There are several issues that I would like to bring to your attention. #1: I have been required to included engineering design information on this subdivision plat, and specifically the "road cross-section detail." This information is engineering based and in my opinion is not appropriate to be shown on a subdivision plat. I have had a discussion with the planning personnel in the past and specifically on the Ridgeview P.U.D. plat that I am preparing for P&A Turkey. During that discussion it was my understanding that it was agreed that this type of information was inappropriate for a subdivision plat and therefore should not be shown on the subdivision plat. However, I am still being required to shown this information. I have placed the following note on the subdivision plat in conjunction with the above required detail: SURVEYOR'S NOTE This detail is provided as a requirement for approval by the Weld County Planning Department for the final mylar submittal. I, Charles B. Jones, a Colorado Registered Professional Land Surveyor LS22098, am not licensed in the State of Colorado to practice Engineering. I did not prepare this detail nor am I responsible for the engineering design that developed this detail. It is my opinion that I must place this note on the drawing to specify that this detail was not prepared by me, as I am not licensed in Colorado to practice engineering and that a Licensed Engineer is not required to sign the subdivision plat. Our licensing authority has determined that a "Certificate" is defined as a statement that includes the following: (a) Is signed and/or sealed by a professional land surveyor representing that the surveying services addressed therein have been performed by the professional land surveyor or under the professional land surveyor in responsible charge. (b) Is based upon the professional land surveyor's knowledge, information and belief. (c) Is in accordance with applicable standards of practice. (d) Is not a guaranty or warranty, either expressed or implied It is my professional opinion that I do not have to state that the work was done in accordance with"applicable rules, regulations and laws of the State of Colorado, State Board of Registration for Professional Engineers and Professional Land Surveyors, and Weld County," as is being required by Weld County. By placing my signature and seal on a drawing, it is implied and understood that I have met all applicable requirements for whatever type of drawing/survey that I have prepared. Obviously by the approval of the reviewing authority and in this instance by Weld County their requirements would have been met. This morning she left me the following message via voice mail: "Basically, if you are going to the final plat for the subdivision, and [there are] no changes from the previous supply plan, then I believe you don't have to submit anything; if the county really wants us to review, again, the final plat,we can do that, hut, again, as I said, if[there are] no changes from the previous supply plan, I don't see the point of sending another letter to the county, since we already commented on the water supply and also on the fire-fighting well." The state office commented on the water supply from the North Weld County Water District in their June 14, 2004, letter, stating that "there is expected to be satisfactory water supply and can be provided without causing material injury to existing water rights." They commented on the water supply from the fire well in their March. 17, 2005, letter, stating that"the proposed fire-fighting well will not cause material injury to decreed water rights,provided the well is operated only for fire-fighting purposes and provided the well will be capped and locked at al.l other times." Based on the comments in these letters and foam's voice mail response to our June 7, 2005, letter, 1 believe the water supply summary information we will attach to the Final Plat submittal will be sufficient lin•their final review. We are currently preparing the Final Plat submittal package. During the Final Plat referral process,the Office of the State Engineer will be asked to review our information to establish an opinion on whether or not the proposed water supply will cause material injury to existing water rights and whether or not the supply is expected to be adequate. In the review of the Faith Estates Minor Subdivision, the water supply information for the North Weld County Water District and the water supply information for the proposed "fire well" will be evaluated. The intention of this letter is to provide you with our current information regarding the water supply to determine if it is sufficient for your office to offer an opinion on these issues. In regard to the water supply from the North Weld County Water District (NWCWD), I asked Alan Overton if I could obtain a current Water Supply Report for the district. Alan explained that the NWCWD typically sends a copy of that information to the Office of the State Engineer on an annual basis. He believed your office should already have a current copy. Previously your office reviewed the letter of commitment from the NWCWD indicating that the district is able and intends to serve the proposed subdivision. Your office submitted a letter dated June 14, 2004, in response to the referral materials provided by Weld County. In that letter your office offered the opinion that, "with the District being the proposed water supplier, there is expected to be satisfactory water supply and can be provided without causing material injury to existing water rights." The Final Plat submittal package will contain no changes to the water supply from the NWCWD. That stated, will your office need a current Water Supply Information Summary from the NWCWD or are your current records sufficient? As you are aware, the NWCWD has previously stated that they have "no objection" to the construction of the proposed well within their district and has "no objection"to the developer submitting a well permit application to the Colorado Division of Water Resources. You are also aware that: • The well will be capped and locked and used exclusively by the Eaton Fire Protection District, available only for fighting fires. • The well will not be used to provide water to the central water distribution system. • At such time as the NWCWD is able to provide the required fire flow through the central water system, the use of the well for fire-fighting purposes will be abandoned. The developer intends to submit a General Purpose Water Well Permit Application upon the approval of the Final Plat. A draft copy of the permit application has been attached. Based on the proposed use of the well as described above, we believe the well permit will qualify for "exempt" status and will not take an extended period of time to be approved. Is the attached and previously supplied information sufficient for your office to provide an opinion on the potential for injury to decreed water rights and the adequacy of the water supply in regard to the fire well? Without a Weld County Road address at the end of the above address to obtain a crossroad it is impossible for any emergency agency to know where to respond to. The only change to the address we would like for you to consider for nine savings in an emergency would be to add the county road number to the end of the address. For example the address might read 33309 Faith Lane WCR 99. Unfortunately, Weld County Paramedics at the current time does not have GIS capability nor can the supplier of our current maps keep up with the building progress in the county. There is a significant amount of new subdivisions being developed monthly throughout the county's 4004 square miles and for our agency's persointel to know where everyone of these arc is impracticable. For this reason without a complete address including the \VCR at the end of the address the developer and residents of this subdivision must he aware if an emergency should occur a significant delay in the response time could occur. The only remaining issue that is currently being addressed is the issue of gaining permission from Merritt Oil to be allowed to provide security fencing around the oil tanks and well site. It is felt that Merritt Oil is likely to work with Mr. Harkless to allow him to place some form of a safety fence to keep individuals out of the oil site for their own protection. It is felt that this is a minor issue that should be resolved thus the Sheriffs Office finds that there is no reason based on our concerns that should stop this subdivision from going forward. The Weld County Planning Department has requested that, prior to recording the change of zone plat, we attempt to address the concerns of the City of Greeley as stated in the referral "comments dated December 22, 2004. While we appreciate your review and your comments and we have taken them under advisement, we realize the County does not require their resolution and they do not necessarily match the intention for a low-impact development. Below are our responses to the referral comments: 1. The property is located outside of the City of Greeley's Long-Range Expected Growth Area. The applicant is unable to dedicate a total of 60 feet of right-of-way west of the existing centerline of WCR 37 without putting three of the lots in the subdivision under the minimum lot acreage required for estate lots. Additionally, we also appreciate the positive attributes of the previous layout; however, we were unable to go further with that layout due to constraints presented by existing utilities. The current layout has been accepted by Weld County's Planning and Public Works Departments and is the most economical and functional option for the applicant. 2. The layout has been adjusted to retain as many existing trees on the property as possible. 3. Since the private access road will generate a very low traffic volume, the applicant and the County Public Works Department do not feel pavement is warranted. However, our client has expressed interest in a chip-seal or polymer admixture for the gravel road to help reduce impacts to air quality. The current layout shows the entrance to the subdivision located more than 1,600 feet north of the intersection of Highway 392 and WCR 37, and more than 1,000 feet south of the next parcel. The County has not expressed any concerns regarding 'the separation of access points to WCR 37. Rather, they will be planted with native grasses, which have low water demands and blend into the natural surroundings. The applicant plans to maintain these tracts for the first couple of growing seasons to help the native grass plantings become established. Once the native grasses are established, Tracts A and B will not promote the growth of noxious weeds and will not require irrigation or substantial maintenance. (see-attached memorandum). The material submitted this time appears to be only for a change in zoning on the proposed Faith Estates. The minimum fire flow as required by the Eaton Fire Protection District is 500 gallons per minute, therefore the proposal is to construct a well that will be used exclusively for fire-fighting purposes, until such time that improvements to the existing North Weld County Water District infrastructure are made to increase the fire flow rates in the area. Based on the information provided we cannot determine if a well permit for a well to be used exclusively for fire fighting purposes may be available. Applicant will need to verify if the District objects to the construction of a fire fighting well within the District's water service area and provide a letter of "no objection"with any well permit application submitted to this office.
