determine if there is right-of-way on the section line. Plat Drawing: If right-of-way is determined, the applicant needs to place the appropriate right-of-way on the plat drawing. Section Line Access: The section line (public right-of-way) may be used to accommodate land splits or land locked parcels, which do not have frontage to public right-of-way, such as the property directly west of your proposed USR. The right-of-way or driveway adjacent to the section line shall be a graded and drained road to provide all-weather access to the property. Off-Street Parking and Loading Area: The off-street parking and loading area shall be surfaced with gravel or the equivalent and graded to prevent drainage problems. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. We have no objections to the proposal, however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence to the Department of Planning Services, from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the use. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. Fugitive dust and fugitive particulate emissions shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the -, Commercial Zone as delineated in 25-12-103 C.R.S., as amended. [j: EXHIBIT 6. Adequate toilet and handwashing facilities shall be provided. The family members are allowed to use the toilet facilities located in the residence. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 10.The operation shall comply with all applicable rules and regulations of the State and Federal agencies and the Weld County Code. 2 Hello
