RE: GRANT REQUEST FROM GARY AND JUDY HARKLESS TO PREADVERTISE SITE
SPECIFIC DEVELOPMENT PLAN AND MINOR SUBDIVISION FINAL PLAN, MF#1060
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS,the Board has received a request from Gary and Judy Harkless, 33439 Weld
County Road 37, Eaton, Colorado 80615, c/o Pickett Engineering, Inc., 808 8th Street, Greeley,
Colorado 80631,for preadvertisement of an application for a Site Specific Development Plan and
Minor Subdivision Final Plan, MF #1060, for nine (9) Estate Zone residential lots, and
WHEREAS,said property is described as Lot B of Recorded Exemption#2641; being part
of the SE1/4 of Section 13, Township 6 North, Range 66 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS,after study and review the Board deems it advisable to grant said request,with
the hearing date to be set as September 14, 2005, at 10:00 a.m.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request from Gary and Judy Harkless for preadvertisement of an
application for a Site Specific Development Plan and Minor Subdivision Final Plan, MF#1060,for
nine (9) Estate Zone residential lots be, and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the hearing date to consider said request
be, and hereby is, set as September 14, 2005, at 10:00 a.m.

Gary and Judy Harkless,Go Pickett Engineering, Inc., have submitted a request that the application

Zoned residential lots,which will be heard by the Planning Commission on September 6,2005, be
pre-advertised. If you wish to approve this request, a hearing before the Board on September 14,
2005, will allow adequate time for advertising.

SUBJECT: Pre-Advertisement request for MF-1060 (Faith Estates Minor
Subdivision)
The applicants representative for Faith Estates Minor Subdivision (MF-1060) has submitted a
pre-advertisement request to allow this hearing to be heard on September 14, 2005.
The applicant wants to begin construction as soon as possible and to begin framing in houses.
It should be noted that the internal access for the subdivision will need to be upgraded to an
acceptable condition (as determined by the Department of Public Works) prior to the release of
any building permits.
The Department of Planning Services has no objections to this request.

RE: Faith Estates Minor Subdivision

Dear Mr. Gathman:
This letter is regarding the Minor Subdivision Final Plat approval process for Faith Estates Subdivision, Weld
County Case# MF-1060. In preparation for the final plat submittal and as required by the Weld County
Planning Department, the applicant has addressed all of the comments received during the Sketch Plan and
Change of Zone referral processes. As a result, we do not anticipate any significant issues or concerns to be
brought up during the final plat referral/approval process that is underway.
With this in mind,the applicant wishes to expedite the final plat approval process and hereby requests a"Pre-
Advertisement" of the Board of County Commissioners' hearing for the final plat approval. The applicant is
suffering financial hardship due to the expense and debt he has accrued while completing the subdivision
process through the County. By expediting the final plat approval process,the applicant will be able to secure a
construction loan and initiate the construction of the improvements to the property. It is critical for the
construction to begin as soon as possible in order begin framing-in some of the proposed homes ahead of the
winter season. This will allow the applicant to begin the sale of lots and homes, alleviating the financial burden
created by developing the property.
The Weld County Planning Commission is currently scheduled to hear this case on September 6, 2005. I have
coordinated with the Clerk to the Board regarding the possibility of completing the requested"Pre-
Advertisement" process. The Clerk to the Board informed me that the next available Board of County
Commissioners' hearing would be September 14. Since the applicant is anticipating the Planning Commission's
recommendation of approval to the Board, we request that the"Pre-Advertisement"process be completed and
this case added to the September 14 Board of County Commissioners' agenda. We have attached the $100
processing fee as required. Please contact me if you have any questions or comments. Thank you.
