Environmental Health Services has reviewed this proposal for a livestock trailer
washout, vehicle repair and fueling station. We have no objections to the proposal,
however, we do recommend that the following conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Underground Injection Control (UIC)
Class V Injection Well permit from the Environmental Protection Agency (EPA)
for any vehicle maintenance facility located on the site that is equipped with a
floor drain. Alternately, the applicant can provide evidence from the EPA that
they are not subject to the EPA Class V requirements. (New EPA rule effective
4/5/2000).
2. Submit a dust abatement plan to the Environmental Health Services, Weld
County Department of Public Health & Environment, for approval prior to
operation.
3. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division (APCD), Colorado Department of Health and Environment. Alternately,
the applicant can provide evidence from the APCD that they are not subject to
these requirements.
4. The impoundment is subject to Regulation No. 61 of the Water Quality Control
Commission of the Colorado Department of Public Health & Environment. The
facility shall provide evidence to the Weld County Department of Public Health
and Environment that it has either applied for a CDPS permit or a waiver.
5. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.

Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.
6. The applicant shall submit an odor abatement plan for review and approval, to
the Environmental Health Services of the Weld County Department of Public
Health and Environment.
7. A detailed design and operation plan for the trailer wash shall be submitted to the
Environmental Health Services of the Weld County Department of Public Health
& Environment for review and approval. The plan shall be reviewed and
stamped by a registered professional engineer and demonstrate that construction
of the trailer wash, treatment system, conveyance structures and evaporation
pond will limit discharges to the environment within the limits described in the
rules and regulations of the Water Quality Control Division of the Colorado
Department of Public Health & Environment. The plan should include, at a
minimum, the following:
a. A description of the materials used to construct the wash bay.
b. The method of construction incorporated to prevent waste water from
escaping the structure.
c. A schematic of the flow of water through the wash bay, screen and
oil/grease trap to the evaporation pond.
d. A water balance or other demonstration that the evaporation pond is
adequately sized to store and dispose the anticipated hydraulic load from
the trailer wash and storm water runoff .
e. The method of disposal for accumulated wastes (sludges, etc.) generated
in the washing process.
8. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include, at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).

We recommend that the following requirements be incorporated into the permit as
conditions that must be met prior to the issuance of the Certificate of Occupancy:
1. An individual sewage disposal system is required for the existing onion storage
building and proposed trucker's lounge shall be installed according to the Weld
County Individual Sewage Disposal Regulations.
2. The septic system is required to be designed by a Colorado Registered
Professional Engineer according to the Weld County Individual Sewage Disposal
Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. All raw manure/solids shall be removed and trucked to a permitted solid waste
composting facility at a frequency that will prevent nuisance conditions.
5. The applicant shall operate in accordance with the approved "waste handling
plan".
6. The trailer wash shall be operated in accordance with the approved design and
operations plan and in accordance with the Rules and Regulations of the Water
Quality Control Commission, and the Environmental Protection Agency.
7. The facility shall have adequate equipment to dewater the retention structure, if
necessary.

8. The facility shall be operated in accordance with the approved odor abatement
plan.
9. The facility shall be operated in a manner that controls flies. A fly abatement
plan shall be implemented at the request of the Weld County Department of
Public Health and Environment, Environmental Health Services. The plan shall
be implemented in the event the department receives a significant number of fly
complaints associated the facility, and in the judgement of the Weld County
Health Officer, there exist a fly condition requiring abatement.
10.Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.
11.This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
12.Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility.
13.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
14.The facility shall utilize the existing public water supply (North Weld County
Water District) or an adjudicated water source.
15.AII potentially hazardous chemicals must be stored and handled in a safe
manner in accordance with product labeling and in a manner that minimizes the
release of hazardous air pollutants (HAP's) and volatile organic compounds
(VOC's).
16.The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
17.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
18.The facility shall maintain the stormwater collection system.
19.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article 2, Division IV,
Section 23. Our comments and requirements are as follows:
COMMENTS:
Access: The Colorado Department of Transportation (CDOT) has jurisdiction over all accesses to the state
highway. Please contact Gloria Hice-Idler at the Greeley office to verify the access permit or for any additional
requirements that may be needed to obtain or upgrade the permit. (State Highway 263)
Lots A and B of RE-3900, and Lot A of RE-1901 are identifying as a shared access point.
The latest state highway average daily traffic county reflects approximately 1,600 vehicles taken in a 24-hour
period at this location.
.EQUIREMENTS:
Future Right-of-Way: The applicant has reserved an additional 25 feet of future right-of-way to accommodate
the expansion of State Highway 263 as shown on the plat. Verification with CDOT shall be required prior to
recording the plat.
Access: The applicant is identifying the shared access point to accommodate both Lots A and B at this
location. Utilize this shared access point.
Off-Street Parking: The off-street parking areas identified for truck driver and truck parking shall be surfaced
with recycled asphalt or the equivalent to keep the dust down as trucks are circulating throughout the facility.
Approach: The applicant shall pave the approach with adequate turning radiuses for a minimum of 100 feet.
A paved approach would keep trucks from carrying rocks or mud on the state highway system and keep the
dust down as they approach the access point. The paved approach shall be a minimum of 24 feet to
accommodate two-way truck traffic.
Storm Water Drainage: The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent property damage of the
type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned
ponding of storm run-off.
I'm referring a portion of the storm water drainage to the Environmental Health Department, as it deals with
stock trailer washout and a maintenance bay.

Thank you for the opportunity to comment on this site plan review. The City of Greeley Planning
Staff has reviewed the new application and has the following comments:
1. Outdoor storage should not be permitted within any applicable setback, public right-of-way, or in
landscaped areas.
2. Items not customarily used or stored outside or made of a material that is resistant to damage or
deterioration from exposure to the outside environment should not be placed, stored, or maintained
outside for a period in excess of twenty-four consecutive hours.
3. Outdoor storage of all materials stored or to be stored in an unenclosed area must be screened
from the view of the public right-of-way. Screening should be accomplished through the use of a
solid fence or wall of sufficient height to fully screen all stored materials, or through the use of
landscaping (including plant materials and/or berms) which provides year-round screening of a
sufficient height to fully screen all stored materials, or through a combination of fencing, walls and
landscaping.
4. A buffer yard should be provided to effectively shield neighboring properties, land uses, and
public rights-of-way. Canopy trees, ornamental trees, shrubs, fencing, berms, or a combination of
such methods should be used to accomplish the buffering. The site plan indicates that landscaping
and screening shall be maintained in accordance with the approved landscaping and

screening plan. That plan was not provided by the Weld County Department of Planning Services
and therefore, the City of Greeley Department of Planning Services was unable to provide better
comments on landscaping. In the future, it would be helpful to have the landscaping plan that the
applicant submits.
5. The access drives and parking areas should be paved with asphalt or concrete to reduce the
development's impact on air quality.
6. If the twenty-five foot reserved right-of-way were improved, there would be no separation
between the proposed truck park stalls and the property line. Setbacks should be based off of the
future property line that would be created when the right-of-way is improved. It is recommended
that the thirteen truck park stalls located on the south part of the subject site be setback twenty-five
feet from the reserved right-of-way and landscaping be added to screen the trucks parked in this
area. The buffer yard should also be installed in this area so that landscaping is not unnecessarily
removed when the right-of-way is improved.
7. Considering the subject site is located within the Airport Area of Influence, a referral should be
sent to the Greeley-Weld County Airport. It also appears that a portion of the subject site is located
within a Future Critical Zone.

Dear Ms. Lockman;
The City of Greeley appreciates the opportunity to review and comment on land use cases in
Weld County which could have a significant impact on our community. In addition to the
comments forwarded to you by Darrell Gesick in his October 19, 2004 letter, the City of Greeley
Planning Commission met on November 9, 2004 and expressed concern about potential odors
being generated by the truck washout portion of the facility.
The City of Greeley has taken a number of steps to help reduce odors in and around our
community, including purchasing a feedlot within City limits, implementing a variety of odor
control measures at the sewer plant, and requiring the Greeley Truck Washout to tie into the City
sewer system. As proposed, the truck washout associated with this property is proposed to have
a variety of significant odor generators, including no aeration of the pond, stacked solids located
on-site for an indefinite period of time, and land-applying residual waters through a center-pivot
sprinkler. Twenty-two odor violations were received about the Greeley Truck Washout the year
before they tied into the City sewer. Since then, there has been one complaint in the last five
years.
The following specific concerns were also expressed:
1. Groundwater monitoring wells on this site and on adjacent sites need to be added to insure no
impact to groundwater.
2. Require the removal of stacked solids in a timely manner to minimize odor. This could be as
frequent as once per day.
3. Require odor from this facility to not exceed a minimum of a 7:1 standard at any time and
require the facility to incorporate "best practices" to minimize odor, including aeration of the
pond, timely removal of stacked solids, tying into the City sewer, etc.
4. Identify the maximum number of trucks the facility can process in a day, given the limitations
of their odor control measures.
5. Investigate the feasibility of tying into the City of Greeley's sewer system and potentially
annexing to the City, since the land application portion of the property is immediately
adjacent to City limits.
6. Pave, asphalt or concrete, the areas where vehicles will be driving.

The City and County have both invested in the development of industrial sites in and around the
airport. Allowing an odor generator to locate in the area without adequate means to address
odors will limit the growth potential at the airport. The City urges the County to take appropriate
odor-control measures to limit the impacts of this facility on the surrounding area, including the
airport. The odor control plans proposed by the applicants, incorporation of trees and adding a
fence is not sufficient.

Ms. Lockman:
The following are the Fire Authority's questions and concerns for the proposed Miller
Transportation project(Case Number AmUSR-1441):
1. Will the proposed fuel tank be located underground or aboveground? What
will be in it? Plans shall be submitted specifically for the installation of the
tank that must include a site plan, product data, MSDS's, etc. to the Fire
Authority for review and approval prior to installation.
2. Plans shall be submitted to the Fire Authority for any and all buildings that
will be remodeled or newly constructed for review and approval prior to work
commencing. Additional requirements for buildings may be identified during
these reviews.
3. Please clarify if the concrete washout facility will be a building or an open
pad.
4. Please clarify the use of the 14' x 36' building proposed on the plans.
5. Please clarify the operation of the proposed access gates to the east side of the
property. Lock and chain? Electrically operated? When will they be closed
and locked?
6. Are there any oil and gas wells/production facilities within 350' of any
building or proposed building on the site?
7. Where is the nearest fire hydrant in relation to the site?
8. Please clarify where the fueling station will be located.
Please have the applicant submit the requested information to me at 1100 10° Street,
Suite 100, Greeley, CO 80631. The Fire Authority plans on attending the Weld County
Planning Commission Hearing for this project because of the many issues that exist.

Dear Ms. Lockman:
The above referenced referral was reviewed for comment on behalf of the Division of Wildlife by Larry
Rogstad, District Wildlife Manager in Greeley. Rogstad also made a site inspection on October 22, 2004 and
spoke briefly by telephone with Lauren Light, authorized agent for the project. Based on Rogstad's review the
Division of Wildlife would recommend the following:
• The irrigation pond on the north property boundary should be protected to insure that runoff from the site
or liquid and solid waste from the truck wash will not run off into the pond. A slightly raised berm should
be installed between the pond and the storage lagoon to direct accidental spills from running to the pond or
irrigation canal to the east of the property.
• Slope for the relocated south pond shoreline should be contoured no steeper than 3:1. Preferably the
contour should be shallower 5:1 or less to promote production of cattail and bulrush which will provide
partial screening of the pond from increased human activity on the developed site. Shoreline and uplands
resulting from the relocated pond edge should be seeded to appropriate mixture of grasses/legume for the
site as determined by the Natural Resources Conservation Service(NRCS)or other qualified consultant. A
thick stand of prairie cordgrass,reed canarygrass,bluestems, wheatgrass and other tall grasses along with a
legume component may create a movement barrier which would decrease emigration of frogs and toads
away from the irrigation pond to the washout pond and adjacent parking areas,thereby reducing mortality
to these creatures.
• Plum thickets,junipers or other shrubby vegetation should be installed on the top of the berm between the
irrigation pond and storage pond to provide further visual screening between wildlife and increased human
activity on site.
• Careful consideration should be given to the choice and placement of landscaping material along Highway
263. While benefiting wildlife and the visual aspect on the site, improperly placed trees and shrubs when
mature, may increase the snow load on the highway. This section of Highway 263 also suffers a high
incidence of car-deer strikes. Fencing around the perimeter and plantings along the highway should allow
adequate sight distance to prevent increase in the rate of road strikes. NRCS or Colorado State Forest
Service will be able to offer advice on the proper selection of plant materials,planting techniques, and
placement that will allow for maximum benefit and survival of these plantings.

• Completion and operation of this facility in all likelihood may prevent the continued use of the irrigation
pond on the adjacent property for unrestricted hunting. This may negatively impact the hunting lease value
for the neighboring landowner. Placement of permanent hunting blinds in the southeast and southwest
corners of the pond with a posted safety/no hunt zone to the south would allow continued use of the pond
for hunting. Hunters using the designated blinds would shoot away from the facility. However such an
arrangement should be agreed to by the adjacent landowners or their agents.
Facts upon which suggestions are based:
• The site for the washout,repair and fueling station has already been developed and used
previously as a onion storage shed. Redevelopment of the site to the suggested use should have
minimal impact on wildlife resources.
The irrigation pond immediately north of this property however is generally full especially during the fall
migration. Until it freezes, the pond provides food and cover for waterfowl, shorebirds and waterbirds. Often
ducks are found on this pond before they start to use nearby rivers. Because of regular use by ducks and geese this
pond has been traditionally hunted until freezeout. Raptors especially Northern Harriers, are frequently seen
hunting the pond and adjacent fields. The pond edge is marked with tracks and scat of red fox, coyote, and
raccoons. During spring, chorus frogs and woodhouse toads have been heard or seen on the pond. Northern
leopard frog,bullfrog and other amphibians can be expected to be found here. Several species of snakes and turtles
can also be expected to be dependent on the pond for food and cover.
The plans call for reworking the south pond edge,which is actually located on the subject parcel.
Reworking the pond offers the opportunity to contour this edge to provide maximum benefit to wildlife while
allowing for completion of the development. Since the pond is adjacent to the proposed development visual
screening techniques suggested may provide the separation that will allow wildlife continued use of this key
wildlife habitat once the business is open.
Hunting is a recreational and economic benefit to Weld County. On the date of the site visit, I spoke with
two duck hunters at the pond. They told me they had just leased the pond and adjacent fields for hunting during
the 2004-2005 hunting season. Revenues generated through hunting leases provide a much needed financial
benefit to farmers. Whenever possible steps should be taken to insure that our hunting legacy continues in
appropriate settings.

Site Specific Development Plan and Special Review Permit for a business permitted as a use by right or an
accessory use in the Industrial Zone District ( livestock trailer washout, vehicle repair and fueling station) in the
A (agricultural zone district).
1. A building permit shall be obtained prior to the construction of any new building, addition or remodel of the
existing building..
2. A plan review is required for each building for which a building permit is required. Plans shall include a floor
^tan. Plans shall bear the wet stamp of a Colorado registered architect or engineer. Two complete sets of plans
e required when applying for each permit. Provide a Code Analysis Data sheet provided by the Weld County
Building Department with each Building permit application.
3. Buildings shall conform to the requirements of the various codes adopted at the time of permit application.
Currently the following has been adopted by Weld County: 2003 International Building Code; 2003 International
Mechanical Code; 2003 International Plumbing Code; 2003 International Fuel Gas Code; and the 2002 National
Electrical Code and Chapter 29 of the Weld County Code.
4. The building will be classified as an(Office) B, and ( Motor vehicle repair garage complying with the maximum
allowable quantities listed in Table 307.7(1) S-1. Fire resistance of walls and openings, construction
requirements, maximum building height and allowable areas will be reviewed at the plan review. Setback and
offset distances shall be determined by the Zoning Ordinance.
5. Building height shall be measured in accordance with the 2003 International Building Code for the purpose of
determining the maximum building size and height for various uses and types of construction and to determine
compliance with the Bulk Requirements from Chapter 27 of the Weld County Code. Building height shall be
measured in accordance with Chapter 23 of the Weld County Code in order to determine compliance with offset
and setback requirements. Offset and setback requirements are measured to the farthest projection from the
building.

The sheriffs office has no concerns with this Special Use Permit. The sheriff's office
would however be willing to provide a program entitled Crime Prevention Through
Environmental Design to the developer. This program reduces the likelihood of criminal
activity at a specific location by"hardening"it to crime.
The Sheriffs Office lacks the ability to absorb any additional service demand without the
resources recommended in the multi-year plan provided to the Board of County
Commissioners or as indicated by growth not considered at the time the plan was
developed. I have no other comments on this proposal.
