The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Our comments and requirements are as follows:
COMMENTS:
WCR 18 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which
requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is
maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23,
Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
WCR 18 and WCR 53 already has dust control being placed in front of each home on this designated haul
"lute to the adjacent property, Mr. Tweety, who runs the truck driving school. The Stonebraker property is
_erectly east of this facility.
Vehicle Trips: In the original USR questionnaire No. 5(f) Vehicles Accessing the Site, The applicant's
response was one vehicle per month on the off-season. In the amended USR, under the same item, the
applicant's response was 20 trips per day by light pickups or automobiles for inspection and with larger trucks
making 25 to 50 trips per day around the 4th of July holiday (January and July). This is a dramatic change in
the amount of traffic being generated by the site per the amendment.
We have an updated average daily traffic count on WCR 18 and 53 adjacent to the proposed USR
amendment. WCR 18 count reflects approximately 145 vehicles and WCR 53 reflects 169 vehicles per day.
Both counts were taken 6/30/2004 with follow-up counts after 30 days that reflected the same amount.
REQUIREMENTS:
Access: The applicant identified in the application utilizing the existing access to the amended USR. This is a
shared access with the existing/new home on site.
Circulation: The access and circulation pattern shall be surfaced with gravel. The gravel shall support semi-
truck traffic and shall be graded to prevent drainage problems. The applicant identified a 30-foot
egress/ingress easement across Lot A of RE-3589 to the amended USR property.
Dust Suppressant: With the tremendous amount of increase in the second questionnaire on the amended
USR, we recommend that dust suppressant is placed for approximately 300 feet and including the access drive
front of the applicant's property and the neighbor directly across the road from the USR site to minimize
npact to the adjacent property owner.

The adjacent USR semi-tractor truck driving school is already placing dust control adjacent to residences on
the designated haul route--WCR 53 and WCR 18--for use at their facility. It is required that the applicant
provide dust control applications a minimum of twice per year or as needed in front of the neighboring property
to minimize the impact to adjacent property owner. The applicant shall enter into an Improvements Agreement
(dust control)with the Weld County Public Works Department.
Storm Water Drainage: As I have addressed the storm water drainage in the previous USR and the applicant
is only adding three additional storage facilities, the same requirements are in place.

Environmental Health Services has reviewed this proposal for display fireworks storage
and fireworks equipment staging facility along with an office. We have no objections to
the proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall provide current evidence that the facility has an adequate
water supply (i.e., well or community water system).
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to issuance of building permits:
1. A stormwater discharge permit may be required for a
development/redevelopment/construction site where a contiguous or non-
contiguous land disturbance is grater than or equal to one acre in area. Contact
the Water Quality Control Division of the Colorado Department of Public Health
and Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information.
We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the proposed metal
building(s) and shall be installed according to the Weld County Individual
Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.

10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
12.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

A Site Specific Development Plan and special Review Permit for a Use by Right, Accessory Use or Use by
Special Review in the commercial or Industrial Zone District. ( Display Fireworks and fireworks equipment staging
facility along with an Office ) in the A (Agricultural Zone.
1. A building permit shall be obtained prior to the construction of any new building.
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
are required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Building Department with each Building permit application. Building plans shall also be submitted to Southeast
held Fire Protection District for their approval.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. Each building will require an engineered foundation based on a site-specific geotechnical report or an open
hole inspection performed by a Colorado registered engineer. Engineered foundations shall be designed by a
Colorado registered engineer.
5. The structures will probably be classified as a mixed use, B (offices) and F (Manufacturing) and S-1 (Storage)
occupancies. Fire resistance of walls and openings, construction requirements, maximum building height and
allowable areas will be reviewed at the plan review. Setback and offset distances shall be determined by the
Zoning Ordinance.
6. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

The sheriff's office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening" it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
.-- Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.

Dear: Chris
The Town of Keenesburg received a referral on the William&Ann Stonebraker application in
November 2004. We returned that referral with a finding of no conflicts dated 11-16-04.
This matter was again reviewed after our March 21St 2005 Town Board meeting and based on the
packet received from the planning department we still have no conflict.
The area of this project is within the Town of Keenesburg's growth plan. If this area were to be
annexed it would most likely be commercial highway zoned to be consistent with the existing
part of town.
We have not received any complaints on the existing facility operated at this location. It appears
it has been maintained just as was promised by the Stonebraker family.
The Town of Keenesburg feels confident that the Weld County Department of Planning will
make certain that all of the"safety concerns" will be addressed and that all necessary
inspections and permits required will be in place.
