'- - - OE ^1900{._ 6 9 'v,' MS:VO ..<alT.i_ n..... --.., ,. x(....a. r..a_...�.:. _-:n sa':t-rmu�.°wmil.a ..aac3o'�'mcai RESOLUTION RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 65: 80 :13 FOR A FIRE- WOOD PROCESSING FACILITY ON A TRACT OF LAND LOCATED IN PART OF SECTION 17 , TOWNSHIP 6 NORTH, RANGE 67 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, plrsuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado helld a public meeting on the 29th day of December, 1980 at the hour of 9 : 00 o' clock a.m. for the purpose of hearing the application :of Al and Jean Butzine for a Conditional Use Permit for a firewood processing facility on the following described real estate, to-wit: A parcel situated in the Northwest o of Section 17 , Township 6 North, Range 67 Vest of the 6th P.M. , Weld County, Colo- rado, being more particularly described as follows: Commencing at the West 4 corner of the aforementioned Section 17 and consider- ing the west line of said Section 17 to bear N 0°14 ' 53" E and with all bearings contained herein relative thereto, thence N 0°14 ' 53" E, a distance of 1087.11 feet, more or less, to the True Point of Beginning; thence S 89°45' 07" E, a distance of 268. 00 feet, more or less, to a point; thence N 0°14 ' 53" E, a distance of 130. 51 feet, more or less, to a point; thence N 53°48' 57" W, a distance of 81. 16 feet, more or less, to a point; thence N 0°14 ' 53" E, a distance of 6. 0 feet, more or less, to a point; thence N 47°03 ' 16" W, a -distance of 275. 24 feet, more or less, to a point on the west line of the Northwest 4 of the aforementioned Section 17; thence S 0°14 ' 53" W, a distance of 350. 79 feet, more or less, to a point, 'said point being the True Point of Beginning. The above described parcel is subject to all easements, agreements and rights-of-way now existing or on record. WHEREAS, the petitioner was present, and WHEREAS, evidence was presented in support of approval of the Conditional Use Permit for a firewood processing facility, and WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution / // PL0933 ,t,z /2 /� 7 800400 PL0933 I _ authorizes such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- sent, has studied the request of the petitioner and the recommen- dations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permitlfor a firewood processing facility on the hereinabove described real estate complies with all of the conditions as set out in Section 3. 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Al and Jean Butzine for a Conditional Use Permit for a firewood processing facility on the hereinabove described tract of land be, and hereby is , granted subject to the following conditions: 1. The Development Standards contained in the Conditional Use Permit. 2. No building or electrical permits shall be issued on the Conditional Use Permit area until the Development Standards for the Con- ditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. BE ITI FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the reasons for approval contained in the Planning Commission recommendations dated December 16, 1980 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. Question 1d . -- "A description of the proposed operation in sufficient detail to indicate effects of the operation in producing air and water pollution, odor, noise , glare , fire or other safety hazards "and traffic conjestion. " The wood operation would include the following steps : I . Wood delivered by truck to operation site by wholesale wood suppliers . II. Cutting the wood product into 16" lengths . (Explanation of step II ) Wood suppliers either bring the wood on site in tree length or 81 lengths . If tree lengths arebrought, then, we would cut to 8I lengths by means of a chain saw. After all the logs are cut into 81 lengths , then we cut them into the desired length of 16". by means of a buzz saw driven by a small farm tractor. III. Spliltting _of 16" logs . (Explanation of step III) The logs will either be split by a hydraulic log splitter or a cone splitter powered by a small farm tractor. IV. Bundling of split wood into 1 cubit foot bundles . (Explanation of step IV) This is a manuel opera- tion that the split wood is put into jigs and are tied by hand with twine . Storage of bundled wood is normally inside of existing shed located in the proposed area. ONA gcnlrc $AG1S NOTE : on occassion wood will be soldpby the cord or portions thereof . Sales Tax License Number is 14-18459 . V . Delivery of bundled wood . (Explanation of step V ) , Delivery of bundled wood to retail stores is done presently by two ton trucks and pickups . Page 2 of 2 As you can see by the described information of operation . -- that air and water pollution, odor, glare , and traffic - - r -- congestion does not pertain to this type of business . • The only two areas are noise and fire hazards . The fol • - lowing information 'covers these areas . - • - NOISE : Limited , if no-use , of chain saws will he our operation, and limited to daylight hours . The noise produced by a small farm tractor is less than the nor- mal farming operation on all sides of the proposed site . The North and West sides of proposed site has a 9' hedge of Russian Olive trees , and the South and East side has a 3 ' Honeysuckle hedge (soon to be 8 ' ), which will reduce the noise factor even further . We have only one neighbor within a quarter of a mile , and they have no objections to this type of operation. Possible future operations would include a building in which all sawing (after 8 ' lengths were cut ) , splitting, bundling and storing would take place . At which time we would probably go to all electrical systems , which would almost eliminate the noise factor. FIRE HAZARD : This is such a remote possibility, but I willladdress this area. Our wood products are neatly piled with bark Lnd scrap wood piled arl hauled off frequently. Normally, less than 100 cords will be stored No other structure is located near the pro- posed Site with the exception of the existing shed . Question le . -- "A description of methods for disposal of sewage or other wastes in a sanitary and healthful manner." This question does not apply to our operation. Question lf . -- "A description of methods for supplying water in such a manner .as to be adequate in quantity, quali- ty and dependability for the proposed use . Information on source of the WATER SUPPLY must be furnished . If a well, the gallons per minute , the State date of adjudication, and the well permit . If water is furnished by a water district, a contractlor letter from the district stating they are sup- plying or can supply the necessary water . • This qu stion does not apply to our operation. That concludes the questions asked on Form 8n9-79-022 . For general information this business will be operated by family me4ers , and no plans are made for full time workers . It formed in mixed outwash deposits . Included in this unit are some soils with dark surface layers. Some leveled areas were also included in mapping. Typically Ehe surface layer is grayish brown fine sandy loam about 10 inches thick. The subsoil is yellowish brown to very pale brown fine sandy clay• loam about 14 inches thick. The substratum, to a depth of . 60 inches ,' is calcareous fine sandy loam. I Permeability is moderate. Available water capacity is moderate. :1 Effective rooting depth is 60 inches or more . Surface runoff is medium and erosion hazard is low. . Where irrigated this soil is suited to all crops adapted to this area, (FiUu2E i3) including corn, sugar beets , beans , alfalfa'', small grains , potatoes and onions,. An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage , sugar beets , small grain, beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may ae needed for proper water application. All methods of irrigation are suitable with furrow irrigation the most common type used. Good cultural practices such as stubble mulch farming, strip cropping and minimum tillage are needed to combat wind and water erosion. • Terracing may also be needed to control water erosion. The potentlial native vegetation on this site is dominated by sand blue- stem, sand reedgrass and blue grama. Needle-and-thread , switch grass , • sideoats grama and western wheatgrass are also prominent. Potential production ranges from 2200 .pounds per acre in favorable years to 1800 pounds per acre 'in unfavorable years. When range condition deteriorates, vita? sand bluestem, sand recdgrass and switchgrass decrease and blue grama, sand dropseed and sand sage increase. Annual weeds and grasses invade the site as range condition becomes poorer. • 1 • Management 'of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sand bluestem, sand reedgrass , switchgrass , sideoats grama, blue grama , pubescent wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements of livestock. For successful seeding, a clean firm, sorghum stubble -- prepared the growing season prior to seeding -- or a firm prepared seedbed and grass drill should be used. Early spring seeding has proven most successful Windbreaks and environmental plantings are generally suited to this soil. I . Soil blowin is the principal hazard to establishing 'trees and shrubs . r .x i Y j f • This hazald. can be overcome by cultivating only in the tree row and by leaving a strip of vegetation between the rows , Supplemental irrigation ' may be necessary at the time of planting and during dry periods: Trees that are best suited and have good. survival are Rocky Mt. juniper, eastern redcedar, ponderosa pine , Siberian elm, Russian olive and hackberry. Shrubs best suited are skunkbush sumac , lilac and Siberian peashrub. Wildlife is an important secondary use , with these soils best suited for openland and rangeland wildlife. In cropland areas , habitat favorable for ring-necked pheasants , mourning doves , and many non-game species can be developed by establishing wildlife areas for nesting and escape cover. For pheasant, the inclusion of undisturbed nesting cover is vital and should be included in plans for habitat development: this is especially true in area of intensive agriculture. Rangeland wildlife , exemplified by the pronghorn antelope , can be assisted and encouraged by development of livestock watering facilities , proper levestock grazing management , and range reseeding where needed. Rapid expansion of the Greeley and surrounding area has resulted in urbanization of much of this Olney soil. It has a good potential for urban and recreational development . Its only limiting feature is the moderately rapid permeability in the substratum and the hazard of con- tamination of ground water from sewage lagoons.
