Buildings that meet the definition of an Ag Exempt Building per the requirements of Section 29-1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building permits, however,a Certificate of Compliance must be filed with the Planning Department and an electrical and/or plumbing permit is required for any electrical service to the building or water for watering or washing of livestock or poultry. 9) Effective January 1,2003, Building Permits issued on the proposed lots will be required to adhere to the fee structure of the County Road Impact Program.(Ordinance 2002-11) 10) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States,ranking fifth in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with longstanding agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural area:open views,spaciousness,wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long-established agricultural practices to accommodate the intrusions of urban users into a rural area. Well run agricultural activities will generate off-site impacts,including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest, and gravel roads; odor from animal confinement, silage, and manure; smoke from ditch burning;flies and mosquitoes;and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. Ditches and reservoirs cannot simply be moved out of the way of residential development without threatening the efficient delivery of irrigation to fields which is essential to farm production. Page 3 Section 35-3.5-102, C. R. S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Weld County covers a land area of over 4,000 square miles in size (twice the State of Delaware) with more than 3,700 miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the county and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed,will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Snow removal from roads within subdivisions are of the lowest priority for public works or may be the private responsibility of the homeowners. Services in rural areas, in many cases,will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. Children are exposed to different hazards in the county than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs, and livestock present real threats to children. Controlling children's activities is important,not only for their safety, but also for the protection of the farmer's livelihood. Parents are responsible for their children. 2. The applicant shall submit two(2)paper copies of the plat for preliminary approval to the Weld County Department of Planning Services.Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services' Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. The Mylar plat and additional requirements shall be submitted within sixty(60)days from the date the Administrative Review was signed. The applicant shall be responsible for paying the recording fee. 3. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this Recorded Exemption. First, the Lake Ditch mentioned does not enter this land. It is located across the northeast corner of the Garcia Estates development. Also,there is not a small=mall wetland near the south end of the property, as we feel the accompanying photos show. When water is taken from the Home Supply Ditch to serve the properties to the north of the highway, it does flow in an open ditch to the mouth of a pipe, but that intermittent flow does not constitute a wetland. Second, the ditch shown along the east edge of the proposal has been abandoned for irrigation purposes, and now only serves to receive natural drainage from the site, as it has for over 100 years. We have relocated the entry road so as to not disturb the habitat or trees. Further,we believe that placement of curbs, gutters and sidewalks will prevent the natural drainage from reaching that area, thus rendering it untenable. We propose to seek a variance from that requirement on those grounds, as well as their extreme incompatibility with the general area. On the Schrage proposal, we have also increased the front yard setback,to enhance the increased buffer requested. In our opinion, the remaining concerns expressed can best be enumerated in the covenants which will be filed with the final plat. In that document, lot owners would be made aware of their responsibilities with regard to noxious weeds, native predators, fencing and other concerns such as hunting over adjacent lands. The parcel is currently agricultural land and generally cannot be considered as critical habitat for any wildlife species. The Lake Ditch,although a man-made waterway, provides a riparian corridor with associated riparian species near the south end of the property and a small wetland appears to be located near the south end of the property as well. This corridor and related vegetation should be maintained to provide habitat for wildlife. An irrigation ditch also runs along the east side of the proposed development. All willows, cottonwoods,and other native riparian habitat should be left undisturbed as well as the dead wood and trees in this area. For the Francisco Garcia Estate Lots on the east side of this irrigation ditch,a 75 foot buffer was established on the ditch for Open Space. Clustering of houses and development on the west side of the Schrage Property would provide a more substantial buffer for this riparian area. Increasing the buffer to 100 feet would provide additional buffer. According to the Colorado Division of Wildlife Natural Diversity Information Source Map for Weld County,the area provides winter range for bald eagles, foraging areas for ducks and geese,and is within the overall range for pheasant and mule deer and white-tailed deer. Coyote, fox, raccoon, skunk, songbirds,other raptors and herptofauna may also occur in this area. Upon disturbance of any areas,noxious weeds should be monitored and controlled. Homeowners should also be aware that planting trees, shrubs and other herbaceous plants may attract wildlife. Subsequently,ornamental landscaping may be damaged by wildlife. Homeowners will need to be responsible for damages incurred and will not be eligible for any reimbursement by the Colorado Division of Wildlife. Homeowners should be made aware of the presence of native predators. Pets should not be allowed to roam free. All domesticated livestock and farm animals should be secured with wildlife proof fencing appropriate for the species being raised. Pets as well may negatively interact with wildlife even on the home-sites and homeowners will be responsible for handling these problems. However, the P.U.D. submittal includes a Sketch Plan phase, which is not paralleled by the Exemption process. Therefore, we are submitting an Exemption Sketch with the P.U.D. Sketch Plan, in order to identify the means by which the P.U.D. parcel is to be created, and keep the two submittals on the same time line. Accordingly,this questionnaire, while factual, does not include all the documentary evidence that will be submitted after the Sketch Plan review of the P.U.D. 1. Water Supply Statement: a. The Portion north of the Home Supply Ditch comprising the P.U.D. already includes the original farm home, which has an active tap from the Little Thompson Water District. ARTICLE 1 .00 - NAME OF TRUST This Trust may be known as the SCHRAGE LIVING TRUST. Settlors and any other person may make additions to the Trust with the consent of the Co-Trustees. ARTICLE 3.00 - STATEMENT AS TO FAMILY The Settlors, THEODORE H. SCHRAGE and RUTH M. SCHRAGE of Loveland, Colorado, are husband and wife. THEODORE H. SCHRAGE has three stepsons who are the natural sons of RUTH M. SCHRAGE; namely, ROBERT GENE LEWIS of Littleton, Colorado, who is married and has four children; DAVID LEROY LEWIS of Hot Springs, South Dakota, who is married and has three children; and BRYAN BERNIE LEWIS of Aurora, Colorado, who is married and has two children. Any references in this Agreement to Settlors' children are to such named three children. ARTICLE 4.00 - RIGHT RESERVED BY SETTLORS Settlors reserve the right to amend or revoke the trust under this Agree- ment in whole or in part, at any time or times, except as otherwise set forth herein, by writing delivered to the Trustee during the Settlors ' lives. No amendment with respect to the Trustee' s compensation or Trustee' s continuing duties or liabilities shall be effective without the Trustee' s written consent. ARTICLE 5.00 - PROVISION FOR SUCCESSOR TRUSTEE Upon the deaths of the Settlors or first named Trustees, THEODORE H. SCHRAGE and RUTH M. SCHRAGE, BRYAN BERNIE LEWIS shall succeed as Successor Trustee under this Trust Agreement. Said Successor Trustee shall also assume responsibility as Successor Trustee under this Agreement at such time as he, in his sole and absolute judgment, determines that both THEODORE H. SCHRAGE and RUTH M. SCHRAGE are so incapacitated by reason of illness, age or other cause, that they are incapable of managing and expending property and funds for their own use and benefit or are unavailable to give prompt attention to their financial affairs. The Successor Trustee shall not be required to make such determination until he has received effective written medical notice of Settlor' s incapacity. ARTICLE 6.00 - DISPOSITION DURING SETTLOR'S LIVES During Settlors' lives, the Successor Trustee shall pay or apply the net income and principal of the trust estate as Settlors may direct from time to time, but until otherwise directed, the Successor Trustee shall pay the net income to Settlors on a monthly basis. If in the Successor Trustee' s sole and absolute judgment Settlors are both so incapacitated by reason of illness, age or other cause that they are incapable of expending funds for their own use and benefit or are unavailable to give prompt attention to their financial affairs, the Successor Trustee may use so much of the net income and principal of the trust estate as the Successor Trustee in his sole and absolute discretion deems necessary or advisable (i ) for the support, maintenance, health, comfort and welfare of Settlors and any persons who, in the judgment of the Successor Trustee, are dependent upon Settlors, and (ii ) for the purposes of discharging any obligation incurred by Settlors, believed by the Successor Trustee to be a valid debt. Any income not so used shall be accumulated and added to principal from time to time. The provisions of the foregoing to the contrary notwithstanding, the Succ- essor Trustee, is directed to seek Federal , State or local public assistance for the Settlors when Settlors' assets reach an amount which will allow Settlors to qualify for such assistance. The Successor Trustee is further authorized to preserve Settlors ' assets to the extent that the same is allowed by governmental agencies providing financial assistance for the Settlors. ARTICLE 7.00 - DEBTS AND DEATH TAXES ON SETTLORS DEATH On the death of both of the Settlors, to the extent the trust estate holds United States treasury bonds eligible for redemption at par in payment of the federal estate tax, Successor Trustee shall pay the federal estate tax due by reason of Settlors death, submitting such bonds for redemption, to the extent necessary, in payment of such tax. In addition, the Successor Trustee shall pay directly or Settlors' Personal Representative all expenses of administration, the expenses of Settlors last illness and funeral , Settlors' debts, and any death taxes payable by reason of Settlors death, as Settlors' Personal Representative shall direct, or if there is no Personal Representative of Settlors' estate, as the Successor Trustee determines, all without contribution from any person and without apportionment. -2- ARTICLE 8.00 - DISPOSITION OF TRUST ESTATE UPON THE DEATH OF BOTH SETTLORS Upon the deaths of both of the Settlors and after satisfying the payments required to be made by Successor Trustee under ARTICLE 7.00, the Successor Trustee shall distribute the principal and all accumulated and accrued but undistributed income of this trust estate as follows: Such amount shall be distributed to the Settlors' three children, namely, ROBERT GENE LEWIS, DAVID LEROY LEWIS and BRYAN BERNIE LEWIS as follows: The trust estate remaining for distribution shall be grossed up by the amount of $42,000, said amount having been previously advanced to DAVID LEROY LEWIS in 1977. The total grossed up estate shall then be divided by three and ROBERT GENE LEWIS and BRYAN BERNIE LEWIS shall receive one-third (1 /3) each of the total grossed up estate. DAVID LEROY LEWIS shall receive one-third (1 /3) of the total grossed up estate minus the $42,000 advancement previously made to him. For example, using this manner of distribution, if the trust estate remaining for distribution is $84,000.00, ROBERT GENE LEWIS and BRYAN BERNIE LEWIS would be dis- tributed $42,000.00 each and DAVID LEROY LEWIS would receive nothing because of the previous advancement to him of $42,000.00. In the event the trust estate is less than $84,000.00 it shall be distributed equally to ROBERT GENE LEWIS and BRYAN BERNIE LEWIS; and DAVID LEROY LEWIS shall receive nothing and shall not be required to refund or reimburse the trust estate for all or part of his previous advancement. In no event shall DAVID LEROY LEWIS owe money to the trust estate solely because of his previous advancement. In the event any of the Settlor's said children are deceased, then their respective share shall go to their issue by representation. If there are no such surviving issue, then such share shall go to Settlors' issue by representation. If any beneficiary to whom the Successor Trustee is directed to distribute any share of the trust estate is under the age of twenty-one (21 ) years or is, in the opinion of the Successor Trustee under any disability which renders such beneficiary unable to administer distributions properly when the distribution is to be made, the Successor Trustee may, in his discretion, continue to hold such beneficiary' s share as a separate trust until he or she reaches the age of twenty-one (21 ) years or overcomes the disability, when the Successor Trustee shall distribute such beneficiary' s trust to him or her. If such beneficiary dies before that time, the Successor Trustee shall , upon the beneficiary' s -3- death, distribute the beneficiary' s share to the remaining beneficiaries under this Trust Agreement by representation. While any trust is being held under this Article, the Successor Trustee may pay to, or apply for the benefit of, the beneficiary for whom the trust is held such amounts of the net income or principal , or both, as the Successor Trustee may determine to be necessary or advisable for such beneficiary' s support, maintenance, health, education, comfort and welfare, after taking into consideration all other resources known to the Successor Trustee to be advailable for such purposes. Any undistributed income may be added to principal from time to time in the discretion of the Successor Trustee. At any time the Successor Trustee, in his sole and absolute discretion, may distribute a trust in full if the Successor Trustee considers that the expenses of administration in continuing the Trust are greater than the Trust assets warrant. ARTICLE 9.00 - TRUST ADMINISTRATION AND PROTECTIVE PROVISIONS 9.01 - JURISDICTION: Settlors direct that any trusts be administered expeditiously consistent with their terms, free of judicial intervention and without order, approval or other action of any Court. 9.02 - INALIENABILITY: No beneficiary other than Settlors shall have any right to anticipate, sell , assign, mortgage, pledge or otherwise dispose of or encumber all or any part of the trust nor shall any part of the trust including income, be liable for the debts or obligations, including alimony or maintenance of any bene- ficiary other than the Settlors or be subject to attachment, garnishment, execution, creditor' s bill or other legal or equitable process. 9.03 - APPLICABLE LAW: The validity of this trust shall be determined by the laws of Colorado. Questions of construction and administration of this trust shall be determined by the laws of the situs of administration. ARTICLE 10.00 - POWERS OF TRUSTEE 10.01 - GRANT: In administering any trust under this Agreement, Trustees may exercise the following powers: hold, retain, invest, reinvest and manage without diversification as to kind, amount or risk of nonproductivity in realty or person- alty and without limitation by statute or rule of law; partition, sell , exchange, grant, convey, deliver, assign, transfer, lease, option, mortgage, pledge, abandon, borrow, loan, contract, distribute in cash or kind or partly in each at fair market value on the date of distribution of specific assets without requiring pro rata allocation of the tax bases of such assets; hold in nominee form, continue businesses, carry out agreements, deal with itself, other fiduci- aries and business organizations in which Trustees may have an interest; -4- • • establish reserves, release powers and abandon, settle or contest claims. In exercising discretion regarding distribution of assets with different income tax bases, Trustees shall exercise such discretion in a manner which will not result in disallowance of any deduction otherwise allowable in determining the federal estate tax due in Settlors' estates and in the exercise of such discretion Trustees shall be under no duty to make any compensatory adjustments as a consequence of any such distribution. 10.02 - FIDUCIARIES' POWERS ACT: If the situs of administration of the trust is in Colorado, Trustees may also exercise all the powers in the Colorado Fiduciaries' Powers Act as amended after the execution of this Agreement and after Settlor' s deaths. If the situs of administration of the trust is outside Colorado, Trustees may also exercise all the powers in the Colorado Fiduciaries' Powers Act, which Settlors incorporate in this Agreement as the Act exists on the date of this Agreement. 10.03 - DISTRIBUTIONS: Trustees may make any payments under any trust (1 ) directly to the beneficiary, (2) in any form allowed by law for gifts to minors, (3) to the beneficiary' s guardian or conservator, (4) to any person deemed suitable by Trustees or (5) by direct payment of the beneficiary' s expenses. ARTICLE 11 .00 - TRUSTEE SUCCESSION AND ADMINISTRATIVE PROVISIONS 11 .01 - RESIGNATION: Any Trustee may resign by giving thirty days' written notice to Settlors or other beneficiaries effective at the end of thirty days. 11 .02 - VACANCY: If any Trustee shall cease to act for any reason, the benefic- iaries shall within thirty days, appoint by a writing, a successor Trustee. 11 .03 - REPRESENTATIVE OF BENEFICIARY: The conservator of a beneficiary under legal disability, or if none, the guardian of such person, or if none, the person having the right of custody of a minor beneficiary, may act for such beneficiary for all purposes under the administrative provisions of this Agreement. 11 .04 - COMPENSATION: Any Successor Trustee under this Agreement shall be entitled to reasonable compensation commensurate with the services actually performed and to reimbursement for expenses properly incurred. 11 .05 - RIGHTS OF SUCCESSORS: Every Successor Trustee shall have all the title, rights, powers, privileges and duties conferred or imposed upon the original Trustees, without any act of conveyance or transfer. No Trustee need examine the accounts, records and acts of any previous fiduciary or any allocation of the trust estate or be responsible for any act or omission to act on the part of any previous fiduciary. -5- • • 11 . 06 - REPORTS : Periodic reports shall be rendered by Succesor Trustee to Settlors , during their lifetime , or if they are incapaci - tated to the other beneficiaries , showing all the receipts , disbur- sements and distributions during the period and assets then held as the principal of the trust , which reports shall be rendered not less frequently than annually . The records of Successor Trustees with respect to a trust shall be open at all reasonable times to the inspection of Settlors or other beneficiaries . 11 . 07 - CORPORATE TRUSTEE : Any corporate successor to the trust business of the corporate Trustee shall be the successor corporate Trustee with like powers , duties and obligations . ARTICLE 12 . 00 - DEFINITIONS 12 . 01 - ADOPTED CHILDREN : A child adopted by any person and the issue by blood or adoption of such child shall be considered issue of such person and of such person ' s ancestors if the adoption is by legal proceeding while the child is under twenty-one ( 21 ) years . 12 . 02 - PRONOUNS , SINGULAR AND PLURAL : Unless the context requires otherwise , words denoting the singular may be construed as denoting the plural and words of the plural may be construed as denoting the singular , and words of one gender may be construed as denoting such other gender as is appropriate . 12 . 03 - ISSUE : The issue of a person means all his lineal descend- ants of all generations , with the relationship of parent and child at each generation being determined by the definition of child and parent contained in the Colorado Probate Code at the date of this Agreement . 12 . 04 - BY REPRESENTATION : Whenever a distribution to issue by representation is called for , the distributable assets are to be divided into as many shares as there are , at the time such assets are distributable , issue in the nearest degree of kinship and then deceased issue in the same degree who left then living issue , each then living issue in the nearest degree receiving one share and the share of each then deceased issue in the same degree being divided among his issue in the same manner . 12 . 05 - OTHER DEFINITIONS : Except as otherwise provided in this Agreement , definitions of terms in this Agreement shall be as -6- • • defined in the Colorado Probate Code as amended after the date of this Agreement . Our comments and requirements are as follows: COMMENTS: WCR 3 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article Ill, Section 23-3-50, the required setback is measured from the future right-of-way line. REQUIREMENTS: The Weld County Public Works Department recommends approval of this application. The applicant shall utilize the existing residential and shared accesses to these parcels. (Lots A and B) Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
