The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and requirements are as follows: COMMENTS: WCR 26 is designated on the Weld County Road Classification Plan (FHU) as local gravel road, which requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. "-'/CR 29 section line is designated on the County Road Classification Plan (FHU) as a section line. This road NOT maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Right-of-Way: The applicant indicated that the existing access road is 30 feet in width and is parallel to the east section line of Section 5. All four quarters associated with Section 5 (Township 2, Range 66 West) were patented February 2, 1903. Our 1889 Resolution predates this patented date; therefore, Weld County has the 30-foot right-of-way within the proposed USR adjacent to the Section line. If anytime in the future additional splits associated with this property sever portions of the USR or the adjacent property to the south that is landlocked, this public right-of-way could be used to provide access to landlocked parcels. REQUIREMENTS: Plat Drawing: The applicant needs to identify on the plat drawing all public rights-of-way with dimensions. Off-Street Parking: Parking spaces including access drive shall be surfaced with gravel, asphalt, concrete, or the equivalent and shall be graded to prevent drainage problems. Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. I am referring the structure area to the Department of Environmental Health as it deals with chemical loading, oil and gas servicing, for their equipment. c: USR-1504 M:\PLANNING - DEVELOPMENT REVIEW\USR-Use by Special Review\USR-1504.DOC M:\PLANNING — DEVELOPMENT REVIEW\USR-Use by Special Review VUSR-l504.DOC Weld Count/ D , rr,teni "PI MEMORANDUMWI I P TO: Michelle Martin, Planner I DATE: February 25, 2005 C FROM: Donald Carroll, Engineering Administrator COLORADO SUBJECT: USR-1504, The Bluffs, John Villano & Josef Guetlein managers & Ray Edmiston owner of Aerial Sprayers, Inc.
