RE: ACTION OF BOARD CONCERNING HEARING TO DETERMINE WHETHER TO
RENEW HOTEL AND RESTAURANT LIQUOR LICENSE - RJML, LLC, DBA LA
MARAVILLA - EXPIRES MARCH 10, 2006
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board of County Commissioners,as the local liquor licensing authority for
Weld County,Colorado,pursuant to Section 12-47-302,C.R.S.,and Sections 12-2-30, 12-2-40 and
12-2-50,Weld County Code, may cause a hearing to be held on the application for renewal of any
liquor license previously issued by it to determine if good cause exists to refuse to renew said
license, and
WHEREAS,on or about February 3, 2005, RJML, LLC,dba La Maravilla (the"Licensee"),
presented to the Board of County Commissioners of Weld County,Colorado,an application for the
renewal of a Hotel and Restaurant Liquor License,for the sale of malt,vinous and spirituous liquors,
for the licensed premises known as the"La Maravilla Restaurant,"located at 13015 Weld County
Road16, Fort Lupton,Colorado,and paid the requisite renewal fee required by Appendix 5-H of the
Weld County Code, and
WHEREAS,said Hotel and Restaurant Liquor License was previously approved by the Board
on August 2, 2004, with expiration on March 10, 2005, and
WHEREAS,the matter of the renewal of said liquor license was heard by the Board on the
30th day of March,2005,at which time the Licensee was represented by Gene Tardy,Attorney-at-
Law, and
WHEREAS,at said meeting,the Board was presented with updated Stipulated Conditions
for Renewal of the Liquor License,set forth below,having been agreed to by the Licensee,the staff
of the Weld County Sheriff's Office,and the staff of the Weld County Department of Public Health
and Environment, and
WHEREAS,having considered the updated Stipulated Conditions for Renewal of the Liquor
License, set forth herein; having heard the testimony and evidence adduced at said meeting,
including the commitment by the Licensee to comply with the updated Stipulated Conditions for
Renewal of the Liquor License,having considered the testimony,evidence and remonstrances filed
with said Board,and having carefullyweighed the same,the Board deems it advisable to renew the
Hotel and Restaurant Liquor License for RMJL LLC, dba, La Maravilla, said license expiring
March 10, 2006, and being subject to and conditioned upon compliance with all of the Stipulated
Conditions for Renewal of Liquor License which are set forth herein.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that the Board does hereby grant the renewal of the Hotel and Restaurant Liquor
License for RMJL,LLC,dba,La Maravilla, 13015 Weld County Road 16, Fort Lupton,Colorado,to
sell malt,vinous and spirituous liquors for consumption by the drink on the premises only,and the
Board does hereby authorize and direct the issuance of said license by the Chair of the Board of
County Commissioners, attested to by the Clerk to the Board of Weld County, Colorado, which
license shall expire March 10, 2006, providing that said place where the licensee is authorized to
sell malt,vinous,and spirituous liquors for consumption by the drink on the premises only,shall be
conducted in strict conformity with all of the laws of the State of Colorado and the rules and
regulations relating thereto, and subject to the following Stipulated Conditions for Renewal of the
Liquor License:
STIPULATED CONDITIONS FOR RENEWAL OF LICENSE
(A) The Licensee(which term includes the Licensee, its employees and agents)shall
call the Weld County Sheriff's Office and report each incident and person whom the Licensee has
reason to believe has violated the Colorado Liquor Code or other state law in the licensed premises,
its parking lot,or appurtenant structures. Because the Licensee is encouraged to make these calls,
the number of calls made shall not be a basis for revocation or non-renewal of the liquor license.
The Board of County Commissioners shall not be constrained from considering the nature of a
pattern of calls,the numbers notwithstanding. The Licensee shall provide one(1)parking stall near
the front entrance of the licensed premises that will be reserved for a Sheriff's office vehicle.
(B) The Licensee shall employ for an additional twelve (12) months a qualified and
competent security company that will have free and open communication with the Weld County
Sheriff's Office. Thereafter, the need for the security company shall be assessed by the Weld
County Sheriff's Office, and the security company may be terminated with the agreement of the
Weld County Sheriffs Office. The security guards will work inside the licensed premises and in the
parking lot of the licensed premises. All security guards working in or outside the licensed premises
shall wear uniform clothing that allows them to be readily distinguished from the patrons. No
security guards will carry firearms while working in or outside the licensed premises.
(C) Upon renewal,the occupancy level in the dance hall portion of the licensed premises
shall be 450 occupants. If the Licensee wishes to further increase the occupancy, he shall install
secondary treatment to the existing septic system. After the secondary treatment has been in place
for ninety(90)days,the County Health Department shall conduct a review to determine whether the
improved septic system is performing adequately and the Weld County Sheriff's Office shall
conduct a review to determine whether the increased occupancy level has caused law enforcement
concerns. Upon the Health Department's and Weld County Sheriff's recommendations, the
occupancy level may be increased to 500 occupants by resolution of the Board of County
Commissioners of Weld County. At this point,Church&Associates will provide a progress report
regarding the septic system. If there are no concerns expressed by Church &Associates or the
Weld County Sheriff,the occupancy level may be increased to 550 occupants. At this point,Church
& Associates shall perform a thorough analysis report. If there are no concerns expressed by
Church &Associates or the Weld County Sheriff, the occupancy level may be increased to 600

occupants. At each interval, the County Health Department and the Weld County Sheriff shall
review their records and recommend approval or denial of each increase. Each increase must first
be approved by resolution of the Board of County Commissioners prior to becoming effective. If the
County Health Department or Weld County Sheriff's office has any concerns,they shall work with
the Licensee to attempt to resolve these concerns. Applicable limits on the number of meals
served, restaurant hours of operation, and restaurant methods of service shall comply with the
requirements set forth in Board of County Commissioners' Resolution #2004-2245.
(D) The Licensee shall at all times be in compliance with the Colorado Primary Drinking
Water Regulations.
(E) The Licensee shall continue to take all necessary steps to assure that minors are
not served any alcoholic beverages. These steps shall include providing a secure barrier separating
minors from adults in the dance hall as permitted by the Weld County Building Code and serving
alcoholic beverages to adults on the "minor side" by"single-serve," only(no beer buckets). The
Board finds that the public welfare and morals will not be impaired as long as the Licensee complies
with these conditions governing minors present within the licensed premises when alcohol is being
served.
(F) The Licensee shall continue to host "responsible vendor" training every six (6)
months as agreeable to the Colorado Department of Revenue Liquor Enforcement Division,and this
training shall be open to other area licensees. Each employee shall be"responsible vendor"trained,
and the Licensee shall provide documentary evidence that each employee has been"responsible
vendor"trained to the Weld County Clerk to the Board within thirty(30)days of the first available
"responsible vendor" class after hiring.
(G) The Licensee shall continue to fully fence the trash receptacles and exert its best
effortto assure that all trash is placed within a receptacle rather than in bags on the ground outside
the receptacle.
(H) The Licensee shall continue to provide lighting for the parking lot on the all sides of
the licensed premises. The Licensee also agrees to continue to provide two (2) security officers
to patrol the parking lot - one in the west lot and one in the east lot—when the dance hall is open.
(I) The Licensee agrees to continue to limit use of the dance hall to Thursday, Friday,
Saturday and Sunday evenings,all legal holidays as recognized by the State of Colorado,and May
5th and September 16th.

SUBJECT: La Maravilla, Dance Hall License
The Department has reviewed all pertinent health-related operations at the La Maravilla facility
and has no issue with the approval of the facility's Dance Hall License.
Comments concerning the sewage disposal system, drinking water system, and food service
establishment are addressed individually below:
Sewage Disposal:
This facility disposes of its domestic wastes through a septic system. According to records
provided by the owner, Ruben Rodriquez, the amount of wastewater disposed is well within its
design capacity. The system is designed to handle up to 1,727 gallons per day. The average
discharge during the months of October, November, and December was approximately 1,100
gallons per day.
Water Treatment System:
Water is provided to the facility by a well. The water treatment system is classified as a
transient, non-community system by the Colorado Primary Drinking Water Regulations. Based
upon information available to the Department, the system is in substantial compliance with the
Colorado Primary Drinking Water Regulations.
Food Service:
The facility has a Colorado food service license. Based upon recent inspections by Department
staff, the facility is in substantial compliance with the Colorado Retail Food Establishment
Regulations.

THIS AGREEMENT BETWEEN the State of Colorado, Liquor Enforcement Division
("Division") and RJML, L.L.C., d/b/a La Maravilla Restaurant, 13015 WCR 16, Ft. Lupton,
Colorado 80621 ("Licensee")is offered for the purpose of a settlement of the matters detailed in the
Order to Show Cause and Notice of Hearing attached hereto as Exhibit 1 (hereinafter"Notice"). The
above-named parties submit and agree as follows:
1. The facts and allegations contained in the Notice are true and accurate.
2. The Licensee agrees to a seven(7)day suspension of its hotel and restaurant liquor
license as a penalty for its violation of the Colorado Liquor Code as set forth in
Paragraph 1 of this Stipulation and Agreement.Said suspension of Licensee's hotel
and restaurant liquor license to take place as follows:
A. License to be actively suspended for two(2)days from 12:01 a.m. on February
25,2005 until 11:59 p.m.on February 26.2005.
B. Five(5)days of suspension to be held in abeyance fora period of one (1)year,
from the date of approval of this agreement by the state licensing authority,
pending no further violations of the Colorado Liquor Code during this period.
C. During any-perioduf activelieense-suspensiem Licensee-will-post-its-premises in —.-- .—
compliance with Regulation 47-600(F), 1 C.C.R. 203-2.
3. The Licensee petitions and the Division agrees that the Licensee shall be allowed to
pay a fine in lieu of suspension in accordance with 12-47-601(3), C.R.S. In this
regard,the parties agree as follows:

A. That the public welfare and morals would not be impaired by permitting the
Licensee to operate during the period set for suspension and that the payment
of the fine will achieve the desired disciplinary purposes; and
B. That the books and records of the Licensee are kept in such a manner that loss
of sales of alcohol beverages which the Licensee would have suffered had the
suspension gone into effect, can be determined with reasonable accuracy
therefore; and
C. That the licensee has not had its license suspended or revoked,nor had any
suspensions stayed by the payment of a fine, during the two (2) years
immediately preceding the date of the complaint which has resulted in this
Stipulation and Agreement; and
4. The parties agree that the fine shall be the equivalent of twenty percent(20%)of the
Licensee's estimated gross revenues from the sales of alcohol beverages during a
period of two days, except that the fine shall not be less than two hundred dollars
($200.00)nor more than five thousand dollars($5,000.00). The parties agree that the
average day's sales for the month of November 2004 shall be the appropriate
measure of said estimated gross revenues. Based upon these records,the amount of
the fine has been determined to be$556.44.
5. Payment of the fine pursuant to the provisions of this Agreement shall be in the form
of a certified check or a cashier's check made payable to the Colorado Department of
Revenue. Said fine shall be paid to the Department of Revenue on or before
February 16.2005.
6. Upon the payment of the fine as agreed upon in Paragraph 5, Licensee's two-day
suspension as set forth in Paragraph 2 of this Stipulation and Agreement shall be
deemed automatically stayed.
7. If the Licensee fails to make payment in a timely manner as detailed in Paragraph 5
of this Stipulation and Agreement, the full two-day suspension shall be served as
detailed in Paragraph 2.
If at any subsequent hearing or stipulation in lieu of hearing, the state licensing authority
should find that the Licensee, during the aforesaid one-year period, violated any provision of the
Colorado Beer or Liquor Codes, including all regulations thereunder, then the state licensing
authority shall,in addition to any other penalty imposed,order Licensee to serve all or any days of
suspension presently held in abeyance, pursuant to this agreement.

WHEREAS, it has been made to appear to the State Licensing Authority,Executive Director,
Department of Revenue, State of Colorado,that RJML, LLC,D/B/A La Maravilla Restaurant,
13015 WCR 16,Ft. Lupton, Colorado 80621,License No. 40-48501 ("Licensee"),has violated
the statutes or the rules and regulations of the Department of Revenue governing its license in the
following particulars:
I. Pursuant to 12-47-901 (1) (a), C.R.S., it is unlawful for any person to sell, serve, give
away,dispose of, exchange, or deliver or permit the sale, serving, giving, or procuring of
any alcohol beverage to or for any person under the age of twenty-one years.
A. It is alleged that on or about November 12, 2004, the Licensee,through its agent
or employee,Julia Esther Camacho Medina,permitted the sale, serving, giving, or
procuring of an alcohol beverage(Bud Light brand malt liquor)to a Colorado
Liquor Enforcement Underage Operative(DOB 08/22/1984, age 20), a person
under the age of twenty-one years.
NOW THEREFORE, you are hereby ordered to appear before me to show cause why
your said license should not be suspended or revoked as by law provided.
A pre-hearing meeting with the Liquor Enforcement Division to discuss matters relating
to this Hearing, including the setting of a mutually convenient hearing date,may be arranged
upon your request. You should contacfLaufaHarn`s of iW-205=2382 in the Division within teir
(10)days of the date of this Notice to arrange such a conference. If you fail to contact the
Division within ten(10) days, a hearing date will be set without further notice to you; and you
will then be notified of that hearing date by letter.
