This project falls primarily under the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 1 (County Line Road) is designated on the Weld County Road Classification Plan (FHU) as an arterial road, which requires a 140-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Boulder County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. RE-3926 is associated with this proposed USR. The applicant has identified a 30-foot joint access and utility easement to access across Lot B to the rear lot, Lot A. Question: Is this joint access and utility easement dequate to meet Planning Services' requirements associated with Section 24-7-50 J, which refers to flag pole _anfigurations? If not, I will work with you and the applicant on a flag pole configuration accessing on to WCR 1 adjacent to the north property line. REQUIREMENTS: Access: The applicant is indicating that the existing access point will be utilized for Lots A and B. No new private residential accesses shall be allowed onto roadways classified as arterial. A parcel shall share the access point already in existence. Access to new parcels may be obtained by a mutual reciprocal easement across the involved parcels to connect with existing points of access or by connection to adjacent public non- arterial roadways. The existing access/30-foot joint access and utility easement shall be surfaced with gravel and have adequate turning radiuses graded and drained to provide an all-weather access. Off-Street Parking/Delivery: The applicant has indicated that very little deliveries will occur on site and most of the business is wholesale. There appears to be adequate parking and a turn around area for the delivery truck. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This facility shall adhere to the maximum permissible noise levels allowed in the Residential Zone as delineated in 25-12-103 C.R.S., as amended. 6. Adequate handwashing and toilet facilities shall be provided. 7. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 8. The facility shall utilize the existing public water supply.(Left Hand Water District) 9. A building permit shall be obtained prior to the construction of any new building, addition or remodel of the existing building. A plan review is required for each building for which a building permit is required. Plans shall include a floor plan. Plans may be required to bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans are required when applying for each permit. Structural integrity of the existing structure may be required to be verified by a Colorado registered architect or engineer. 3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International Residential Code; 2003 International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code. 4. The building will be classified as R-3 (Single family Dwelling). Classification and requirements will change if the business includes public areas such as a sales room. Fire resistance of walls and openings, construction requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the Zoning Ordinance. 5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of determining the maximum building size and height for various uses and types of construction and to determine compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset and setback requirements. To date, no meter has been set 2) The owner contacted the District in January, informed the District that the property was being divided and asked that the unset tap be assigned to Lot A, the easterly lot, where he intended to use the tap. 3) This request shows the proposed business on Lot B, and that the intention is to use the Left Hand Water District tap on Lot B. 4) There also appears to be a potential accessory dwelling on Lot B, which would require— if it is completed — an upgrade to a 3/4" tap to serve a primary and accessory dwelling, according to District Policy. The applicant, as owner of the tap, has the right to use the tap on either lot but cannot use one tap to serve two lots if they can be divided and sold separately. If the tap is assigned to Lot B, the right to a tap for Lot A can only be assured if a tap is applied for and purchased for that separate property. The District has reviewed the development proposal in terms of (1) available school capacity, (2) required land dedications and/or cash-in-lieu fees and (3) transportation considerations. After reviewing the above proposal, the School District has no objections to its approval and finds that there is adequate available school capacity for this area. The reasons for this position are as follows: • None of the schools in this feeder exceed the 125%capacity benchmark. Under current analysis, there appears to be sufficient capacity to support this development over the next 5-year period. • Capacity calculations in this referral include Erie High School which will relieve Erie Middle/Senior High School in the Fall of 2005 and a new elementary (Elementary 23) which will relieve Erie Elementary within the next 5 year. There may be crowding at Erie Elementary in the short-term until Elementary 23 is constructed. Should this development be approved, the options for managing the short term overcrowding while the new schools are under construction may include adding modular classrooms and implementing split or staggered schedules as needed. Other options may include but not be limited to implementing year-round schools or asking voters to approve new bonds for additional school facilities or a mill levy for additional operating funds. It should be noted that a lack of operating funds may be a factor in delaying construction and occupancy of new school facilities in this area. Detailed information on the specific capacity issues, the cash-in-lieu/land dedication requirements and transportation impacts for this proposal follow in Attachment A. The recommendation of the District noted above applies to the attendance boundaries current as of the date of this letter. These attendance boundaries may change in the future as the new facilities are constructed and opened. Any residential project within the applicable feeder that causes the 125% school benchmark capacity to be exceeded within 5 years would not be supported. This determination includes both existing facilities and planned facilities from a voter-approved bond. The building capacity, including existing and new facilities, along with the impact of this proposal and all other approved development projects for this feeder is noted in the chart below. "Combines capacity of current Erie Elementary and future Elementary 23 until boundaries are established Specific comments concerning this proposal regarding School Capacity are as follows: • Specific Impact- This application will add 1 new accessory single-family dwelling unit with the potential of 1 new student to the Erie Elementary, and Erie Middle/Senior High feeder. • Benchmark Determination - The School District anticipates that the necessary capacity is available to serve this development proposal without triggering the 125% benchmark capacity within the next 5 years. • Additional Capacity Impacts— Erie High School is scheduled to open in the Fall of the 2005-2006 school year and will relieve Erie Middle/Senior High. A new elementary school has also been approved in the 2002 Bond and is expected to be open within the next 5 years. However, the exact date of completion for this latter facility remains to be determined and will depend on the rate of residential growth in this feeder and the availability of operating funds. (2) LAND DEDICATIONS AND CASH IN-LIEU FEES The implementation of the Intergovernmental Agreement (IGA) Concerning Fair Contributions for Public School Sites by the Weld County requires that the applicant either dedicate land directly to the School District along with provision of the adjacent infrastructure and/or pay cash-in-lieu (CIL) fees based on the student yield of the development. CIL fees only provide funds for land acquisition, which is only a small component of providing additional school capacity for a feeder. Specific comments regarding land dedications and CIL fees for this referral are as follows: • Dedication and/or Cash-in-lieu Requirements- The District does not anticipate the need for another school site in this area. Since no land dedication is required, CIL fees will be assessed per the attached chart. • Number of Units covered by dedication/cash-in-lieu—All residential units will be subject to CIL fees. • Dedication/Cash-in-lieu Procedures - Cash-in-lieu payments are to be made to the St Vrain Valley School District Business Office—395 S. Pratt Parkway, Longmont, CO. 3)TRANSPORTATION/ACCESS Transportation considerations for a project deal with busing and pedestrian access to and from the subdivision. Pedestrian access, in particular, is an important goal of the School District in order to facilitate community connection to schools and to minimize transportation costs. Specific comments for this application are as follows: • Provision of Transportation - Busing, under current boundaries, would likely be provided. Pedestrian and • Access Issues — Due to this project's rural location, pedestrian access to existing or future school sites is not an issue. The Fire District does not object to the request, provided the requirements of the Fire District can be met: Based on my review, I have the following comments: If the detached garage is used for as a business, the building must comply with the adopted Building Code that use and would be required to have annual fire safety inspections as well as a final inspection before the building was approved for use as a business. Water supply for fire protection will not be required if there is no additional square footage added to the footprint of the building. If the detached garage will be turned into a single-family residence, the building must comply with the adopted Building Code that use. Water supply for fire protection may be required for that use. If an additional single-family dwelling is constructed on the property, water supply for fire protection requirements may also apply. It should be noted that water supply for fire protection is not required for a single-family residence that is not larger than 3,600 gross square feet and is placed on at least a 2.5 acre site.
