HomeMy WebLinkAbout20050135.tiff RESOLUTION RE: APPROVE AGREEMENT FOR RECREATIONAL/EDUCATION SERVICES FOR COLORADO WORKS SUMMER ACTIVITIES PROGRAM WITH VARIOUS PROVIDERS AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with two Agreements for Recreational/Education Services for the Colorado Works Summer Activities Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Social Services,and the following providers, commencing May 1,2004, and ending December 31, 2004, with further terms and conditions being as stated in said agreements, and 1. Town of Kersey 2. Town of Milliken WHEREAS,after review,the Board deems it advisable to approve said agreements, copies of which are attached hereto and incorporated herein by reference. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, ex-officio Board of Social Services, that the two Agreements for Recreational/Education Services for the Colorado Works Summer Activities Program between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County,on behalf of the Department of Social Services,and the above mentioned providers be, and hereby are, approved. Griego,Director, Social Services441k) (t RE: Agreements for Recreational/Education Services for Colorado Works Summer Activities Program with Various Summer Providers Enclosed for Board approval are Agreements for Recreational/Education Services for Colorado Works Summer Activities Program between the Weld County Department of Social Services (Department)and various summer providers. The Agreement was discussed and reviewed at the Board's Work Session of November 22, 2004. Data entry for certain children and youth who participated in this year's Summer Activities Program has not been successful in the Colorado Benefit Management System(CBMS). To expedite payment, an Agreement is being established to pay providers. The major provisions of the Agreement are: 1. The term of the Agreements are for a period beginning May 1, 2004 through December 31, 2004. 2. The Department agrees to reimburse the various summer providers a maximum registration or activity fee per child of$125.00 per summer and at the same rate charged to other participants receiving the same recreational or educational services. These summer providers are as follows: A. Town of Kersey B. Town of Miliken 3. The Town of LaSalle will provide recreational or education services to children and youth referred by Social Services, were TANF eligible, and were aged one through seventeen years of age. 4. The source of funding is Colorado Works or Temporary Assistance for Needy Families (TANF). If you have any questions,please telephone me at extension 6510. 2005-0135 Contract No. -04-TANF-SP 110 AGREEMENT FOR RECREATIONAL/EDUCATION SERVICES FOR COLORADO WORKS SUMMER ACTIVITIES PROGRAM;`; THIS AGREEMENT is made and entered into this 1i day of December,2004,by and between/tit Bard of County Commissioners of the County of Weld, State of Colorado, sitting on behalf of the Weld County C t_./0 Department of Social Services, hereinafter referred to as"Social Services", and TOWN OF MILLIKEN,whose address is PO Box 290,Milliken,CO., 80543,hereinafter referred to as"Summer Provider". WITNESSETH: WHEREAS,the Social Services provides supportive services to eligible children and juveniles who need educational and/or recreational activities as outlines in its Colorado Works Plan for Weld County, and WHEREAS, Social Services is in need of recreational and educational providers to assist Social Services' Summer Activities program in providing services to eligible children:nd juveniles, WHEREAS,TOWN OF MILLIKEN has educational or recreational activities available for eligible children and juveniles of Social Services at fees, which is set forth below. NOW,THEREFORE, in consideration of the mutual promises and covenants contained herein,the parties hereto agree as follows: 1. TERM: The term of this Agreement shall be from May 1,2004,through and until December 31, 2004. 2. SERVICES PROVIDED BY SUMMER PROVIDER: Summer Provider agrees to provide educational and/or recreational services for eligible children and youth involved in the Summer Activities Program according to enrollment activities of the Summer Provider. 3. COMPENSATION: Social Services agrees to pay Summer Provider for educational and/or recreational services performed pursuant to this Agreement at the rate not to exceed$125 per term of the Agreement and at the rate charged to other non-Social Services participants receiving the same recreational or educational services. The parties agree that the service rate as contemplated herein shall constitute the entire amount of compensation due to the Summer Provider for any work performed hereunder. 4. INDEPENDENT CONTRACTOR: Summer Provider agrees that it is an independent contractor and will not become an employee of Social Services,nor is the Summer Provider entitled to any employee benefits under Social Services as a result of the execution of this Agreement. 5. INDEMNIFICATION: Summer Provider shall indemnify Weld County, its officers and employees,against liability for injury or damage caused by any negligent act or omission by Summer Provider in the performance of this Agreement and shall hold Weld County harmless from any loss occasioned as a result of the performance of this Agreement. 6. NON-ASSIGNMENT: Summer Provider may not assign or transfer this Agreement, any interest therein or claim thereunder,without the prior written approval of Social Services. 7. ACCESS TO RECORDS: Social Services shall have access to Summer Provider's financial records for the purposes of audit. Such records shall be complete and available for audit 90 days after final payment hereunder and shall be retained and available for audit purposes for at least five years after final payment hereunder. TERMINATION: Either party may terminate this Agreement at any time by providing the other party with a 10-day written notice thereof Furthermore,this Agreement may be terminated at any time without notice upon a material breach of the terms of the Agreement. 9. TIME OF THE ESSENCE: Time is of the essence in each and all of the provisions of this Agreement. 10. ENTIRE AGREEMENT/MODIFICATIONS: This Agreement constitutes the entire understanding between the parties with respect to the promises and covenants made therein. No modification of the terms of this Agreement shall be valid unless made in writing and agreed to by both parties. 11. NON-APPROPRIATION: No portion of this Agreement shall be deemed to create an obligation on the part of Social Services to expend funds not otherwise appropriated in each succeeding year. 12. WAIVER OF IMMUNITIES/THIRD PARTY LIABILITY: No portion of this Agreement shall be deemed to constitute a waiver of any immunities of Social Services or its officers or employees may possess,nor shall any portion of this Agreement be deemed to have created a duty of care with respect to any persons other than Social Services and not a party to this Agreement.
