WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners held a public hearing on the 23rd day of March, 1983 , at the hour of 2 : 00 o'clock p.m. in the Chambers of the Board for the purpose of hearing the application of Associated Natural Gas, Inc . , P. O. Box 5493 , Denver, Colorado, 80217 , for a Use by Special Review for a natural gas processing plant, on the following described real estate, to-wit; Part of the SE a, Section 34 , Township 7 North, Range 67 West of the 6th P. M. , Weld County, Colorado. WHEREAS, Section 24 . 4 . 2 of the Weld County Zoning Ordinance provides standards for review of said Use by Special Review, and WHEREAS , the Board of County Commissioners heard all of the testimony and statements of those present, has studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, finds that: 1. The submitted materials are in compliance with application requirements of Section 24 .7 of the Weld County Zoning Ordinance. 2 . It is the opinion of the Board of County Commissioners that the applicant has shown compliance with Section 24 . 4 . 2 of the Weld County Zoning Ordinance as follows : a. The proposal is consistent with the Comprehensive Plan policies in that the use does not infringe on continued agricultural use in the vicinity or County. The proposal does not appear to have any adverse impacts on the agricultural interests of the County or the environment. b. The proposal is consistent with the intent of the Agricultural Zone District; and is provided for as a Use by Special Review. c. No overlay districts effect the subject site. d. USR-543:83:6 Development Standards 1. The permitted use on the hereon described parcel of land shall be the processing of gas gathered from nearby production to remove salable liquids and deliver the processed gas to a local purchaser. 2. The major facilities shall be one (1) office, one (1) compressor, and pumping building, and two (2) product storage tanks and one (1) two-hundred (200) barrel oil tank, as described in the submitted application materials. 3. All accesses shall have the approval of the Weld County Engineering Department. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineer- ing Department. 4. All truck traffic shall be routed along Weld County Roads 33 and 76. 5. All construction, electrical work and fabrication will be done in accordance with the Weld County Building Code. 6. The appearance of the facility shall be maintained in a neat and orderly condition through periodic painting and maintenance. 7. The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust, and the growth of noxious weeds. 8. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. 9. The applicant shall provide for adequate fire protection and that any other safety and fire protection will be as prescribed by the Eaton Fire Protection District, Industry Standards, and/or other applicable rules and regulations of governmental bodies having jurisdiction on the premises. The applicant shall provide two (2) fire hydrants if the North Weld Water District has the capacity to provide adequate water for these hydrants. 10. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards, as shown or stated above, shall require the approval of an amendment of the Special Use Permit by the Planning Commission and the Board of County Commis- sioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services. 11. The property owner and/or operator of this operation shall be responsible for complying with all of the above stated Development Standards. Noncompliance with any of the above stated Development Standards may be reason for revocation of the Special Use Permit by the Board of County Commissioners. 12. The applicant shall provide a six (6) foot chainlink fence with three (3) strands of barbed wire at the top. GO:rg A public hearing was conducted on March 23 , 1983 at 2:00 P. Russell Anson Planning Department Representative, Greg Oxenfeld The following business was transacted: I hereby certify that pursuant to a notice dated February 14 , 1983, duly published February 17, 1983 , in the La Salle Leader, a public hearing was held on the request of Associated Natural Gas, Inc. , for a Use by Special Review for a natural gas processing plant. The Planning Commission recommended that the request be approved with conditions and development standards. Tom Norton, an Engineer, and Mike Quigley, representing Associated Natural Gas, Inc. , were present to answer questions. Mr. Norton stated that they have no problems with the conditions or the development standards. Mr. Norton stated that this site is located directly behind the old hay mill. Mr. Quigley stated that Associated Natural Gas, Inc. has a contract to supply Western Slope Gas from this site. Mr. Quigley commented on the construction of the site, the operation, and added that when they reach capacity there will probably be six to seven trucks visiting this site per day. Mr. Quigley stated that they have leveled this site and have started to install the piers. There was no one present in opposition to this application. Commissioner Martin moved to approve this request with the conditions and development standards as recommended by the Planning Commission. Commissioner N. Carlson seconded the motion and it carried unanimously. RE #589 - Don Anderson: This request is to divide the property into parcels of 160 acres and 3 . 8 acres, more or less. The Planning staff recommended that the request be approved with conditions. Mr. Norton stated that the applicant would like to separate the smaller parcel to accomodate the Associated Natural Gas, Inc. , gas processing plant and continue farming the larger parcel. It was determined that if a fire starts it should be extinguished by oxygen and water would only be used as a coolant. There was no one in opposition to this request. Commissioner N. This use is consistent with the Weld County Comprehensive Plan and similar plants have been constructed in Agricultural zones throughout the County. The use requested is compatible with surrounding land in that an abandoned alfalfa Plant is adjacent to the site , which is a similar use • It is also compatible in that numerous wells have been drilled throughout the area and production cannot commence on these wells without the processing plant. Future development in the area is anticipated to be additional Agricultural uses with continued development of the oil and gas available in rural Weld County. This future development is compatible with the use intended and in fact is necessary in the case of oil and gas development. This application complies with the Weld County Zoning Ordinance, Section 50, Overlay District Regulations , in that no overlay districts exist at the proposed gas processing plant site. The applicant has negotiated with numerous property owners in the area to establish the best possible location for minimum interference with the agricultural land and has located the site in accordance with these property owners desires. The applicant is designing and constructing the plant following all codes and oil insurance guidelines to ensure the protection of the health and safety of the inhabitants of the neighborhood and of Weld County. JRII 2g 19a3 t. Weld Co.Planning Commission x / OIL AND GAS PROCESSING PLANT DESCRIPTION OF PROPOSED OPERATIONS. The proposed oil and gas processing plant will be operated as a business with no residential units at the plant site. It will basically be operated eight (8) hours per day with one to two people at the plant during normal working hours. It will be maintained by a crew working out of the office at the plant site to operate and maintain the gas collection transmission system which sends raw natural gas to the plant. The proposed structures will be constructed of steel frame with siding. All tanks will be constructed of steel and liquid tanks will be bermed around the exterior high enough to contain the total volume of liquid that might be spilled should the tank rupture. All roads within the plant site will be graveled and natural drainage will be controlled so that it does not exceed the normal runoff from the site prior to construction of the facilities. The domestic sewage system at the site will be a septic system sized to accommodate the equivalent of a single-family residence. A permit for this installation will be obtained from the Weld County Health Department in accordance with the standard requirements . A letter is enclosed from the North Weld Water District showing that water is available for the plant . ?he only water required would be the same as a single family residence , to sunp1y domestic water for the office and restrooms . The vehicular traffic to the site will consist of pipeline service vehicles which will be one or two pickups in and out of the site three to four times per day. At the beginning of processing there will be four to six semi trucks per day hauling product from the site and in two to three years when the plant is operating at maximum capacity, there will be six to seven semi trucks hauling product from the site. It is not the intent of Associated Natural Gas to store or stockpile any quantity of materials or waste at the site. There is no waste associated with the processing plant and the only materials that would be stored would be a few valves ; a small amount of pipe material for maintenance and repair of the pipeline system. The operator intends to construct the plant in sixty (60) days and have it in operation in late April of 1983. No specific landscaping plan is proposed with this site. The reclamation procedure that would be completed when the plant is no longer needed for use would be to sell all major equipment and move it from the site. Only a minor amount of piping and unsalvagable material would remain. The fire protection measures necessary for a processing plant of this type consist primarily of continual attention to safety procedures by the employees . Fire extinguishers will be available at the facilities and in all vehicles , however, if a major fire occurred even the local fire departments would not be able to control such a fire. It would be necessary to shut down the gas pipeline system and let the fire burn itself out. We have included a cony of the Air Pollution Study for the plant and the Soils and Geological Study for the plant , for your information. One of the plants will be located in Section 34, 1`7N, R66W (about 2 miles west of Eaton) and the other will be located in Section 35, T4N, i263W (approximately 2 miles Southeast of Gilcrest) . Both plants will receive gas gathered from nearby production, process the gas to remove salable liquids, and _deliver the processed gas to a local purchaser such as Western Slope Gas Company. The pipelines serving the two plants will also be constructed by Associated Natural Gas. At the present time we -are anticipating the construction over the next two years of about 90 miles of 3 thru 8 inch pipelines connecting about 200 new gas wells. The pipeline system and the plants will ultimately handle about 30 million cubic feet of natural gas per day for which there has not been a market heretofore. We anticipate that the construction o£ these facilities will result in expenditures in Weld County of about 5 million dollars over the next 2 years of which about three million will be spent in the next six months . Associated has been working with local gas producers in Weld Lounty for the last 3 - 4 months to negotiate arrangements whereby a market could be developed for the unproduced natural gas in the county. Over the last _few weeks agreements have been consumated whereby, as stated above, Associated will construct and operate the pipeline andplant facilities. The gross revenue from these projects should be ultimitly in the range of $20 - 25, 000,-000 per year. We are aware that the construction of any facility such as these plants requires a special use permit from Weld County and the permit applications are being filed this week. We further understand that the processing and approval of the permits will require at least sixty (60) days. We have however, agreed with the local producers to try to have the plants "on stream" by mid March if possible. Since the _design and installations of the plants will require 6 - 8 weeks it is important that we move at once, and engineering and material procurement is currently underway. However, it is obvious, that we will not have Weld County special use permits in time to start field construction. Consequently, we are herewith proposing to start construction and installation of the plants within the next two weeks at our own risk and subject to the final approval of Weld County.
