HomeMy WebLinkAbout20052033.tiff hoo, RESOLUTION RE: ACTION OF BOARD CONCERNING VACATING SHOW CAUSE DATE SET FOR USE BY SPECIAL REVIEW PERMIT#828 - JUDY OAKLEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 28th day of March, 2005, a Probable Cause Hearing was held before the Board to consider setting a Show Cause Hearing to determine whether or not Judy Oakley, 12236 Weld County Road 18, Fort Lupton, Colorado 80621, was in compliance with certain Conditions of Approval and Development Standards contained in Use by Special Review Permit#828 for a Kennel(64 Adult Dogs and 120 Puppies)in the A(Agricultural)Zone District, and WHEREAS, the alleged violations were said to be occurring on property described as part of the NW1/4 and part of the NW1/4 NE1/4 of Section 30, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after hearing testimony from the Department of Planning Services, the Board deemed it advisable to continue the matter to July 13, 2005, at 9:00 a.m., to allow the respondent adequate time to complete the closing on the property and vacate the kennel use, and WHEREAS, on July 13, 2005, after hearing testimony from the Department of Planning Services, the Board found that pursuant to the procedure as set forth in Chapter 2,Administration, of the Weld County Code there was sufficient probable cause to schedule a Show Cause Hearing for August 17, 2005, at 10:00 a.m., to consider whether or not said Use by Special Review Permit should be revoked for failure to comply with certain Conditions of Approval and Development Standards, and WHEREAS, Development Standard #12 of Use by Special Review #828, issued to Judy Oakley, states, "The Special Review permit shall not be transferable to any successors in the interest to the described property and shall terminate automatically upon conveyance or lease of the property to others for operation of the facility", and WHEREAS, the Board received evidence that the subject property has been transferred to L.G. Everest, Inc., dba Andesite Rock Company, 7321 East 88th Avenue, Suite 200, Henderson, Colorado 80640, and the kennels have been vacated. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Show Cause Hearing date set for August 17, 2005, be, and hereby is, vacated. She has moved out of the house and taken her kennel business with her. So to answer your big question -the kennels are empty. We will gradually be removing the buildings and structures.
