Weld County Public Works Department has reviewed final plan materials and has the following development referral
comments.
Comments
❑ The applicant shall re-submit to Public Works an amended sealed final drainage report that includes FEMA documentation.
o The Final Drainage Report - Faith Estates Subdivision, dated June 2005, by R. Sean Phipps, P.E., (Colorado PE
#37698) with Pickett Engineering, Inc. is generally acceptable. Public Works has not located documentation
regarding the presence of FEMA defined floodways,or lack thereof, in the report. The final drainage report shall
include a flood hazard review documenting any FEMA defined floodways. The engineer shall reference the
specific map panel number, including date. The development site shall be located on the copy of the FEMA
map.
o As a public notice, the drainage report states: "...the road centerline has been set one foot above said elevation (at
4755 feet)and the minimal allowable opening to a residential dwelling is to be not less than 4756 feet."
❑ The applicant shall re-submit to Public Works amended sealed final roadway / construction / grading plan drawings for
acceptance by Public Works.
o Intersection sight distance triangles shall be corrected on the roadway plans. Intersection sight distance triangles at
the development entrance must be shown in the proper locations (as per AASHTO) with respect to lanes of
oncoming traffic and the dimensions labeled. All landscaping within the triangles must be less than 3'/z feet in
height at maturity, and noted on the final roadway plans.
❑ The applicant has submitted an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private
Road Maintenance), which is acceptable to Public Works. The Board of County Commissioners prior to recording the final plat
shall approve the agreement.
❑ The applicant must submit three (3) additional sets of final roadway, drainage, utility / construction plan drawings (stamped,
signed, and dated)to Public Works for Weld County Field Inspectors' use during construction of the subdivision.
❑ The applicant or their agents may be required to obtain permits from Weld County's Public Works - Utility Agent, for each
utility.
Recommendation
❑ The above comments are prerequisites and shall be fulfilled prior to recording the final plat.
Any issues shall be resolved with Public Works prior to recording of the final plat.

The Weld County Health Department has reviewed this Final Plat. The primary and secondary
septic envelopes placed on the Final Plat are slightly smaller than what was reviewed at the Change
of Zone, but are adequate. All envelopes meet the 100 foot setback to a ditch. Language for the
preservation and/or protection of the second absorption field envelope is to be placed in the
development covenants. There were no covenants included to review. There were no notes placed
on the Final Plat.
The Change of Zone application was approved with the following conditions:
1. Water service shall be obtained from the North Weld County Water District
2. A Weld County septic permit is required for each proposed septic system,which shall be
installed in according to the Weld County individual sewage disposal system regulations.
Each septic system shall be designed for site-specific conditions, including, but not limited
to: maximum seasonal high groundwater, poor soils, and shallow bedrock.
3. Language for the preservation and/or protection of the second absorption field envelope
shall be placed in the development covenants. The covenants shall state that activities
such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary
structures, dirt mounds, etc.) are expressly prohibited in the designated absorption field
site.
4. A stormwater discharge permit may be required for a development/redevelopment
/construction site where a contiguous or non-contiguous land disturbance is greater than
or equal to one acre in area. Contact the Water Quality Control Division of the Colorado
Department of Public Health and the Environment at
www.cdphe.state.co.us/wq/PermitsUnit for more information.
5. During development of the site,all land disturbances shall be conducted so that nuisance
conditions are not created. If dust emissions create nuisance conditions,at the request of
the Weld County Health Department, a fugitive dust control plan must be submitted.
6. In accordance with the Regulations of the Colorado Air Quality Control Commission any
development that disturbs more than 5 acres of land must incorporate all available and
practical methods which are technologically feasible and economically reasonable in order
to minimize dust emissions.
7. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6
months in duration,the responsible party shall prepare a fugitive dust control plan,submit

an air pollution emissions notice,and apply for a permit from the Colorado Department of
Public Health and Environment.
8. "Weld County's Right to Farm" as provided in Appendix 22-E of the Weld County Code
shall be placed on any recorded plat.

1. Building permits shall be obtained prior to the construction of any building. Building permits are
required for the principle dwelling and for buildings accessory to the principle dwelling.
2. A plan review is required for each building. Two complete sets of plans are required when applying
for each permit. Each building may be required to be designed by a Colorado registered engineer.
3. Buildings shall conform to the requirements of the codes adopted by Weld County at the time of
permit application. Current adopted codes include the 2003 International Building Code; 2003
International Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code;
2002 National Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an
open hole inspection performed by a Colorado registered engineer. Engineered foundations shall be
designed by a Colorado registered engineer.
5. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined
by the Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to
determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building.

The Sheriff's Office recommends the following improvements for this housing sub-division:
1. The Sheriffs Office requests that builders and developers designate an area by the entrance of
the sub-division in which to place a shelter for school children awaiting the school bus. This
area should also include a pull off for the school bus which enables it to safely load and unload
children out of the roadway.
2. Either mail distribution within the sub-division or a central drop off location within the sub-division
should be developed so that residents do not have to cross a county road to obtain their mail.
3. A permanent sign should be placed at the entrance to the subdivision detailing the name of the
sub-division,address,and a graphical presentation of the roadways within the subdivision.
There should be a plan developed to maintain this sign.
4. If the roadways within this sub-division are not maintained or adopted by the county, individuals
purchasing property in this sub-division should be notified that the Sheriff's Office will have
limited traffic enforcement powers.
5. A plan should be developed to maintain roadways within the sub-division especially during
inclement weather conditions for emergency vehicles.
6. The Sheriffs Office is very supportive of homeowner funded homeowner's associations. These
associations provide a contact for the Sheriffs Office and a means of maintaining common
areas.
7. If there are oil or gas production facilities within this sub-division,they need to be fenced off in
order to mitigate the potential for tampering. These facilities are known to create an attractive
nuisance for young people. Tampering not only creates a significant danger to safety but also of
environmental damage with extensive mitigation and clean-up costs.
S. The names of all streets within the sub-division should be presented to the Sheriffs Office for
approval. This will eliminate duplication of street names within the county.
The Sheriff's Office lacks the ability to absorb any additional service demand without the resources
recommended in the multi-year plan provided to the Weld County Board of County Commissioners or as
indicated by growth not considered at the time the plan was developed. I have no other comments on this
proposal.

Dear Chris,
With regard to the above referenced referral, the Colorado Division of Wildlife would recommend:
1. To minimize the possibility of contaminating ground and surface waters, careful consideration
should be given by your staff and other appropriate Weld County agencies in selecting the style
and permitting the location for the septic system for lot 6 of the subdivision.
2. In an attempt to decrease the impacts of increased human disturbance caused by construction and
occupancy of this subdivision to the wet meadow and adjacent woodlands at the south west
corner of the parcel, a shrub planting may be installed along the north and east edge of this
important wildlife habitat. Candidate species for the planting may include but not be limited to:
chokecherry, golden current, wild rose, American plum or other plant species with high value for
wildlife. The planting should be installed using weed/mulch cloth barrier in a manner that when
mature it will screen the wet meadow from the human habitations.
3. Tree trimming on the trees found in the open canopied forest should be done in a manner that will
preserve tree cavities and other cover for wildlife to all extent possible.
Larry Rogstad, District Wildlife Manager, met with Mr. Harkless on site and reviewed the applicant's
proposal. As the local officer, Rogstad was familiar with the parcel, which is in a section of land that has
been historically farmed using irrigated agricultural methods. As such the property being considered for
the most part is of limited value as wildlife habitat. However, in the center of section 13, on the west end
of Mr. Harkless' property(approximately the south third of Lot 6)there is a low swale composed of wet
meadow an open canopied cottonwood riparian woodland and portions of the old number 2 ditch system.
As this area is the only uncultivated portion of all the surrounding lands, this swale provides essential
habitat for wildlife. Nesting raptors, hunting roost sites for raptors, cover for deer, raccoons, red fox and
a variety of other creatures may be found at this site. Over the years Rogstad has contacted hunters using
this area.

Mr. Harkless recognizes the value of the lowland in attracting and holding wildlife, and appreciates that
maintaining its character is an asset to his development. However a 200 foot set back from home sites to
this important wildlife habitat may be inadequate to allow the comfort that will allow the wildlife to
continue use of the swale. Mr. Harkless has expressed an interest in installing wildlife plantings to
provide visual screening and promote continued use by wildlife. To this end the Division of Wildlife
would like to offer our assistance in planning for planting that will be as effective as possible in achieving
these goals.
During his inspection Rogstad noticed that the south and west end of lot six had a stand of wild licorice, a
facultative wetland indicator. Cottonwoods and willow in the area also indicate a high water table.
Pollution of surface and groundwater adversely impacts fishery and wildlife resources on site as well as
potentially downstream. Care must be given to preserve these precious resources. It is imperative that
we give careful consideration to selecting proper sites and correct technology in installing septic systems
on sites with high water tables.
Mr. Harkless expresses a strong desire to maintain the existing trees in as healthy a manner as possible.
To this end he will be working with arborists to trim the stand. The Division appreciates the need to
idemify and remove hazard trees and diseased tissue. However, tree cavities provide essential nesting
habitat and cover for many diverse species of wildlife. To this end we would recommend that the mature
cottonwoods be examined and trimmed as necessary, while preserving as many openings and cavities
possible. Rogstad would be happy to meet with the arborist and Mr. Harkless if necessary to discuss
mutual interests in trimming the trees while maintaining wildlife habitat. In an effort to reduce negative
impacts on nesting species it would be best if the work occurs in the fall or early winter.
We have appreciated the opportunity to review and comment on this proposal. Rogstad wishes to pass

We have reviewed the above applicant's request. The Eaton School District has a process in
place addressing growth within the District.
The School District has adopted a methodology to determine a cash-in-lieu payment for
residential development within the District in order to provide adequate educational opportunities
as a result of that development.
The cash-In-lieu payment per dwelling lot is $1,043 for a total of $9,387 for this 9-Lot PUD.
Payment should be hand delivered or mailed to Eaton School District, 200 Park Avenue, Eaton,
Colorado 80615. A receipt will be mailed to the applicant and a copy to the Weld County
Planning Department. Payment will be required prior to final plat.
The District typically does not go into developments to pick up students. As a result, the District
would need a bus turnout area at the entrance on the west side of WCR 37 that would be a
minimum 15' wide and 80' in length. The District would also like to request that a covered bus
shelter be provided (similar to what is found at city bus stops) that blocks the wind on three sides
with a roof to protect students while they are waiting for the bus. The size of the structure would
be would be approximately 6' x 10' located at the north east corner of the entrance into the
development.

We have reviewed the above applicant's land use map prepared December 8, 2004. The
proposed bus turnout would be sufficient as long as It is constructed whereby It allows for a •
rectangular area that is 15' wide by 80' in length to allow our bus to enter and stop to pick up
students. As per our earlier letter dated June 18, 2004, a bus shelter approximately 6' x 10'
would be sufficient as the district typically does not go into developments to pick up students.

Dear Mr. and Mrs. Harkless:
This letter is to confirm our understanding as to how your minor subdivision referral will affect the
Eaton School District RE-2. As per the District's response to the Weld County Planning
Department on January 27, 2005, the District has established a cash-in-lieu payment for
residential development within the District in order to provide adequate educational opportunities
as a result of that development.
The District will accommodate your request to coincide this payment with the final plat and the
closing of a bank construction loan for infrastructure Improvements to the property that will take
place in early July 2005. This agreement stipulates that the $9,387 due to Eaton School District
RE-2 will be remitted to us within ten days of the July loan closing. In the event payment is not
made to the District within that time frame, or other arrangements are not made with the District in
respect to payment, collection procedures will begin immediately.
If you are in agreement, please sign in the space provided below and return a copy to me. Thank
you for your cooperation with Eaton School District RE-2.

We have previously reviewed the above referenced proposal to subdivide a 33.51-
acre into 9 single-family residential lots by our letters dated June 14, 2004, January 12,
2005 and March 17, 2005.
Information from this submittal indicates that this is the Final Plat for this
subdivision and water is to be provided by the North Weld County Water District (District)
per terms and conditions of the District. In our letters dated June 14, 2004 and March 17,
2005 (copies attached) this office already rendered an opinion on the proposed water
supply indicating that the proposed water supply can be provided without causing material
injury to the existing water right and the proposed water supply is adequate. In addition,
the proposed fire-fighting well will not cause material injury to decreed water rights,
provided the well is operated only for fire-fighting purposes and provided the well will be
capped and locked at all other times.
Since no changes in the water supply for the Faith Estates subdivision were
identified in this new submittal, the comments from our letters dated June 14, 2004 and
March 17, 2005 still apply.

Dear Ms. Martin:
We have reviewed additional information submitted to this office on March 8, 2005 on
the above referenced proposal to subdivide a 33.51-acre into 9 single-family residential lots.
Although we have not received a formal request by the county to review this additional
information, in an effort to assist the county the State Engineer's Office offers the following
comments.
As previously mentioned in our letter dated January 12, 2005 (copy enclosed), the
developer is proposing to construct a well that will be used exclusively for fire-fighting purposes,
until such time that improvements to the existing North Weld County Water District(District)
infrastructure are made to increase the fire flow rates in the area to the minimum fire flow as
required by the Eaton Fire Protection District of 500 gallons per minute. The developer was
required to verify if the District objects to the construction of a fire fighting well within the
District's water service area and provide a letter of"no objection"with any well permit
application submitted to this office. A letter dated February 8, 2005 from the District indicates
that the District has no objection to the applicant obtaining a well permit for the fire fighting
purposes within the boundaries of the District.
In addition our previous letter dated January 12, 2005 mentioned that if a permit for a
fire fighting well is issued, the permit will require the well and/or storage tank filled by the well,
to be capped and locked and available only for fighting fires. The fire fighting well cannot be
used to provide water to the central water distribution system. Based upon this additional
information the well will not be used to provide water to the central water distribution system
and the use of the well will be exclusively for fire-fighting purposes. At such time that the District
will be able to provide the required fire flow through the central water system the well will be
abandoned.
Based on the above, it is our opinion, pursuant to C.R.S. § 30-28-136(1)(h)(I), that the
proposed fire-fighting well will not cause material injury to decreed water rights, provided the
well is operated only for fire-fighting purposes and provided the well will be capped and locked
at all other times.

We have reviewed the above referenced proposal to subdivide a 33.51-acre parcel described as
Lot B of the Recorded Exemption RE-2641, into 9 single-family residential lots ranging in size from 2.6
acres to 3.6 acres.
The proposed water source for the residential lots is listed as the North Weld County Water
District (District). An existing residence located on proposed lot 6 has water service provided by the
District. A letter of commitment from the District was included in the referral material. The letter indicates
that, the District is able and intends to serve the proposed eight additional lots in the subdivision per terms
and conditions of the District. The developer will be responsible for the extension of the water line to the
subdivision.
Based on current records on file in this office, the District currently has an adequate uncommitted
water supply to provide the water associated with this project. A Water Supply Information Summary was
not included in the referral material.
Pursuant to Section 30-28-136(1)(h)(II), C.R.S., it is the State Engineer's opinion that with the
District being the proposed water supplier, there is expected to be satisfactory water supply and can be
provided without causing material injury to existing water rights.
