RE: APPROVAL OF RECORDED EXEMPTION NO. 457 - VICKI BOOTH MILL
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public meeting held
on the 24th day of September, 1980 in the Chambers of the Board
of County Commissioners of Weld County, Colorado, that the divi-
sion into two parcels of land, as shown on the plat known as
Recorded Exemption No. 457 , being the property of Vicki Booth
Mill, described as part of the Southeast Quarter of Section 36 ,
Township 4 North, Range 68 West of the 6th P.M. , Weld County,
Colorado, being more particularly described as follows does not
come within the purview of the definition of the terms "subdi-
vision" and "subdivided land" , pursuant to its authority under
Section 30-28-101 (10) (d) , CRS 1973, as amended:
Part of the Southeast Quarter of Section 36,
Township 4 North, Range 68 West of the 6th
P.M. , Weld County, Colorado being more parti-
cularly described as follows :
Beginning at the Southeast corner of said
Section 36 and considering the South line
of said Southeast Quarter of Section 36 as
bearing North 90°00 ' 00" West, with all
other bearings contained herein relative
thereto;
Thence North 90°00 ' 00" West, along said South
line, 2654 . 51 feet to the South Quarter Corner
of said Section 36;

or reserved by instruments of record or as now
existing on said described parcel of land.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Vicki Booth Mill be, and hereby is , exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 24th day of
September, A.D. , 1980 .

Re: Recorded Exemption #457
Dear Commissioners:
The attached application, plat, and related items are in reference to a
request from Vicki Booth Mill for a recorded exemption. The parcel of
land on which this request has been made is described as part of the SE',
Section 36, T4N, R68W of the 6th P.M. , Weld County, Colorado. This pro-
perty is located 3 miles east and 2 miles north of Mead. The property
contains approximately 77.657 acres of Class II, III and IV irrigated
soils and Class II, IV and VI nonirriaged soils. The request is to split
the property into parcels of 28.195 acres and 49.462 acres.
On September 17, 1980 the Board of County Commissioners approved a request
from Vicki Booth Mill for a Lot Size Variance so that she could make ap-
plication for this Recorded Exemption. At the time the decision was made
on that request, the Department of Planning Services staff submitted a
letter of recommendation to the Board. A copy of that letter of recom-
mendation is included in the attached packet. Nothing has been received
by our office that would change our recommendation of approval for this
request as outlinedin the letter dated September 17, 1980 to the Board.
This request complies with the provisions of Section 9-4 (A) of the Weld
County Subdivision Regulations.

Dear Commissioners :
The attached letter and related materials are in reference to a request for a
lot size variance from Vicki Booth Mill . The property on which this request
has been made is described as Pt. SE14 Section 36, T4N, R68W of the 6th p.m. ,
Weld County, Colorado. This property is located 3 milts east and 2 miles
north of Mead.
The property under consideration contains approximately 77.657 acres of class
II , III and IV irrigated soils and class III , IV and VI non-irrigated soils.
The request is to obtain a variance from the minimum lot size requirement,
Section 9-4. A. (6) of the Weld County Subdivision Regulations , so that she
may make application for a recorded exemption.
As indicated in a letter dated July 25, 1980, it is the applicant' s desire to
sell the 28. 195 acre parcel which consists of the improvement site plus seep
and slough land which is not suitable for farming. The balance of the property
will continue to be farmed for the purpose of raising feed for a family cattle
feeding operation in the area.
Based upon the information submitted and the adopted policies in the County,
the Department of Planning Services Staff recommends the request be approved
in that the request is consistant with the Intent Clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) ,
the Intent Clause of the Agricultural Zone District (Section 3.3 A. of the
Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since

the uses will be cor atible with the surrounding agricultural uses . The request
will allow agricultural and related uses to be the predominant land uses . There
will be no reduction in the arount of land currently being used for agricultural
production.

The Little Thompson Water District presently is serving a domestic
water tap (our tap no. 386) on property owned by Vicki Booth Mill located
in the Southeast Quarter of Section 36, T4N, R68 West, Weld County, Colorado.
The water district will be able to provide an additional tap to this
property on Weld County road 38 upon receipt of the proper fees and compliance
with the rules and regulations of the District.

A '• To Whom it May Concern :
Pursuant to the enclosed request for Recorded Exemption
on my Weld County Farm as per the plat and application
attached hereto, I wish to set forth the following
reasons for said request .
This farm was purchased in January, 1980 for the pur-
pose of raising feed for a family cattle feeding opera-
tion in the area. The land is presently being farmed on
a crop share basis by a tenant farmer who owns a farm in
the area which includes his own personal headquarters
and, therefore , I have no need for the improvements .
Lot "A" of the Recorded Exemption consists of the im-
provement site plus seep and slough land which is not
suitable for farming . This seepy condition exists due
1 to seep from the Little Gem Reservoir which lies to the
. northwest of Lot "A" . This land lies in a draw and his-
torically has never been farmed and would not be suitable
for a change of use .
Since I have no use for the improvement site and the land
incli}ded with it is not suitable for farming, it is my
intention to place this unit on the market and retain
the good farmable land for feed raising purposes.
I respectfully request approval by the Planning Commis-
sion and the Board of County Commissioners of Weld County
of the enclosed Application for Recorded Exemption.
