RESOLUTION
RE: GRANT CHANGE OF ZONE FROM A (AGRICULTURAL DISTRICT) TO I-3 .
(INDUSTRIAL DISTRICT) FOR R. T. DEVELOPMENT
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 6th day of October,
1982, at 2 : 00 o'clock p.m. for the purpose of hearing the appli-
cation of R. T. Development, c/o C. E. Tomson, Rocky Mountain
Production Company, L767 South Spruce Street, Suite 145, Engle-
wood, Colorado 80112, requesting a Change of Zone from A (agri-
cultural District) to I-3 (Industrial District) for a parcel of
land described as follows, to-wit:
A part of the North half of the Northeast
quarter of Section 31, Township 1 North,
Range 66 West of the 6th P.M. , Weld County,
Colorado, being more particularly described
as follows :
Commencing at the Northeast corner of said
Section 31, thence West along the North line
of said Section 31, 520.20 ' ; thence S89°31' 00"W,
1098. 03' to the point of beginning; thence
thence S89°31' 00"W, 64.68 ' ;
thence S00°29 ' 00"E, 659. 23 ' ;
thence $67°03 ' 00"E, 70.49 ' ;
thence N00°29 ' 00"W, 687.27 ' to the point of
beginning.
Said parcel contains one acre, more or less
including Co. Rd. 4 R.O.W.
WHEREAS , Section 21. 6.2 of the Weld County Zoning Ordinance
provides standards for review of such a Change of Zone, and
WHEREAS , the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the applicant and the recommendations of the Weld County
Planning Commission, and having been fully informed, finds as
follows :
1. The requested zone change is in compliance with Sec-
tion 21. 4. 1 of the Weld County Zoning Ordinance as
follows :
a. This request amends the property considered under
Change of Zone 350, which was approved by the Board
of County Commissioners, to include a strip of land
adjacent to and west of the approved "I-3" (Industrial)
site.

RE: COZ - R. T. DEVELOPMENT
b. It is the opinion of the Board of County Commissioners
that the property is consistent with the Weld County
Comprehensive Plan in that the property is located in
the City of Brighton Comprehensive Plan area and the
City of Brighton Planning Commission has recommended
approval of the original request. The Brighton Com-
prehensive Plan map identifies this property for
future industrial land use.
c. It is the opinion of the Board of County Commissioners
that this request will be compatible with the surround-
ing land uses, will have adequate sewer service to
serve the permitted uses within the proposed zone
district, and will have adequate road and highway
facilities to provide access to the property. In
addition, the property does not appear to have sand,
gravel or other mineral resources on or under the
subject property and is not located within a Flood
or Geological Hazard area, and that soil conditions
do not present moderate or severe limitations to
development.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the application of R. T.
Development, for a Change of Zone from A (Agricultural District)
-to I-3 (Industrial District) on the above referenced parcel of
land be, and hereby is , granted.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 6th day of
October, A.D. , 1982.

The following business was transacted:
I hereby certify that pursuant to a notice dated August 25, 1982, duly
published September 2, 1982 and September 23, 1982 in the LaSalle Leader, a public
hearing was held on the request of R. T. Development for a Change of Zone, from
A (Agriculture) to I-3 (Industrial) . The Planning Commission recommended that
this request be approved. Mr. C. E. Tomson was present representing R. T.
Development and answered questions. Mr. Tomson stated that this parcel is
presently leased to a drilling company. No one in attendance at the hearing
was opposed to the granting of said Change of Zone. After discussion, Commissioner
C. Carlson made a motion to approve this Change of Zone because it is suitable for
the area. Commissioner N. Carlson seconded the motion and it carried unanimously.

The purpose of this re-rowing application is to facilitate the re-zoning to
I-3 of a small strip of 1-and we have purchased which was inadvertently not
included in the original Deed of Trust between R.T. Development Co. Inc. and
Margaret Malara. This ommision has caused the real estate transaction to be
labeled an illegal transaction in the mind of the County Planning Services.
The legal description problem has been corrected and hopefully the re-zoning
of this strip of land lying on the west edge of our property can be implemented.
The property does lie within the boundaries of Recorded Exemption #1471-31-1-RE-244,
which is dated Febuary 14, 1977. Your favorable consideration of this request will
