RE: ACTION OF THE BOARD CONCERNING AUTHORIZATION FOR THE WELD COUNTY
ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST GARY DEGGE,
WESTERN EQUIPMENT AND TRUCK, INC., C/O ALBERTO LOYA FOR VIOLATION
OF THE WELD COUNTY CODE
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,Gary Degge,Western Equipment and Truck, Inc., 20551st Avenue, Greeley,
Colorado 80631, c/o Alberto Loya, 481 Soar Lane, Platteville, Colorado 80651, VI #0500198, is
allegedly in violation of the Weld County Code, and
WHEREAS,despite efforts by the Planning staff to resolve said matter,the violation has not
been corrected, and
WHEREAS, on the 15th day of June, 2005, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS,Gary Degge,Western Equipment and Truck,Inc.,was represented by Alberto
Loya, Events Coordinator, at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to continue said
violation to August 3, 2005, at 9:00 a.m., to allow adequate time for additional communication
between staff and Mr. Loya regarding the intent of a Temporary Assembly Permit and Weld County
Zoning Regulations, and to initiate the Use by Special Review Permit process.
NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County,Colorado,that VI#0500198 against Gary Degge,Western Equipment and Truck, Inc., do
Alberto Loya be, and hereby is, continued to August 3, 2005, at 9:00 a.m.
