RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #1316 -
HALL-IRWIN CORPORATION, C/O JULIE COZAD, LOT HOLDING INVESTMENTS,
LLC
WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,by Resolution dated May 23,2001,the Board approved Use by Special Review
Permit#1316 for Open Pit Sand and Gravel Mining in the A(Agricultural)Zone District for Hall-Irwin
Corporation, on the following described real estate, to-wit:
Part of the NE1/4NW1/4 and part of the NW1/4NE1/4
of Section 19, Township 6 North, Range 67 West of
the 6th P.M., Weld County, Colorado, and
WHEREAS,the Board has received a request from Julie Cozad, Lot Holding Investments,
LLC, 1760 Broad Street, Unit E, Milliken, Colorado 80543, to vacate that portion of Use by Special
Review Permit#1316, being described as follows:
Lot A of Recorded Exemption#3948, being a part of
the N1/2 of Section 19, Township 6 North, Range 67
West of the 6th P.M., Weld County, Colorado, and
WHEREAS,the Board of County Commissioners heard all of the testimony and statements
of those present, studied the request of the applicant and the recommendations of the Department
of Planning Services staff and all of the exhibits and evidence presented in this matter and, having
been fully informed, deems it advisable to approve said partial vacation.
NOW,THEREFORE,BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said portion of Use by Special Review Permit#1316 described herein be,
and hereby is, vacated.

SUBJECT: Partial Vacation of USR-1316 in part of Section 19,
Township 6 North, Range 67 West of the 6t° P.M. Weld
County, Colorado.
The Department of Planning Services has received the attached letter dated September 13,
2005 from Julie Cozad, Entitlement Manager for Lot Holding Investments, LLC. Ms Cozad is
requesting that a portion of USR-1316 be vacated.
Background information:
Legal Description: Lot B RE-2767, Section 19, T6N, R67W of the 6th P.M., Weld County,
Colorado
Location: South of and adjacent to Highway 392 and east of Weld County Road 15
USR-1316: Approved by the Board of County Commissioners on May 23, 2001 for
gravel mining
Mr. George Hall recently applied for Recorded Exemption 3948. Because this portion of the Use
by Special Review Permit is no longer active, the Department of Planning Services required the
vacation of USR-1316 as a condition of approval. This request for partial vacation of USR-1316
is to satisfy the Department of Planning Services' condition.

This letter is a formal request to vacate portions of USR-1316, more specifically the area known as Lot
A of Recorded Exemption 3948, as approved by the Weld County Commissioners on April 20, 2005.
Mining is complete on this area and reclamation will be been done according to the Division of
Minerals and Geology Reclamation Plan.
