HomeMy WebLinkAbout20050222.tiff HEARING CERTIFICATION DOCKET NO. 2005-04 RE: SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT#1490 FOR A VETERINARY HOSPITAL IN THE A (AGRICULTURAL) ZONE DISTRICT - ROGER AND ALICE MONROE AND KEVIN AND SUSAN VENDEGNA, C/O NICOLE TREVETHICK A public hearing was conducted on January 19, 2005, at 10:00 a.m., with the following present: Commissioner Robert D. Masden, Chair Commissioner William H. Jerke, Pro-Tem Commissioner M. J. Geile Commissioner David E. Long Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Chris Gathman Health Department representative, Char Davis Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated December 30,2004, and duly published January 5, 2005, in the Fort Lupton Press, a public hearing was conducted to consider the request of Roger and Alice Monroe and Kevin and Susan Vendegna, c/o Nicole Trevethick, for a Site Specific Development Plan and Use by Special Review Permit #1490 for a Veterinary Hospital in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Chris Gathman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site and surrounding uses, and stated there are two existing residences on the site, as well as outbuildings. Mr. Gathman stated the applicant is proposing to lease the two-acre portion of the site for the veterinary hospital, and one of the residences will need to be established as a Nonconforming Use, or the applicants will be required to apply fora Recorded Exemption as a Condition of Approval for this permit. He stated 11 referral agencies reviewed this proposal,and nine responded favorably or provided comments that have been addressed through the Conditions of Approval and Development Standards. In response to Chair Jerke, Ms. Gathman stated the site is located 3.5 miles from the municipal boundary of Longmont, and .75 miles from Mead. In response to Commissioner Masden, Ms. Gathman stated the applicant will deal primarily with small animals. Responding to Chair Jerke, Mr. Gathman stated the Use by Special Review Permit covers two acres of the overall property, the applicant will be leasing the site, and the Board can add the standard language which limits the permit to this applicant rather than allowing a use that is transferrable. Char Davis, Department of Public Health and Environment, stated the site is serviced by the Little Thompson Water District and a septic system, and all of the animals will be enclosed. Donald Carroll, Department of Public Works, stated the site is accessed from Weld County Road 32, and the Weld County grader shed is located directly west of the site. He stated the applicant will have one main access, staff is requiring the access be at least 24-feet wide and that no parking or staging be allowed on the County road,and the average daily traffic count is less than 100 vehicles per day. In response to Chair Jerke, Mr. Carroll stated the access is approximately 500 feet west of the intersection with Weld County Road 5. Nicole Trevethick,applicant,stated she has been in practice for five years,and the Mead area is in need of veterinary services. In response to Chair Jerke, Ms. Trevethick stated she treats small animals, and the property is owned by her grandparents and her aunt and uncle. Responding to Commissioner Masden, Ms. Trevethick stated the only animals that will be kept on the site will be those that are hospitalized; she will not be boarding animals. No public testimony was offered concerning this matter. Mr.Gathman stated typically staff includes the language for a nontransferable use when there are compatibility issues. He stated staff received no concerns from the Town of Mead or surrounding property owners. Based on those comments, Chair Jerke stated it does not appear there are compatibility issues and the use should be able to remain with the property. Commissioner Vaad concurred,especially since it is a two-acre site and any expansion would require an amendment to the permit. He noted the applicants are neighbors who live in his neighborhood,and they have made considerable improvements and upgrades to the property. Responding to Chair Jerke, Ms.Trevethick stated she has reviewed and concurs with the Conditions of Approval and Development Standards as proposed and modified. Commissioner Long moved to approve the request of Roger and Alice Monroe and Kevin and Susan Vendegna,do Nicole Trevethick,for a Site Specific Development Plan and Use by Special Review Permit #1490 for a Veterinary Hospital in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion also included the addition of items#1,#2,#8 and#13 of Ms. Davis' referral response, dated October 11,2004,to be added as Development Standards. (Clerk's Note: These four items were added as Development Standards#12,#13,#14, and#15,with the remaining items being renumbered.) The motion was seconded by Commissioner Vaad,and it carried unanimously.
