HomeMy WebLinkAbout20051027.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO MARCH 23, 2005 TAPE #2005-17 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Centennial Center, Greeley, Colorado, March 23, 2005, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long - EXCUSED Commissioner Robert D. Masden - EXCUSED Commissioner Glenn Vaad Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Debra Miller Controller, Barbara Eurich MINUTES: Commissioner Geile moved to approve the minutes of the Board of County Commissioners meeting of March 21, 2005, as printed. Commissioner Vaad seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Vaad moved to approve the Certification of Hearings conducted on March 21,2005,as follows: 1) Hearing to gain public input regarding changing the boundary lines of Commissioner Districts in Weld County, Colorado. Commissioner Geile seconded the motion, which carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: Gary Stewart, representing Danny Perdew of Faith Tabernacle Church, read excerpts from a letter(Exhibit A)and presented pictures(Exhibit B)relative to Board of Adjustment Case#1005. He stated said case pertained to the signs identifying Faith Tabernacle Church. He stated the Weld County Code addressing signs has not been updated and the issue needs to come before the Board of County Commissioners for review. ChairJerke expressed appreciation to Mr. Stewart for his efforts on the Board of Adjustment and welcomed the opportunity to discuss the issue further. Mr. Stewart stated a second issue concerned a mobile home and a vehicle located on his property in Aristocrat Ranchettes, which the Department of Planning Services has cited as being in violation of the Weld County Code. He submitted a letter outlining his dispute(Exhibit C). Responding to ChairJerke, Mr. Stewart stated there is not a pending zoning violation hearing for his property. Chair Jerke stated Weld 2005-1027 BC0016 f'g-0b-PC- County has compliance officers in the field regularly and at the monthly violations hearing meeting,one out of three cases involve violations within Aristocrat Ranchettes. He summarized that the issue is ongoing. Commissioner Geile stated Mr.Stewart needs to work with the Department of Planning Services to resolve the issue. Monica Mika, Director, Department of Planning Services, stated staff has initiated a violation; however, there is not a specific date set up, and staff is attempting to resolve the issue before it moves to violation hearing status. CONSENT AGENDA: Commissioner Geile moved to approve the consent agenda as printed. Commissioner Vaad seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: There were no Commissioner Coordinator Reports. WARRANTS: Barbara Eurich, Controller, presented the following warrants for approval by the Board: All Funds $348,756.03 Commissioner Vaad moved to approve the warrants as presented by Ms. Eurich. Commissioner Geile seconded the motion, which carried unanimously. BIDS: PRESENT BIDS: Pat Persichino, Director, General Services, stated there were no bids to present. APPROVE 2005 CRACKSEAL BID- PUBLIC WORKS: Mr. Persichino stated the Department of Public Works requested approval of the low bid from Flat Coat Asphalt Specialists in the amount of $7,810. Responding to Commissioner Geile, Frank Hempen, Director, Department of Public Works, stated there have been performance problems with Flat Coat Asphalt Specialists in the past;however,the firm has taken positive steps to address the issues and staff will be present on the job site to monitor performance. Mr. Hempen stated there was no recourse except to give Flat Coat Asphalt Specialists the opportunity to perform, because the firm is the low bidder. Responding to Commissioner Vaad, Mr. Hempen stated there is a performance bond for the project,in the amount of$7,810. Commissioner Geile moved to approve said bid. Seconded by Commissioner Geile, the motion carried unanimously. APPROVE MOW-HERBICIDAL BID-PUBLIC WORKS: Mr. Persichino stated the Department of Public Works requested approval of the low bid from B and G Mowing Services for Class I and Class II mowing services, and Korby Landscape, LLC for Class III mowing services. He stated approval was requested for the low bid from Paratex Colorado, Inc., for Class I and Class IV herbicidal application, and Korby Landscape, LLC for Class II and Class III herbicidal application. Responding to Commissioner Geile, Mr. Persichino stated the prices include the equipment. Mr. Hempen stated Class I is for smaller areas and Class III is for a 15 or 20-foot mower. He explained some of the vendors have a set-up charge and the cost is per hour or per acre. Responding to ChairJerke, Mr. Hempen stated the area mowing and weed control will take place on private property and does not include mowing of rights-of-way. Commissioner Geile moved to approve said bids. Seconded by Commissioner Vaad, the motion carried unanimously. Minutes, March 23, 2005 2005-1027 Page 2 BC0016 NEW BUSINESS: CONSIDER CONSULTANT AGREEMENT FOR OCCUPATIONAL THERAPY SERVICES AND AUTHORIZE CHAIR TO SIGN - BETH LABONDE: Mr. Speckman stated the consultant will provide occupational therapy to migrant and seasonal Head Start children on the Western Slope. Commissioner Vaad moved to approve said agreement. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER VALE GRANT APPLICATION FOR LONG TERM CARE OMBUDSMAN ADVOCATE/FRIENDLY VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN: Mr.Speckman stated the amount of the grant is$8,500 and the program year is from July 2005 through June 2006. He explained the program is to prevent elderly abuse. Commissioner Geile moved to approve said grant application. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER MEMORANDUM OF UNDERSTANDING FOR ELECTRONIC RECORDING AND AUTHORIZE CHAIR TO SIGN-TITLE COMPANY OF DENVER: Bruce Barker, County Attorney, stated his office has reviewed the memorandum of understanding. Commissioner Vaad explained the memorandum of understanding speeds up the paper processing for recording of real property documents. Commissioner Vaad moved to approve said memorandum of understanding. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER CHANGE ORDER NO. 1 TO CONTRACT FOR ENGINEERING SERVICES FOR WELD COUNTY ROADS 64.75,23,AND 66 AND AUTHORIZE CHAIR TO SIGN-KBN ENGINEERS: Mr.Hempen stated the change order is to increase the overall contract price by $21,647.30 to account for additional services performed beyond the original contract scope of work, including additional right-of-way legal descriptions and exhibits, utility pot holing services, printing of plans and special provisions, hiring a construction testing company, compensation for extensive irrigation/drainage design and additional man-hours for plan interpretation throughout construction of the project. He stated after the increase the total contract cost will be$45,097.30,which represents less than eight percent of the project costs and the Town of Windsor will share the cost. Commissioner Geile moved to approve said change order. Seconded by Commissioner Vaad, the motion carried unanimously. CONSIDER PREPAID COMMISSION ADDENDUM TO FACILITY INMATE SERVICESAGREEMENTAND AUTHORIZE CHAIR TO SIGN - EVERCOM SYSTEMS, INC.: Mr. Barker stated he had reviewed the provisions of the original agreement;however,he is concerned about the prepaid clause and recommended continuance of the matter until March 28, 2005, to determine the exact intent of the addendum. Commissioner Vaad moved to continue said matter until March 28, 2005, at 9:00 a.m. Seconded by Commissioner Geile, the motion carried unanimously. CONSIDER REQUEST FOR RELEASE OF DEED OFTRUSTAND RELEASE AND AUTHORIZE CHAIR TO SIGN-SYKES REALTY, INC.: Mr. Baker reviewed the conditions of the deed of trust. He stated Sykes Realty, Inc., is requesting release of the deed of trust. Chair Jerke recommended having a work session to discuss the exact terms of the original deed of trust. Commissioner Vaad moved to continue said matter to April 6,2005,at 9:00 a.m. Seconded by Commissioner Geile,the motion carried unanimously. Ma den G ( G enn Vaad Minutes, March 23, 2005 2005-1027 Page 4 BC0016 March 23,2005 BOARD OF COMMISSIONERS WELD COUNTY HONORABLE COMMISSIONERS: DURING MY EIGHT YEARS OF SERVING ON THE WELD COUNTY BOARD OF ADJUSTMENT THERE WAS A GREAT DEAL OF SATISFACTION THAT WE PERFORMED AS A BOARD FOR DOING RIGHT FOR THE PEOPLE. THERE WAS ONE EXCEPTION THAT STANDS OUT AND I TAKE A STRONG POSITION THAT JUSTICE WAS"NOT" PERFORMED. CASE#BOA-1005 WAS PRESENTED AND THERE WAS THREE SEPARATE HEARINGS AND AT THIS TIME I SERVED AS CHAIR FOR THE BOARD. REVEREND DANNY PERDEW OF FAITH TABERNACLE CHURCH,LOCATED AT HYS. 34 &71ST AVENUE PRESENTED HIS CASE.ONE ISSUE WAS THE HEIGHT OF THE STEEPLE WHICH WAS SLIGHTLY GREATER THAN THE BUILDING CODE ALLOWED,THIS WAS APPPROVED BY THE BOARD. THE OTHER SIGNIFICANT ISSUE WAS THE DESIRED SIGNS TO IDENTIFY THE CHURCH. THE FINAL BOA DECISION WAS COMPLICATED IN SUCH A MANNER THAT IT MIGHT BE SAID THAT IT WAS ULTIMATELY DENIED. MR. PERDEW PRESENTED THAT THE SIGN SHOULD BE RAISED TO A HEIGHT TO ACCOMMODATE THE VIEW FROM HWY.34. AS THE PLAIN THAT THE CHURCH IS LOCATED ON IS MUCH LOWER THAN THE HWY AND PART OF 7I ST STREET,ALSO IN THE PROPOSAL WAS THAT THE SIGN WOULD BE CONSTRUCTED IN MATCHING MATERIAL FROM THE CHURCH STRUCTURE.THERE WAS TO BE A SECOND SIGN ON 71ST STREET THAT WOULD IDENTIFY THE CHURCH AND PARKING LOT. PRESENTLY NO SIGN EXISTS THAT IDENTIFIES THE CHURCH AND I HAVE NOTICED THAT WHEN THEY HAVE A SPECIAL EVENT THEY IDENTIFY THE STRUCTURE WITH A BUS OR VAN ON THE CORNER WITH A SIGN. THIS STRUCTURE IS THE BEST ARCHITECTURAL DESIGN IN THIS NEIGHBORHOOD AND IT IS MAINTAINED IN AN EQUAL MANNER. THESE FOLKS AT THIS CHURCH OF WHICH I AM TAKING A STAND (AND HAVE NO AFFILATION)ARE NOT COMPLAINERS BUT RATHER ACTIVE IN THE COMMUNITY TO HELP OTHERS. WITHOUT GOING INTO DETAILS OF THE SERVICES THAT THIS CHUCH PERFORMS FOR THE COMMUNITY I KNOW THAT THE BOARD OF COMMISSIONERS WOULD BE AS IMPRESSED AS I AM. THE WELD COUNTY PREHISTORIC SIGN CODE WAS CARVED IN STONE SOMEWHERE AND PROBABLY TRANSPORTED OVER HERE ON THE MAYFLOWER AND IS SO OUTDATED THAT IT IS NOT UP TO DATE WITH NEEDS AND TECHNOLOGY. THE AFTER MEETING COMMENTS OF BOA MEMBERS WAS A FURTHER INDICATION TO ME THAT THERE WAS NOT A GOOD UNDERSTANDING. IT IS MY UNDERSTANDING THAT THE CITY OF GREELEY HAS APPLIED FOR ANNEXATION FOR THIS PROPERTY. HOWEVER,THIS PROBLEM OF THE SIGN BELONGS TO WELD COUNTY GOVERNMENT AND NEEDS TO BE TAKEN CARE OF PROPERLY BY THE SAME. PRESENTLY BOTH PROPERTIES ARE COMPLETELY FURNISHED AND MAINTAINED FOR MY PERSONAL USE. MONICA SAID THAT SHE WOULD REVIEW SAME AND SUGGESTED THAT I TAKE UP THE ISSUE WITH THE BOARD OF COMMISSIONERS AT THIS VERY TIME. MONICA DISCLOSED TO ME YESTERDAY THAT THEY DO PICK&CHOOSE THEIR CASES AS FUNDS WILL ALLOW. MY PROPERTIES ARE THE VERY CLEANEST IN THIS AREA WITH THE EXCEPTION OF MY IMMEDIATE CLEAN NEIGHBOR TO THE SOUTH. I HAVE WORKED HARD AND SPENT GOOD MONEY TO MAINTAIN MY PROPERTIES AND DOCUMENTATION WILL REFLECT THIS. I WANT MY PROPERTIES IN COMPLIANCE,BUT THIS ERROR IS NOT MY FAULT AND A MAJOR PART OF THE FAULT IS WITH THE PLANNING DEPARTMENT. I RESEARCHED THIS VERY ISSUE BEFORE PURCHASING THE PROPERTY AND NO RECORDS WERE AVAILABLE THAT REFLECTED THIS DISCREPANCY. WITHIN THIS RANGE THERE I COUNTED ONE HUNDRED AND TEN(110)DERELICT VEHICLES,NINE DERELICT CAMPERS(9)FIVE NON COMPLIANCE MOBILE HOMES(5) AND A MULTITUDE OF DIRTY,TRASHED AND JUNKED LOTS WITH HOMES SITUATED. ONE OF THESE LOTS HAS TWO(2)HOMES AND NOT IN COMPLIANCE AS BOTH ARE OCCUPIED AND ON THE SAME WATER SYSTEM, SEPTIC IS A QUESTION? THE LEMAY PROPERTY IS THE MOST DISGUSTING&NOTORIOUS IN THIS NEIGHBORHOOD AND IT IS MY UNDERSTANDING THAT THEY RECENTLY RECEIVED THE BLESSING OF WELD COUNTY GOVERNMENT TO CONTINUE THIS JUNK YARD WHICH IS PARTIALLY BEHIND AN UGLY, PATCHED, FALLING FENCE.(NOT INCLUDED IN ABOVE COUNT) MY PROPOSAL IS THAT THE 77 FOOT LENGTH STORAGE MOBILE HOME WOULD BE REDUCED [N SIZE BY 51 FEET AND THE REMAINING 26 FEET WOULD BE A CONTINUANCE OF THE EXISTING BLOCK&TIED DOWN CONDITION AS WELL AS SKIRTED, PAINTED AND PRESENTED IN MANNER THAT IS BETTER THAN MORE THAN HALF OF THE OTHER EXISTING SRUCTURES IN THIS NEIGHBORHOOD. SINCERELY, GARY STEWART Your description of the"tan derelict van"my boys cleaned and tuned it last summer and I since moved it to the property where it is titled, registered and licensed and it is Not a derelict vehicle,There are 98 derelict vehicles in this immediate area that are not behind ugly fences,these have flat tires,doors&hoods open,no license plates,missing windows, some cannibalized and settling down in the dirt they are really easy to spot. It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we have no discretion in this matter if you fail to correct this violation. I am familiar with the property as I use to live at 7169 Henry St.Lot I,of block 57,this Lot in concern is lot 4. The white modular was placed on lot 4 in 1998 and at that time your inspector would not issue an occupancy certificate until the yellow mobile home was blocked and tied down as it was to be used for extra items storage. Picture enclosed as the structure in question is blocked&tied. The yellow mobile home use to be the primary residence at this location. March&April of 2003 I inquired of the Weld County Public Trustee,Clerk Recorder,Treasurer,Assessor and twice to the Department of Planning Services.This inquiry was to determine the facts so that I would not get any unnecessary surprises. I also hired an attorney and purchased a title insurance policy in an attempt to cover all the bases.Now according to you the information that I received from your Department was wrong. The problem may be that Monica as your Director allows some information to pigeon holed in a certain office and the rest of your department and the public is placed at risk. This in my opinion is reckless business. I would like to have a copy of the original complaint on this subject. Last summer my two college boys spent the entire summer cleaning the property of debris,fixing,painting, repairing and monitoring. We had two 30 yard roll-off dumpsters as well as many truck loads to the disposal dumps. The property has not had this much clean up since the 80's when I first became familiar with same. There was literally decades of accumulation that had been ignored. During 19981 installed a home on Lot 2 and Lot 7 of this Same Block 57,at that time I applied and had in my possession &posted two complete permits and the permits from the Health Department.Contractors were in place and performing their duties respectfully when your then Inspector, David Sprague came on the scene and told the contractors that no permits existed(which was not so)then the contractors left and went to another job site. It was several months before the contractors returned and began working and during that time your department was on my case for not having the project completed.The night the Princess Diane died 1 was under the home digging cassions with spot lights and this was after my full day of work. Resultantly I later had a heart attack and I blame the Department of Planning at that time and now. The record keeping system in Weld county has been notorious and this problem that you think exists is in my opinion included. Unrelated to your department but the Health Department at another time lost all the information and details of a septic system on another property of mine near Greeley. The then director Jeff Stoll personally did the inspection and made amends. Now within a few hundred feet of old yellow there are five illegal mobile homes and believe me I do know what an illegal mobile home is.Four of these are not tied down and the fifth is occupied as a rental residence as the second home on the acre and both your department and Aristocrat Ranchette Water Project (ARWP)is aware but chicken. My boys are in college this summer and cannot do extra work for me as well as my office is in Englewood, and my livestock are at the Greeley location and I spend a full day every day,but none the less I look forward to having a conversation with you. Your description of the"tan derelict van"my boys cleaned and tuned it last summer and I since moved it to the property where it is titled,registered and licensed and it is Not a derelict vehicle,There are 98 derelict vehicles in this immediate area that are not behind ugly fences,these have flat tires,doors&hoods open,no license plates,missing windows, some cannibalized and settling down in the dirt they are really easy to spot. Block 52, Second Filing, Aristocrat Ranchettes, Fort Lupton. Colorado 80621 The above described property is located one intersection north of my properties on Coleman Avenue& within 500 feet. This mentioned property has a long term accumulation of old vehicles, mobile homes, appliances and other miscellaneous junk and trash. The other unfortunate part is that the Planning Dept. allows it to be partially contained by a fence that is as old. in bad shape and as ugly as the junk & trash. One of the old mobile homes and other junked vehicles are setting on the right of way of Lamb Avenue. It is a mystery to sonic of the neighbors as why the Weld County Planning Dept. is known for knit picking on small items and the major atrocities are ignored. Anyway the neighbors are considering petitioning your Dept. and the Commissioners for proper action. I thought that was appropriate to first give you a "heads up." Furthermore it is a fire hazard, rodent den, safety concern with high winds, very ugly Site and an environmental contamination concern. 1 would estimate that this acre of land will have 3 to 5 acre feet of junk & trash and now I ask why? Staff currently has a case pending at the County Attorney's Office for this site; however,it does not sound like it will address all of your concerns mentioned in your letter. In any Agricultural Zone District, such as Aristocrat Ranchettes, "Derelict Vehicles"are allowed as an Accessory Use as long as they are screened from all adjacent properties and public rights-of-ways,such as the property owner is doing. The vehicles located outside of the screened area are 'called out' in our current pending complaint at the County Attorney's Office. The mobile home located inside the fenced area (the furthest South mobile home)was permitted quit some time ago as a"Storage Unit". The Weld County Code has since been changed and no longer allows this type of permit; however, pre-existing permits are considered "Nonconforming Uses". Additionally, the property owners are in the process of joining a mobiie home to the existing mobile home (already permitted as a Principle Dwelling Unit)through a building permit(BCS-020424). The mobile home located in the right-of-way was previously added to our existing complaint at the County Attorney's Office.
