A RESOLUTION FINDING THAT THE PETITIONS FOR
ANNEXATION OF THE HAWK'S LANDING ANNEXATIONS #1 AND
#2 ARE IN SUBSTANTIAL COMPLIANCE WITH C.R.S. 31-12-107(1)
AND SETTING A DATE FOR A HEARING BEFORE THE BOARD OF
TRUSTEES OF THE TOWN OF SEVERANCE TO CONSIDER
ANNEXATION AND ZONING OF THE AREAS PROPOSED TO BE
ANNEXED.
WHEREAS, the owners of 100% of the property known as the Hawk's Landing
Annexation#1 and#2 have filed Petitions for Annexation of the hereinafter described property to
the Town of Severance, and;
WHEREAS, the Board of Trustees has determined that the Petition is in substantial
compliance with C.R.S. 31-12-107(1) and that a hearing on such annexation should be scheduled
as provided by Colorado law.
NOW THEREFORE BE IT RESOLVED BY 1'HF. BOARD OF TRUSTEES OF
THE TOWN OF SEVERANCE,COLORADO AS FOLLOWS:
Section 1. The Board of Trustees hereby accepts the above described petitions for
annexation and finds and determines that the petition for annexation of the property described as
the Hawk's Landing Annexation #1 and Hawk's Landing Annexation #2 and as described in
Exhibit "A" attached hereto is in substantial compliance with the requirements of C.R.S. 31-12-
107(1)and Section 30 of Article II of the Colorado Constitution and desires to initiate annexation
proceedings in accordance with law.
Section 2. The Board of Trustees will conduct a public hearing on the 16u day of
February 2005,at the hour of 7:00 p.m.or as soon after as possible at the Town Hall,Town of
Severance, 231 West Fourth Avenue, Severance, Weld County, Colorado for the purpose of
determining whether the area proposed to be annexed meets the applicable requirements of C.R.S.
31-12-104 and 105, and to determine whether the area should be annexed to the Town of
Severance,and to consider the proposed zoning..
Section 3. The Town Clerk is hereby directed to publish notice of this hearing once
each week for four weeks in The Tribune,the designated newspaper for the Town of Severance.

The undersigned, in accordance with Title 31, Article 12, Chapters 101 et Seq., Colorado
Revised Statutes, hereby petition the Mayor and Trustees of the Town of Severance, Colorado,
for annexation to the Town of Severance the unincorporated territory described herein and

are submitted herewith and by this reference are incorporated 4wrein. The description of the
territory hereby petitioned for annexation into the Town is set forth in Exhibit'A' attached hereto
and incorporated herein by reference.

In support of this petition,the petitioner(s)allege(s)that
1) It is desirable and necessary that the above described territory be annexed to the Town of
Severance,Colorado.
2) The requirements of Section 31-12-104 and 31-12-105 of the Colorado Revised Statutes

annexed is contiguous with the Town of Severance;

Statement of Community Need and Impact
For Annexation & Zoning in the Town of Severance
Submitted by Applicant
Project Description
The property comprising the Hawk's Landing Annexations#1  are located in the
quarter section immediately SE of the intersection of WCR 74 and State Hwy 257. The
area to be annexed includes approximately 20.51 acres, of which 5.19 are road right-of-
way. Due to separate ownership interests for the combined parcels, 2 annexations have
been required.
The existing land use on Annexation#1 is agricultural and on Annexation#2 is
agricultural/rural residential.
In conjunction with the proposed annexation, the land use is to change to Commercial
and the zoning is to be established as Neighborhood Commercial & Community
Commercial.
Project Concept
Applicant's objective for this development is to provide the Town of Severance with a
variety of commercial and office uses in an area that enhances and expands the economic
viability of the Town. The proposed zoning provides for a compatible mix of
commercial uses in a regionally planned environment.
In annexation#1 (the north parcel) a neighborhood commercial center is planned with
concept of 8 retail/commercial pads. In annexation#2 a community commercial use
may be more applicable utilizing 3 larger pads for offices or larger commercial users.
Economic Impact
In addition to adding to the Town's property tax base, the appreciation and structural
buildout shall treble the coffers associated with this land as an agricultural use currently.
In annexation#1 where the pads are designated mainly retail, our projection is for the
average taxable sales revenue associated with each pad to exceed $1 Million annually for
a total taxable sales revenue in excess of$8 Million a year. This area will be visible and
easily accessable from both the Harmony Corridor(WCR 74) and the State Hwy 257.
This site development will serve as a potential employment base for the residents of the
growing town& surrounding developments as well as strengthening the economic base
of the community. This commercial component in the Town of Severance will be a boon
as the regional residential buildout in the 7 mile radius surrounding this site is projected
to approach 10,000 new residents in the next 5-7 years. This site is conveniently located
in the center of the commuter corridor between Greeley, Eaton, Severance, Ault,
Windsor, Timnath&Ft. Collins.
Development Phasing and Schedule
It is our expectation that the development will proceed in two phases, beginning with
Annexation # 1. We will anticipate our final plat in early spring of 2005 and commence
with buildout of onsite infrastructure and bringing projects on site. It is anticipated the
buildout of this site will take place over 5-10 years.
Municipal Services
Municipal Services for the Hawk's Landing Annexation will be provided by the
following agencies:
• Water—NCW&NWC Water
• School—District RE 4
• Fire—Windsor Severance Fire Protection
• Electricity—Xcel
• Telephone—Qwest
• Police—Weld County Sheriff's Dept
• Sewer— see below on Sanitary Sewer
Other districts associated with this annexation include Weld County, West Greeley Soil
Conservation District, Windsor Library& Aims Junior College.
Potable Water is service through a main trunk line just expanded by North Weld Water.
Sanitary Sewer
Sanitary sewer currently does not approach the site. Although, the Town of Windsor has
plans for the extension of main interceptor line to the area. We propose the Town of
Severance provide Hawk's Landing with Sanitary sewer via an IGA with Windsor. Our
development will hook in when the line approaches the state mandated 400 ft from our
site.
In the meantime, we have designs for a commercial septic system for the site. This will
be a very necessary inclusion in our development agreement for the viability of the
project.
Summary
The Hawk's Landing#1 & #2 Annexations will provide the Town of Severance with
many strategic and economic benefits. This annexation provides a western gateway to
the Town off of a major state highway and extremely busy commuter corridor. By
further positioning itself in this area, the Town will realize a significant uplift in tax
revenue and service a larger regional base commercially. As regional infill continues,
Severance will find themselves with a very attractive and commercially viable
development right in the hub of growth. The minimal service cost is far outweighed by
the long term benefit of this commercial development. Therefore, we respectively look
forward to bringing a mutually beneficial project into the Town of Severance via
annexation.
