Please review the enclosed notice and resolution pertaining to the aforementioned annexation proposal and
return any comments to the Town of Windsor at the address shown below within thirty (30) days of the
receipt of this memorandum. If the Town has not received comments from your agency within this 30-day
review period, the Town will consider the lack of a response to be a positive response to the proposal in its
current form. However, for the purposes of having a complete file on this proposal, the Town would
appreciate a response from your office even if your only continent below is "no comment." Thank you
very much for your participation in this process and your input concerning this proposal.
Public Meeting: The Windsor Planning Commission will hold a public hearing at 7:00 p.m. on Thursday,
September 1, 2005 and the Windsor Town Board will hold a public hearing at 7:00 p.m. on Monday,
September 12, 2005 to receive public comments on the enclosed annexation, both of these public hearings
will be held in Windsor Town Hall, 301 Walnut Street.

BEING A RESOLUTION MAKING CERTAIN FINDINGS OF FACT CONCERNING
THE EASTBROOK THIRD ANNEXATION TO THE TOWN OF WINDSOR,
COLORADO; DETERMINING SUBSTANTIAL COMPLIANCE WITH SECTION 31-
12-101, ET SEQ., C.R.S., "1'Hl!r MUNICIPAL ANNEXATION ACT OF 1965"; AND
ESTABLISHING DATES FOR PUBLIC HEARINGS BEFORE IHE PLANNING
COMMISSION AND THE TOWN BOARD OF 1'111, TOWN OF WINDSOR,
COLORADO,WITH REGARD TO THE EASTBROOK THIRD ANNEXATION
WHEREAS, the Town Clerk has received a petition filed by Eastbrook Investments, LLC
to annex to the Town of Windsor certain real property known as the "Eastbrook Third
Annexation"; and
WHEREAS, pursuant to The Municipal Annexation Act of 1965, the Town Board is
required to determine whether or not the aforesaid petition is in substantial compliance with the
requirements of said Act; and
WHEREAS, upon such determination, the Town Board is required to set public hearing
dates in accordance with the requirements of said Act;
- NOW, THEREFORE, IT IS FOUND AND RESOLVED BY THE TOWN BOARD OF
THE TOWN OF WINDSOR, COLORADO, AS FOLLOWS:
1. That pursuant to Section 31-12-107, C.R.S., a petition for annexation has been
filed with the Town Clerk for the annexation of certain real property known as the "Eastbrook
Third Annexation," more fully and particularly described within said petition.
2. That the Town Board finds that the aforesaid petition is in substantial compliance
with Section 31-12-107(1), C.R.S.
3. That in accordance with the Town Board's determination, public hearings should
be held before the Planning Commission and the Town Board of the Town of Windsor, Colorado,
to determine if the proposed annexation complies with Sections 31-12-104 and 105, C.R.S.
4. That a public hearing shall be held before the Planning Commission at 7:00 p.m. on
Thursday, September 1, 2005, at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado.
5. That a public hearing shall be held before the Town Board at 7:00 p.m. on
Monday, September 12, 2005, at the Windsor Town Hall, 301 Walnut Street, Windsor, Colorado.
6. That the Town Clerk, or her designee, shall give notice of the aforesaid hearings in
compliance with the Municipal Annexation Act of 1965.
Upon motion duly made, seconded and carried, the foregoing Resolution was adopted this
25th day of July, 2005.

ANNEXATION IMPACT REPORT
EASTBROOK THIRD ANNEXATION AND MASTER PLAN
The parcel proposed for annexation contains approximately 11.5 acres surrounded by
the previous Eastbrook Annexations, generally located north of Main Street (SH 392);
and west of Weld County Road 21 ; being more particularly described as part of the
SE '/4 of Section 15, Township 6 North, Range 67 West of the 6th P.M., Weld
County, Colorado.
1) (a) Please see the enclosed master plan and vicinity map for current and
proposed municipal boundaries.
(b) Please see item #3 below for information regarding provision of utility
services.
(c) Please see the enclosed annexation map and master plan for the current
and proposed land use patterns of the proposed annexation and the
enclosed Town of Windsor Land Use Plan map for the proposed land use
patterns for the subject property to be annexed and for surrounding
properties.
2) The application materials did not include a draft or final pre-annexation agreement
as the Town of Windsor does not typically require a pre-annexation agreement
unless such an agreement is determined to be necessary during the initial review.
3) Municipal services will be provided as follows:
> Water — The Town of Windsor will provide potable water service to the
proposed development. The potable water system will be constructed solely at
the developer's expense. A non-potable irrigation system will be required to be
constructed solely at the developer's expense in order to reduce the amount of
potable water required.
> Sewage Disposal — The Town of Windsor will provide sanitary sewer
service to the proposed development. All necessary sewage disposal
improvements shall be constructed by the developer solely at the developer's
expense.
> Drainage Facilities — Drainage infrastructure per the Town's requirements is to
be constructed by the developer solely at the developer's expense.
> Fire Protection—Windsor-Severance Fire Protection District
> Police Protection —Town of Windsor Police Department
> School — Weld County School District RE-4 (enclosed please find an Impact
Statement from the school district)
4) Installation and financing of infrastructure extensions, as well as any applicable
reimbursements for previously oversized infrastructure to serve the subject

property, shall be the sole responsibility of the developer.
5) Enclosed please find a list identifying all existing districts within the area to be
annexed.
6) Enclosed please find an Impact Statement from the Weld County School District
RE-4.
All development proposals are required to comply with the Town of Windsor
Comprehensive Plan, Zoning and Subdivision Ordinances and applicable Corridor
Plans.

The Windsor Planning Commission will hold a PUBLIC HEARING on Thursday,
September 1, 2005 at 7:00 p.m. and the Windsor Town Board will hold a PUBLIC
HEARING on Monday, September 12, 2005 at 7:00 p.m. in the Board Room of Town
Hall, 301 Walnut Street, Windsor, Colorado to receive public comments on an
annexation to the Town of Windsor of approximately 11.345 acres known as the
Eastbrook Third Annexation located in Section 15, Township 6 North, Range 67 West or
southeast of and adjacent to the Great Western Railroad tracks, north of Highway 392
and west of WCR 21 in Weld County. Interested citizens are invited to attend and
provide comments on this proposal.
This information is available for public inspection at the Windsor Planning Department,
301 Walnut Street, Windsor, Colorado during the Town's normal business hours of 8:00
a.m. and 5:00 p.m., Monday through Friday, exclusive of holidays.

ANNEXATION PETITION
Eastbrook Annexation No.3
We the landowners of more than 50% of the territory, excluding public streets and alleys,
described as the Section 15, Township 6N, Range 67W of the 6th P.M., County of Weld,
in the State of Colorado containing 50.522 acres more or less, allege the following to be
true and correct:
The perimeter of the proposed annexation has a distance of 4,031.23 feet, of which
4,031.23 feet are contiguous to the existing TOWN limits of the TOWN OF WINDSOR.
A minimum of 1/6 of the perimeter of the proposed annexation is contiguous to the
TOWN OF WINDSOR.
We further allege:
1. It is desirable and necessary that said territory be annexed to the TOWN OF
WINDSOR.
2. A community of interest exists between the said territory and the TOWN OF
WINDSOR.
3. Said territory will be developed in the near future.
4. Said territory is capable of being integrated with the TOWN OF WINDSOR.
5. No land held in identical ownership is divided into separate parcels unless the
owner of said tract has consented in writing or joins this Petition.
6. No proceedings for annexation of the territory have been commenced for
annexation to another municipality.
7. The signers hereof comprise the landowners of more than 50% of the territory
proposed to be annexed exclusive of streets and alleys, and are in fact owners
of 100% of the hereinafter described property.
Therefore, the undersigned hereby request that the TOWN OF WINDSOR approve the
annexation of the area described above and do herewith pay the required fees.
In addition to the annexation, the undersigned request the zoning of RMU with SF-2, GC,
and I-L uses for the above described property.

NARRATIVE
The Eastbrook Subdivision Annexation No. 3 consists of Residential Mixed Use with
General Commercial(GC), Light Industrial(IL), and Single Family(SF-2) uses. The
property is bordered mostly by Eastbrook Annexations No. 1 and No. 2 properties. The
property will have access points on State Highway 382 and Weld County Road 21. The
water and sewer service will connect to the proposed utility lines in Eastbrook
Subdivision Annexation No. 1.
The she is generally level with natural drainage going to the irrigation ditches on the
property. The drainage for the proposed site will drain towards the south to the roads
then to a detention area on the southern end of the property. The pond will release at the
10 year historical rate into the Law Ditch.
Statement of Community Need
The following statement of community need is for the Eastbrook Subdivision
Annexation No. 3. The site is bounded by a combination of Town of Windsor and Weld
County residents. To the east,the site is bounded by Weld County Road 21 and
agricultural farmland, bounded on the south by Highway 392, and to the west the site is
bounded by the Windsor Industrial Park Annexation, and to the north the property is
bounded by the Eastbrook Annexations No. 1 and No. 2 subdivision and agricultural land
to the north of that. The Eastbrook Subdivision Annexation No. 3 is intended to have
mixed uses (RMU Zoning) from single and multi-family development to light
commercial/industrial use. This development is beneficial to the Town of Windsor for
several reasons. The first of which is single-family attached and multi-family residential
development that affordable workforce housing for the Town of Windsor. Secondly, the
planned general commercial/light industrial will provide community services and
products. The commercial and industrial industry in this annexation will also provide
additional tax base for the town along with providing additional jobs for the area.
This project addresses the need for affordable workforce housing for the Town
and proposes a community that blends in with existing and proposed developments of the
surrounding area. JCB Engineering, LLC and the owners of this property look forward to
working with the Town of Windsor in providing a quality addition to the community.
