HomeMy WebLinkAbout20053373.tiff 27B RESOLUTION RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND -_ 9 USE BY SPECIAL REVIEW PERMIT#1522 FOR COMMERCIAL RODEO ARENAS AND COMMERCIAL ROPING ARENAS,TO INCLUDE OUTDOOR ARENAS, RACE TRACK, -_g Eco AND RACE COURSE,IN THE A(AGRICULTURAL)ZONE DISTRICT-ALBERTO LOYA =� = = d U .3 WHEREAS,the Board of County Commissioners of Weld County, Colorado, pursuant to o Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and -¢ op CC —NC/7 WHEREAS, the Board of County Commissioners held a public hearing on the 7th day of December,2005,at the hour of 10:00 a.m.in the Chambers of the Board for the purpose of hearing — oS the application of Alberto Loya, 481 Soar Lane, Platteville, Colorado 80651, for a Site Specific =N c Development Plan and Use by Special Review Permit#1522 for Commercial Rodeo Arenas and = g Commercial Roping Arenas, to include outdoor arenas, race track, and race course, in the A =o= (Agricultural)Zone District on the following described real estate,being more particularly described mwmm°C —nom as follows: _cm —In C S1/2 SE1/4 of Section 30, Township 3 North, — - Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS,said applicant was represented by Todd Hodges,Todd Hodges Design, LLC, 1269 North Cleveland Avenue, Loveland, Colorado 80537, at said hearing, and WHEREAS, Section 23-2-230 of the Weld County Code provides standards for review of said Use by Special Review Permit, and WHEREAS,the Board of County Commissioners heard all of the testimony and statements of those present,studied the request of the applicant and the recommendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter and,having been fully informed, finds that this request shall be denied for the following reasons: 1. It is the opinion of the Board of County Commissioners that the applicant has not shown compliance with Section 23-2-230.6 of the Weld County Code as follows: a. Section 23-2-230.B.3 --The uses which would be permitted would not be compatible with the existing surrounding land uses. The large crowds and heavy traffic which would be attracted to the area and the activities associated with racing,such as gambling and alcohol consumption,are not compatible with the surrounding land uses,particularly those of a residential nature. b. Section 23-2-230.B.7 -- The Design Standards (Section 23-2-240, Weld County Code),Operation Standards(Section 23-2-250,Weld County Code), Conditions of Approval, and Development Standards will not ensure that there are adequate provisions for the protection of the health, safety, and welfare of the inhabitants of the neighborhood and County. It will be difficult for the applicant to control where people walk in a large crowd,the current condition of the site is not vegetated and is subject to blowing, and the proposed use would create more dust erosion and present a threat to the health safety and welfare of the inhabitants of the neighborhood and County. The number of participants on any given daywould be the equivalent of a small municipality, such as the Town of Gilcrest, and would generate comparable impacts without comparable support services. NOW,THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County,Colorado,that the application of Alberto Loya for a Site Specific Development Plan and Use by Special Review Permit#1522 for Commercial Rodeo Arenas and Commercial Roping Arenas, to include outdoor arenas, race track, and race course, in the A(Agricultural)Zone District on the parcel of land described above be, and hereby is, denied.
