Dear Mr. Ogle:
Please find enclosed plat indicating the approximate location of Duke Energy Field
Services, LP natural gas gathering pipelines within the proximity of the planned mining
development. It appears the Applicant has identified our line, running north/south, to
parallel the liquid Sinclair pipeline. Are other pipeline running east/west on the northern
boundary of the property, appears to be outside of the mining activity.
At this time, Duke would have no conflicts with the granting of this USR and would, if
necessary, relocate our pipeline at the expense of the Applicant.

If any work associated with this project requires the placement of dredged or fill material,and
any excavation associated with a dredged or fill project, either temporary or permanent, in waters of the
United States at this site,this office should be notified by a proponent of the project for Department of the
Army permits or changes in permit requirements pursuant to Section 404 of the Clean Water Act. Waters
of the U.S. includes ephemeral, intermittent and perennial streams, their surface connected wetlands and
adjacent wetlands and certain lakes,ponds,drainage ditches and irrigation ditches that have a nexus to
interstate commerce.
Work in waters of the U.S. should be shown on a map identifying the Quarter Section, Township,
Range and County of the work and the dimensions of work in each area of waters of the U.S.

The Weld County Public Works Department has reviewed this proposal; this project falls primarily under the purview of the
Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Our comments and
requirements are as follows:
COMMENTS:
There are two components associated with this amended USR. The first component is the import of sand and gravel
aggregate from the Walters/Bokelman Pit, which is located approximately 300 feet north of the intersection of WCR 13
and WCR 54.
The second component deals with amending the existing USR-1329, mining/materials processing a concrete batch plant
)eration.
Weld County Strategic Roadway: (December 2002) WCR 13 is classified by the County is a Strategic Roadway,
which requires a 140-foot right-of-way at full build out. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. If the right-of-way cannot be verified, it shall be dedicated.
Weld County Road Classification Plan (FHU): (June 2002)
WCR 54 is a major arterial road, which requires a 140-foot right-of-way at full build out. The applicant shall verify the
existing right-of-way and the documents creating the right-of-way. If the right-of-way cannot be verified, it shall be
dedicated.
REQUIREMENTS:
Future Right-of-Way: The plat drawing shall reflect the additional right-of-way to be reserved for the expansion of WCR
13 and WCR 54. There will be a 70-foot right-of-way from the centerline on each side to accommodate the future arterial
status of both locations.
Setback: Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (Ordinance 89, as amended),
the required setback is measured from the future right-of-way line.
Access: The applicant has identified on the plat drawing the site access. Utilize this main access point as no additional
accesses shall be granted at this proposed location.

Traffic Study: Matt Delich has provided a traffic impact study associated with the existing and the importing of additional
materials from the Walters/Bokelman Sand and Gravel Mine Facility. The Weld County Public Works Department would
deal with the additional traffic through the Improvements Agreement/Long-Term Road Maintenance Agreements.
Storm Water Drainage: The applicant has indicated that the storm water drainage will be control on site by being routed
to the pit floors. All discharge points shall be designated on the plat, and appropriately routed to the Big Thompson River.
This portion of the permit falls under the jurisdiction of the State of Colorado, as it deals with discharge of water in the
United States.
On-Site Parking: The on-site parking area including the access drive shall be paved with asphalt, concrete, or the
equivalent with adequate turning radiuses to accommodate large truck movement. The paved surface shall extend to the
batch plant. The purpose is to control dust from dragging foreign material on to WCR 13 and WCR 54.
Import Haul Route: The Walter/Bokelman Sand and Gravel Mine is located approximately 300± feet north of the
intersection of WCR 13 and WCR 54. The applicant shall enter into an Improvements Agreement for the Upgrade and
Paving of the extension of WCR 13 from the intersection through the turning radiuses to the main entrance to the pit.
Note: Weld County always requires paving from the pit entrance to the nearest paved road. There is no designated haul
route north of your entrance to US Highway 34. Your new haul route will be associated with your pit entrance south to
WCR 54 then disburse east or west.
.he applicant shall provide a set of road plans for WCR 13 at the intersection of WCR 54 north through the pit entrance.
The road plan shall include: typical road crossing, base and paving, drainage, stationing with adequate turning radiuses
paving to the scale house or at lease a minimum of 100 feet to keep from dragging debris, and dust control prior to
entering on to WCR 13.
Designated Haul Route: The applicant shall enter into a Long-Term Road Maintenance and Improvements Agreement
with the Weld County Public Works Department for the designated haul route. The designated haul route associated with
your USR-1329 application is as follows:
A. From the main pit entrance (USR-1329) on WCR 13 north to the intersection of WCR 54, thence north continues
Walters/Bokelman pit entrance. The maintenance is on WCR 54 between WCRs 13 and 15, all within Weld
County maintenance area and west of the intersection is Larimer County.
B. A note should be placed on the plat and incorporated into the Long-Term Road Maintenance and Improvements
Agreement, which states the applicant shall enter into an agreement with the Board of County Commissioners
and at any time in the future, maintenance of WCR 13 becomes the responsibility of Larimer County. That portion
would transfer to the appropriate county.
C. The applicant shall provide in writing a sign-off from Larimer County verifying that a traffic impact study has been
reviewed, and if there are any additional improvements associated with the designated haul route of WCR 13
(LCR 901) and WCR 54 (LCR 18) associated with the intersection within Larimer County maintenance area. .
The Weld County Public Works Department has jurisdiction over the maintenance of WCR 13 north of
WCR 54 to US Highway 34. The road section north of the Walters/Bokelman pit has not been designated
as a haul route. If this route is being proposed to Larimer County as their haul route, Weld County Public
Works requires paving of all designated haul routes from gravel pits, concrete, and asphalt batch plants
to the nearest paved roads.

there is a conflict. PSCo has an existing 6" High Pressure Gas Line located within this
proposed development Anv crossings, designations of open space. proposed
landscaping or similar activities involving our existing right-of-way will require PSCo
approval. These encroachments must be approved and documented with a license agreement
to be executed by the adjacent land owner/developer and PSCo. Enclosed please find an

All applicants for encroachment on Public Service Company of Colorado(PSCo) lands or
rights-of-way must complete the attached font and return it along with the required
sketch and any other maps and plans of the proposed encroachment to:

Public Service Company of Colorado charges a$500.00 fee for processing encroachment
applications. This fee is in addition to any fees charged for the use of PSCo lands or
rights-of-way.
Applications are processed as they are received. Most proposed encroachments require
review and approval by PSCo engineering and/or operations staff. Typically, review and
approval of a proposed encroachment takes 2-4 weeks, depending on the type of
encroachment and the completeness of the application.
If the proposed encroachment is approved, you will receive two copies of the license
agreement for execution. Once these agreements are signed, they should be returned for
further execution and processing. No encroachment will be permitted until all fees are
paid and the agreement is signed on behalf of PSCo.

Environmental Health Services has reviewed this proposal for a mineral resource
development facilities, including open pit mining and materials processing, a concrete
batch plant and the importation of sand and gravel aggregates . We have no objections
to the proposal, however, we do recommend that the following conditions be part of any
approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall amend the existing Emission Permit for the modification in the
operation if the Colorado Department of Public Health and Environment
determines that such a modification represents a significant change in emissions
or production.
2. The applicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
3. The existing Colorado Discharge Permit System (CDPS) must be amended for
the increased operation if the Water Quality Control Division of the Colorado
Department of Public Health & Environment determines that such a modification
represents a significant change in the discharge.
4. The applicant shall submit evidence of an Aboveground Storage Tank permit
from the Colorado Department of Labor and Employment (CDL&E), Oil
Inspection Section for any aboveground storage tanks located on the site.
Alternately, the applicant can provide evidence from the (CDL&E), Oil Inspection
Section that they are not subject to these requirements.

5. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. The applicant shall comply with all provisions of the Underground and Above
Ground Storage Tank Regulations (7 CCR 1101-14).
6. Any vehicle washing area(s) shall capture all effluent and prevent discharges
from the washing of vehicles and drum washing in accordance with the Rules
and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
7. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved dust abatement
plan at all times.

8. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in 25-12-103 C.R.S., as amended.
9. Adequate handwashing and toilet facilities shall be provided for employees,
visitors and customers of the facility.
10.Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
11.Portable toilets may be utilized on sites that are temporary locations of the
working face and portable processing equipment, etc. for up to six months at
each location.
12.The facility shall utilize the existing public water supply. (Little Thompson Water
District)
13.Bottled water shall be provided to employees at the temporary locations of the
working face at all times.
14.The applicant shall remove, handle, and stockpile overburden, soil, sand and
gravel from the facility area in a manner that will prevent nuisance conditions.
15.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
16.If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
17.The operation shall comply with all applicable rules and regulations of the
Colorado Division of Minerals and Geology.
18.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-
28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
memorandum to county planning directors, this office will only perform a cursory review of
the referral information and provide comments.
This referral is for a site specific development plan and use by special review for a
sand and gravel mining operation. The mining operation is identified as Green/Croissant
Sand and Gravel Mine Pit. Loveland Ready Mix (LRM) currently operates the site under
the USR-1329 and Division of Mineral and Geology reclamation permit#M2001-022. The
subject property consists of approximately 227 acres, of which only 68 acres are to be
mined. LRM proposes to import sand and gravel aggregates from the proposed
Walters/Bokelman pit and transport it to the Green/Croissant site for processing.
Please note that, as required by C.R.S. §37-90-137(11), gravel pits that exposed
ground water to the atmosphere after December 31, 1980 need to replace all out-of-
priority depletions of ground water. In addition, according to the State Engineer's "General
Guidelines for Substitute Water Supply Plans for Sand and Gravel Pits", any excavation
that intercepts groundwater must also consider the water consumption by the gravel
operation including, but not limited to dust control and water removed with the mined
product. From previous experience, 4 percent of the product mined (any product
excavated below the groundwater table or any product excavated above the ground water
table and washed) by weight is water.
According to our records, on July 13, 2005 the State Engineer's Office approved a
temporary substitute water supply plan ("SWSP") for the Green/Croissant site. Also a well
(gravel pit) permit was approved for this site under permit no. 60263-F. With the proposed
amendment, if sand and gravel aggregate from the Walters/Bokelman pit will be
processed at the Green/Croissant site, the applicant will need to ensure the water
consumption by the gravel operation at the Green/Croissant and Walters/Bokelman pits is
included in the SWSP approved for the Green/Croissant site. The applicant will need to
amend its SWSP if the proposed uses are not included in the current SWSP for the
