THE DEPARTMENT OF PLANNING SERVICES'STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. The submitted materials are in compliance with the application requirements of Section 23-2-260 of the
Weld County Code.
2. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 23-2-220 of the Weld County Code as follows:
A. Section 23-2-220.A.1 --The proposed use is consistent with Chapter 22 and any other applicable
code provisions or ordinance in effect.
Section 22-2-60 A.1 (A.Policy 1.1.)states"Agricultural zoning will be established and maintained
and promote the County's agricultural industry. Agricultural zoning is intended to provide areas
for agricultural activities and other uses interdependent upon agriculture.
Section 22-2-60 A.3 (A.Policy 1.3.) states "Allow commercial and industrial uses, which are
directly related to,or dependent upon agriculture,to locate within the A(Agricultural)Zone District
when the impact to surrounding properties is minimal, and where adequate services and
infrastructure are currently available or reasonably obtainable."

B. Section 23-2-220.A.2--The proposed use is consistent with the intent of the A(Agricultural)Zone
District. Section 23-3-40.F of the Weld County Code provides for airstrips and airports as a Use
by Special Review in the A(Agricultural)Zone District. Section 23-3-40.B.3 of the Weld County
Code provides for agricultural service establishments including crop dusting or spraying
operations facilities as a Use by Special Review in the A (Agricultural) Zone District.
C. Section 23-2-220.A.3 -- The uses which will be permitted will be compatible with the existing
surrounding land uses.Surrounding properties are agricultural in nature with few homes in close
proximity.None of these homes is in direct line with the proposed airstrip.Conditions of Approval
and Development Standards should mitigate the impact to surrounding property owners.
D. Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future
development of the surrounding area as permitted by the existing zoning and with the future
development as projected by Chapter 22 of the Weld County Code and any other applicable code
provisions or ordinances in effect,or the adopted Master Plans of affected municipalities.The site
is within the three mile referral area for the Town of Platteville. The Town did not respond to the
referral request.
E. Section 23-2-220.A.5 --The site does not lie within any Overlay Districts.
Effective January 1,2003, Building Permits issued on the lot will be required to adhere to the fee
structure of the County Road Impact Program. (Ordinance 2002-11)
F. Section 23-2-220.A.6 -- The applicant has demonstrated a diligent effort to conserve prime
agricultural land in the locational decision for the proposed use. The majority of the site is
designated as "Other" by the U.S.D.A Soil Conservation Service with a very small portion of
"Prime".
G. Section 23-2-220.A.7--The Design Standards(Section 23-2-240,Weld County Code),Operation
Standards (Section 23-2-250, Weld County Code), Conditions of Approval and Development
Standards ensure that there are adequate provisions for the protection of health, safety, and
welfare of the inhabitants of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials submitted by the applicant,
other relevant information regarding the request, and responses from referral entities.
The Department of Planning Services' staff recommendation for approval is conditional upon the following:
1. Prior to the Board of County Commissioners hearing:
A. The applicant has not delineated any on-site sign(s). If applicable, and an on-site sign(s) is
desired,the applicant shall submit a sign plan to the Department of Planning Services. If no sign
plan is submitted the site shall adhere to Section 23-4-90.A and .B of the Weld County Code
which states one identification sign per principal use shall be allowed,provided that the sign does
not exceed sixteen (16) square feet in area per face. (Department of Planning Services)
B. The applicant shall submit to the Weld County Department of Planning Services a signed copy
of an agreement with the properties mineral owners which stipulates that oil and gas activities
have been adequately incorporated into the design of the site and that mineral owners concerns
have been mitigated or the applicant shall submit evidence that the mineral owners concerns

2. Prior to recording the plat:
A. The sheets of the plat shall be labeled USR-1504. (Department of Planning Services)
B. The applicant shall submit evidence to the Department of Planning Services indicating that Form
7480-1 "Notice of Landing Area Proposal" has been submitted to the Federal Aviation
Administration for review. Evidence of approval shall be submitted to the Department of Planning

C. The applicant shall submit a lighting plan to the Department of Planning Services for review and
approval. The plan shall be in accordance with section 23-2-250.D of the Weld County Code.

D. The applicant shall submit evidence that a commercial well permit has been received from the
Colorado Division of Water Resources for the proposed use. (Department of Planning Services)
E. In a referral dated March 20, 2005 the Platteville Irrigating and Milling Company indicated
concerns with a possible chemical spill into the Platteville Ditch.Written documentation indicating
how this concern is being addressed shall be submitted to the Department of Planning Services.

F. The applicant shall submit written evidence from the Weld County Department of Public Health
and Environment to the Department of Planning Services that the following requirements have
been met:
1) The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services,Weld County Department of Public Health&Environment.

2) The applicant shall provide written evidence to the Weld County Department of Public
Health and Environment that the applicant has contacted and/or submitted an application
to the Colorado Department of Agriculture (CDA), Division of Plant Industry. This
contact/evidence shall determine if a license under the Pesticide Applicators' Act as
defined under C.R.S.35-10-101 through 35-10-128. is required. Alternately,the applicant
can provide evidence from CDA, Division of Plant Industry that they are not subject to
these requirements. (Department of Public Health & Environment)
3) The applicant shall submit evidence of an Aboveground Storage Tank permit from the
Colorado Department of Labor and Employment(CDL&E), Oil Inspection Section for any
aboveground storage tanks located on the site. Alternately, the applicant can provide
evidence from the (CDL&E), Oil Inspection Section that they are not subject to these

4) The applicant shall submit a waste handling plan,for approval,to the Environmental Health
Services Division of the Weld County Department of Public Health & Environment. The
plan shall include at a minimum, the following:
a. A list of wastes which are expected to be generated on site (this should include
expected volumes and types of waste generated).
b. A list of the type and volume of chemicals expected to be stored on site.
c. The waste handler and facility where the waste will be disposed(including the facility

G. The plat shall be amended to delineate the following:
1) The attached Development Standards. (Department of Planning Services)
2) All public rights-of-way with dimensions. (Department of Public Works)
3) The approved Lighting Plan. (Department of Planning Services)
H. The applicant shall submit two(2) paper copies of the plat for preliminary approval to the Weld
County Department of Planning Services. (Department of Planning Services)
3. Upon completion of 1. and 2. above the applicant shall submit a Mylar plat along with all other
documentation required as Conditions of Approval.The Mylar plat shall be recorded in the office of the
Weld County Clerk and Recorder by Department of Planning Services'Staff. The plat shall be prepared
in accordance with the requirements of Section 23-2-260.D of the Weld County Code. The Mylar plat
and additional requirements shall be submitted within thirty (30) days from the date of the Board of
County Commissioners resolution. The applicant shall be responsible for paying the recording fee.

4. The Department of Planning Services respectively requests the surveyor provide a digital copy of this
Use by Special Review. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif(Group 4). (Group 6 is not acceptable). This digital file may be

5. Prior to construction:
A. The applicant shall inform the Platteville/Gilcrest Fire Protection District of the construction of the
fuel tanks, aboveground or underground. (Platteville/Gilcrest Fire Protection District)
6. Prior to issuance of building permits:
A. A stormwater discharge permit may be required for a development/redevelopment/construction
site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre
in area. The applicant shall contact the Water Quality Control Division of the Colorado
Department of Public Health and Environment at www.cdphe.state.co.us/ wq/PermitsUnit for

7. Prior to issuance of the Certificate of Occupancy:
A. An individual sewage disposal system is required for the proposed office/apartment and shall be
installed according to the Weld County Individual Sewage Disposal Regulations. (Department

B. The septic system is required to be designed by a Colorado Registered Professional Engineer
according to the Weld County Individual Sewage Disposal Regulations. (Department of Public

8. Prior to operation:
A. No smoking signs shall be posted in conspicuous locations and be unobstructed at all times.

B. Two fire extinguishers with a minimum rating of 2A:10B:C shall be in the hanger. They shall be
secured to the wall and located so that no point within the hanger is more than 75 feet away from

C. Parking spaces including access drive shall be surfaced with gravel, asphalt, concrete, or the
equivalent and shall be graded to prevent drainage problems. (Department of Public Works)
9. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the
property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and

1. The Site Specific Development Plan and Special Use Permit is for Agricultural Service Establishment.
More specifically a crop dusting and spraying operation facility including hangar, landing strip,fertilizer
storage facilities, insecticide storage facilities, fuel storage facilities and offices accessory to the crop
dusting or spraying operation in the A (Agricultural) Zone District, as indicated in the application
materials on file and subject to the Development Standards stated hereon. (Department of Planning

2. Approval of this plan may create a vested property right pursuant to Section 23-8-10 of the Weld County
Code. (Department of Planning Services)
3. No smoking signs shall be posted in conspicious locations and be unobstructed at all times.

7. Aircraft stored on site shall be limited to six (6) private and five (5) crop dusting. (Department of

8. Parking spaces including access drive shall be surfaced with gravel,asphalt,concrete,or the equivalent
and shall be graded to prevent drainage problems. (Department of Public Works)
9. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will
reasonably preserve the natural character of the area and prevent property damage of the type
generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off. (Department of Public Works)
10. All liquid and solid wastes(as defined in the Solid Wastes Disposal Sites and Facilities Act,30 20 100.5,
C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against
surface and groundwater contamination. (Department of Public Health and Environment)
11. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those
wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30 20 100.5, C.R.S., as amended. (Department of Public Health and Environment)
12. Waste materials shall be handled, stored,and disposed in a manner that controls fugitive dust,fugitive
particulate emissions, blowing debris, and other potential nuisance conditions. (Department of Public

13. The applicant shall operate in accordance with the approved "waste handling plan". (Department of

14. The applicant shall comply with all provision of the Pesticide Applicators' Act issued by the Colorado
Department of Agriculture, Division of Plant Industry. (Department of Public Health and Environment)
15. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank
Regulations (7 CCR 1101-14). (Department of Public Health and Environment)
16. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be
operated in accordance with the approved dust abatement plan at all times. (Department of Public

17. This facility shall adhere to the maximum permissible noise levels allowed in the Comercial Zone as
delineated in 25 12 103 C.R.S., as amended. (Department of Public Health and Environment)
18. Adequate handwashing and toilet facilities shall be provided for employees and patrons of the facility.

19. Any septic system located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems. (Department of Public Health and Environment)
20. A permanent,adequate water supply shall be provided for drinking and sanitary purposes.(Department

21. All pesticides,fertilizer,and other potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimizes the release of hazardous
air pollutants (HAP's) and volatile organic compounds (VOC's). (Department of Public Health and

22. If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department
of Public Health & Environment, Water Quality Control Division. (Department of Public Health and

23. Planes which are in the process of a spraying application shall be allowed to operate from the site
between the hours of 4:30 a.m.to 8:00 p.m.seven days a week.All other aircraft shall be limited to the
hours of 8:00 a.m. to 5:00 p.m. (Department of Planning Services)
24. The operation shall comply with all applicable rules and regulations of the Federal Aviation
Administration. (Department of Public Health and Environment)
25. The operation shall comply with all applicable rules and regulations of the State and Federal agencies

26. Effective January 1, 2003, Building Permits issued on the lot will be required to adhere to the fee

27. The property owner shall allow any mineral owner the right of ingress or egress for the purposes of
exploration development, completion, recompletion, re-entry, production and maintenance operations

29. A plan review is required for each building for which a building permit is required. Plans shall include
a floor plan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two
complete sets of plans are required when applying for each permit.Provide a Code Analysis Data sheet
provided by the Weld County Building Department with each Building permit application. Provide plans
to Platteville Fire Protection District for their review and approval. (Department of Building Inspection)
30. Buildings shall conform to the requirements of the various codes adopted at the time of permit
application. Currently the following has been adopted by Weld County: 2003 International Building
Code;2003 International Mechanical Code;2003 International Plumbing Code;2003 International Fuel
Gas Code; and the 2002 National Electrical Code and Chapter 29 of the Weld County Code.

31. The main building will probably be classified a mixed use,S-1 (Hanger),B(Office)and R-3(Apartment).
The chemical storage building will probably be classified as H-3(Hazardous)unless the amount of the
maximum allowable quantity of hazardous materials does not exceed the amounts in Table 307.7(1)
of the 2003 International Building Code. The main building shall be accessible to persons with
disabilities. Fire resistance of walls and openings,construction requirements,maximum building height
and allowable areas will be reviewed at the plan review. Setback and offset distances shall be
determined by Chapter 23 of the Weld County Code. (Department of Building Inspection)
32. Building height shall be measured in accordance with the 2003 International Building Code for the
purpose of determining the maximum building size and height for various uses and types of construction
and to determine compliance with the Bulk Requirements from Chapter 23 of the Weld County Code.
Building height shall be measured in accordance with Chapter 23 of the Weld County Code in order to
determine compliance with offset and setback requirements. Offset and setback requirements are
measured to the farthest projection from the building. (Department of Building Inspection)
33. The property owner or operator shall be responsible for complying with the Design Standards of Section
23-2-240, Weld County Code.
34. The property owner or operator shall be responsible for complying with the Operation Standards of
Section 23-2-250, Weld County Code.
35. Weld County Personnel shall be granted access onto the property at any reasonable time in order to
ensure the activities carried out on the property comply with the Development Standards stated herein
and all applicable Weld County regulations.
36. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing
standards and all applicable Weld County regulations. Substantial changes from the plans or
Development Standards as shown or stated shall require the approval of an amendment of the Permit
by the Weld County Board of County Commissioners before such changes from the plans or
Development Standards are permitted. Any other changes shall be filed in the office of the Department
of Planning Services.
37. The property owner or operator shall be responsible for complying with all of the foregoing Development
Standards. Noncompliance with any of the foregoing Development Standards may be reason for
revocation of the Permit by the Board of County Commissioners.

will not allow the construction of the office at this time.
Is there a problem with just building the residence and hanger? What needs to be done to

Airspace Case No. 2005-ANM-493-NRA
An airspace analysis of the proposed private use Tonga Airport, Platteville, Colorado, has been
completed. Based on this study,the Federal Aviation Administration(FAA) has no objection. This
landing area underlies the Class B airspace and is within the Mode C ring for Denver International
Airport; operations shall be in accordance with the requirements and restrictions of the overlying class of
airspace.
F We recommend a clear 20:1 approach slope for each runway end be established and maintained. Please
check the performance capabilities of the aircraft you intend to operate at your airport to ensure you have
adequate runway length. All users of the airport should be briefed on operating conditions at the airport.
This determination does not mean FAA approval or disapproval of the physical development involved in
the proposal. It is a determination with respect to the safe and efficient use of airspace by aircraft and
with respect to the safety of persons and property on the ground. This determination does not relieve the
proponent of responsibility for compliance with any local law,ordinance or regulations, or state or other
Federal regulations.
In making this determination, the FAA has considered matters such as the effect the proposal would have
on the existing or planned traffic patterns of neighboring airports,the effects it would have on the
existing airspace structure and projected program of the FAA, the effects it would have on the safety or
persons and property on the ground, and the effects that existing or proposed man-made objects (on file
with the FAA) and known natural objects within the affected area would have on the proposal.
The FAA cannot prevent the construction of structures near an airport. The airport environs can only be
protected through such means as local zoning ordinances or acquisition of property rights. It is up to you,
as the owner, to provide for this protection.
No evaluation of the environmental aspects of the proposal was made in reaching this determination.
Therefore, this determination is not to be construed as approval of the proposal from an environmental
standpoint under Public Law 91-190 (National Environmental Policy Act of 1969).

In order to avoid placing any unfair restrictions on users of the navigable airspace, if your airport does
not become operational within 12 months of the date of this letter, this determination will expire unless
you request a time extension.
When the airport becomes operational, please complete and return the enclosed FAA Form 5010-5,
Airport Master Record. The Airport Master Record notifies the FAA that your facility has been activated.
If the form has not been returned or an extension has not been requested,your facility may be
considered unactivated and your airspace determination void.
If in the future you wish to open the airport to public use, a new airspace determination will be required.
In addition, if the facility changes names, changes ownership, if there is a change in the owner's address
or other substantial changes, please notify the FAA,NFDC on Form 5010-5. The FAA might solicit
information updates on your airport, and if the solicitation is not responded to,your airport could be
considered an inactive facility.

Edmiston
Mr. Edmiston has recently gone through the Use by Special Review process with Weld County
in order to build an aerial spraying operation south of Platteville. One of the conditions
of approval placed on Mr. Edmiston was that he get approval from the FAA for the Notice of
Landing Proposal. Mr.
Edmiston is asking for an early release of building permits so that he may construct the
facility. Could you please let us know the status of the Notice and if there would be any
risks in granting the early release of building permits?

How about this, Ray turns in his building permit for review and before it is released you
and Monica can decide if you want to release it or have the BCC do it. The building
permit may not be ready to submit for a little bit so I don't want to go to the BCC yet.
That will buy some more time for the FAA approval. I still disagree with you and I think
the building with the apartment is no different then a storage building with an apartment.
If the airstip was denied by the FAA, Ray could still have a building with an apartment in
it, which is a use-by-right in the A zone. Anyway thats my 2 cents worth.
Luckily I didnt break anything when I got bucked off, although I did have to go to the
emergency room. We were on a trail ride with the horse club and I had to get trucked out.
I didnt want a helicopter and I couldnt raise my leg high enough to get back on the horse.
Greg had to carry me on his back up a hill to where a truck could get in. Thought I might
have broken pelvis or hip. They were also worried about a bruised kidney. Thank goodness
I had a helmet on as that protected my head. I landed on the place between my tailbone
and my spine which i guess is some sort of joint. It didnt break but I am swollen but
weirdly enough not bruised. I take ibuprofen every few hours and vicoden at night. Oh
and I walk like a little old lady. Just a freak accident
are you going to the APA conference next week in fort collins? If so, we need to meet up
for lunch

I can't say that I agree that the building would be a use by right. Only the residential

The proposal is presently being circulated for comments from other FAA offices (Air
Traffic Divison, Flight Standards District Office, Airways

There is always a possibility, however small that might be, that a proposed airstrip can
cause a conflict with a nearby public use airport, or might have safety problems. These
