COLORADO SUBJECT: CZ-1076 Dave&T inley(Zone Change) Weld County Public Works Department has reviewed this change of zone request. Comments made during this phase of the subdivision process may not be all-inclusive, as other concerns or issues may arise during the remaining application process. Comments ❑ The applicant/surveyor must amend Change of Zone notes#'s 10, 11, 12,and 13 to reflect the appropriate roadway references to this proposed development. ❑ CR 8 is classified by the County as a collector roadway and requires an 80-foot right-of-way. The right-of-way shall be shown and dimensioned on the change of zone plat. If the right-of-way cannot be verified, it will be dedicated on the plat. Additional right-of-way may be shown reserved on the change of zone plat. CR 8 is paved and maintained by Weld County. ❑ US 85 is classified by the National Highway System as a State Highway. The applicant shall coordinate with Colorado Department of Transportation (CDOT) the requirements for right-of-way on US 85. The applicant, on the change of zone plat, shall show and label the right-of-way recognized by CDOT. This US 85 is paved and maintained by the State of Colorado. ❑ Normally Public works has an understanding of the proposed development and potential impacts on surrounding infrastructure. This proposed zone change to an industrial use may contribute significant traffic to the surrounding area. The applicant may be required to participate and contribute to improvements to the surrounding transportation infrastructure at the final application. If eventual use of this site would be a major impact, such as an asphalt or concrete batch plant, significant roadway and intersection improvements will be required. Transportation routes will be addressed at the final submittal. Since no specific development is proposed, the applicant will not be required to submit off-site roadway improvements agreements or a professional traffic impact study at this time. ❑ This proposed zone change use may contribute significant traffic to the surrounding area, including US 85. The applicant will be required to participate and contribute to improvements for the US 85 Highway Access Control Plan at the final application. ❑ The applicant shall provide a pavement design prepared by a professional engineer along with the final plan submittal. ❑ The change of zone plat that Public Works review normally has an intemal roadway system. The applicant has not indicated internal roadways on the plat,since no specific development is currently planned. Public Works has no comment at this time. ❑ Roadway and grading plans along with construction details will be required with the final plan submittal. p Often,a drainage report by a professional engineer licensed in the State of Colorado would be submitted with the change of zone application. Since no development is proposed, Public Works is not requiring a drainage report at this time. The applicant must keep in mind that consideration for drainage will be required for future proposed development and a final drainage report shall be required with the final plan application. EE Final drainage construction plans,conforming to the drainage report,shall be submitted with the final plan application. Recommendation ❑ The Public Works Department recommends approval of this change of zone, provisional upon completion of the aforesaid comments. Department of Public O COLORADO Health and Environment CASE NO.: CZ-1076 NAME: Dave & Todd Finley The Department has reviewed the request to change the zoning from I-1 Industrial to 1-3 Industrial. There is an existing individual sewage disposal system on the property that has been abandoned according to the application. The application further states that a new septic system will be installed to meet the requirements of the proposed use at the time of further development. The applicant has included a well permit dated September 16, 2004 for an industrial use well. According to the application, the well has not been drilled yet. Additionally, the Change of Zone plat map indicates there is a well on the property, in close proximity to the abandoned septic system (presumably for a previous residential or commercial use). There is no record of this existing well in the Division of Water Resources information reviewed as a part of this referral. The applicant is requested to clarify this well information. No indication of the proposed use of the property has been offered in the Change of Zone application. Any further development of the site will require a Site Plan Review. Any commercial/industrial development must comply with all applicable Weld County Department of Public Health and Environment, Colorado Department of Public Health and Environment, EPA and/or Oil and Gas regulations. The applicant/developer must contact the appropriate agency for more information regarding the site-specific requirements of each development. The Department recommends approval of this application with the following conditions: 1. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended)shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. Fugitive dust shall be controlled on this site. 5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in 25-12-103 C.R.S., as amended. 6. At the time of development, an individual sewage disposal system will be required for the proposed facility and shall be designed by a Colorado Registered Professional Engineer and installed according to the Weld County Individual Sewage Disposal Regulations. 7. Any abandoned septic system must comply with the Weld County Code Section 30-4-20 (D). The applicant should contact the Department to update existing septic permits for those systems that have been abandoned. The Commission offers the following comments and concerns. This property is in an area between the cities Brighton and Fort Lupton that will experience growth pressure in coming years. It is also about 'A mile of frontage on Highway 85, a highly visible location for people traveling between our communities. The Planning Commission has concerns and opposes rezoning that would allow heavy industrial uses, especially when the rezoning is speculative and there are no plan, proposed uses or design criteria. The stated intent of the County's I-3 zone district is "to provide a zone to accommodate industrial USES which may create adverse visual impacts for ADJACENT USES. As a result, such uses may required(sic) locations relatively isolated from other land USE types." Clearly, this location is not "relatively isolated." Thank you for the opportunity to comment.
