RE: APPROVE REQUEST TO CHANGE CONDITION OF APPROVAL #4.B OF USE BY
SPECIAL REVIEW PERMIT#1394- NORTHERN COLORADO CONSTRUCTORS, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on September 24, 2003, the Board of County Commissioners approved the
application of Northern Colorado Constructors, Inc., 18100 Weld County Road 19, Johnstown,
Colorado 80534("the Applicant"),for a Site Specific Development Plan and Use by Special Review
Permit#1394 for a Mineral Resource Development Facility (Dry Open Pit Mining for Sand and
Gravel) in the A (Agricultural) Zone District on the following described real estate, to-wit:
Lots 3, 4, and 5 of Lupton Meadows Subdivision;
being part of the E1/2 SE1/4 of Section 24,Township
2 North, Range 67 West of the 6th P.M., Weld
County, Colorado
WHEREAS, Condition of Approval #4.6 was approved, to read as follows:
"An Individual Sewage Disposal System is required
for the proposed scale house and/or repair shop, and
shall be installed according to the Weld County
I.S.D.S. regulations. The septic system is required to
be designed by a Colorado Registered Professional
Engineer according to the Weld County I.S.D.S.
regulations. The installation of the septic system
shall comply with the Weld County I.S.D.S.floodplain
policy."
WHEREAS, after reviewing the recommendation of Weld County Department of Public
Health and Environment, staff requested amendment of Condition of Approval #4.B to read as
follows:
"A vault system is required for the proposed scale
house and shall be installed according to the Weld
County Individual Sewage Disposal System(I.S.D.S.)
regulations. The vault system is required to be
designed by a Colorado Registered Professional
Engineer according to the Weld County I.S.D.S.
regulations. The installation of the vault system shall
comply with the Weld County I.S.D.S. floodplain
policy."
WHEREAS, because the Applicant has eliminated its plan to install a repair shop on the
property, any reference to"repair shop"in the Resolution#2003-2446,approved on September 24,
2003, shall be deleted.

NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Condition of Approval#4.B of USR#1394, on the hereinabove described
parcel of land be, and hereby is, amended as follows:
"A vault system is required for the proposed scale
house and shall be installed according to the Weld
County Individual Sewage Disposal System(I.S.D.S.)
regulations. The vault system is required to be
designed by a Colorado Registered Professional
Engineer according to the Weld County I.S.D.S.
regulations. The installation of the vault system shall

BE IT FURTHER RESOLVED that all other Conditions of Approval included in Resolution
#2003-2446, approved on September 24, 2003, remain in full force and effect.
BE IT FURTHER RESOLVED that any reference to "repair shop" in the Resolution
#2003-2446, approved on September 24, 2003, be, and hereby is, deleted.
The above and foregoing Resolution was, on motion duly made and seconded,adopted by
the following vote on the 31st day of January, A.D., 2005.

SUBJECT: Request to change condition of approval 4.6 for resolution
USR-1394 (Northern Colorado Constructors)
Northern Colorado Constructors and their representatives are requesting that condition of
approval 4.B (prior to release of building permits) under the resolution of approval for USR-1394
dated September 24, 2003 be amended to allow a vault system. Condition of approval 4.B
currently reads as follows:
"An Individual Sewage Disposal System is required for the proposed scale house
and/or repair shop, and shall be installed according to the Weld County I.S.D.S.
regulations. The septic system is required to be designed by a Colorado
Registered Professional Engineer according to the Weld County I.S.D.S.
regulations. The installation of the septic system shall comply with the Weld
County I.S.D.S. floodplain policy."
The Weld County Department of Planning Services defers to the recommendations of
the Weld County Health Department, as outlined in the e-mail referrals dated January
10 & January 26, 2005, on this issue.

Chris,
I am in receipt of a letter from Ken Rollin representative for USR-1394, NCCI, dated November 30, 2004,
requesting a change to Condition 48. The request is to be allow the use of a vault system in place of the required
septic system.
As we have discussed, Environmental Health's internal policy will not allow a permit for a vault system if
the property has a source of water. This site is serviced by a commercial well.
The condition requiring a septic system for the house has already been approved by BOCC. It is my
understanding that BOCC will need to make the decision to allow this change.

Chris,
Per our phone conversation today on the Health Department's position regarding the use of vaults when a
permanent water supply is the water source, I offer this for clarification:
Because a vault is a 'closed' method of sewage disposal, there is an increased potential for raw sewage to be
release if it is not consistently maintained.
This is also a multi year gravel pit that Northern Colorado Constuctors Inc. will be operating.
The Department consistently asks that there be permanent sewage disposal facilities in place that require minimal
maintenance, and is applying this same consistent standard for NCCI. The Department's opinion of the facility
has not changed and defers the decision of NCCI's request to the BOCC.
Hopefully this helps explain our position.

2. Upon completion of#1 and#2 above,the applicant shall submit a Mylar plat along
with all other documentation required as Conditions of Approval. The Mylar plat shall
be recorded in the office of the Weld County Clerk and Recorder by Department of
Planning Services staff. The plat shall be prepared in accordance with the
requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat and
additional requirements shall be submitted within thirty(30)days from the date of the
Board of County Commissioners resolution.The applicant shall be responsible for
paying the recording fee.
3. The Department of Planning Services respectfully requests the surveyor provide a
digital copy of this Use by Special Review. Acceptable CAD formats are.dwg,.dxf,
and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo
Coverages and Arclnfo Export files format type is .e00. The preferred format for
Images is.tif(Group 4). (Group 6 is not acceptable). This digital file may be sent to
maps(wco.weld.co.us.
4. Prior to release of building permits:
A. The applicant shall address the requirements of the Department of Building
Inspection as stated in its referral received July 24,2002. Written evidence
of this shall be submitted to the Department of Planning Services.
B. An Individual Sewage Disposal System is required for the proposed scale
house and/or repair shop, and shall be installed according to the Weld
County I.S.D.S. regulations. The septic system is required to be designed
by a Colorado Registered Professional Engineer according to the Weld
County I.S.D.S. regulations. The installation of the septic system shall
comply with the Weld County I.S.D.S. floodplain policy.
5. Prior to operation:
A. The access point, including the access to the scale house, shall be paved
a minimum of 24 feet in width to accommodate two-way traffic. The access
point shall have an adequate sight distance in both directions.
6. The Special Review activity shall not occur, nor shall any building or electrical
permits be issued, on the property until the Special Review plat is ready to be
recorded in the office of the Weld County Clerk and Recorder.

Re: Northern Colorado Constructors, Inc. Pit #1
Dear Ms. Davis,
Northern Colorado Constructors Inc. is developing a gravel pit at the corner of county
road 18 and 25 near Ft. Lupton. When the project was first conceived the plan was to use an
existing house on site as a scale house with 1 e loyee. Because the house could be lived in we
were required to design a septic system for the 2 bedroom house. This was done and a permit was
issued.
The plan has been changed and the hous is to be demolished as it has been deemed
uninhabitable. The scale house is going to be a rtable office trailer, a plan of which is enclosed.
This trailer will house 1 employee with an occasi nal visitor. Sanitation for the other employees
will be portable units which will be moved as the work area moves around the property.
Because of the limited use and the fact t t the entire site is in the flood plain we are
requesting that we be allowed to use a vault for he sanitation in the scale house. As you can see
the scale house has a simple stool and basin with no other facilities. We assume the unit will use
about 5 to 10 gallons per day, 5 days a week. At this rate 1000 gallon vault will require pumping
about once a month. The vault will be equipped 'th a warning light to indicate when it is 80%
full.
