Ref: Your Letter of 2/11/05—"Will Serve"Letter
Dear Mr. Friesen:
The fact that you approved a"Study"dated February 4,2005, does not provide for anything as to
a positive solution for years.
Your qualifiers such as listed below leave me to believe that service will be ten years or more,
similar to the last eighteen years. "When and As development approvals,that cannot be served
by Septic Systems, are vested and development proceeds with respect to your property and
following a receipt of approval from the Colorado Department of Public Health and Environment
to construct necessary facilities". This"Will Serve"commitment is subject to all of the
requirements of the Town of Mead, including Mead's Land Use Code,General Municipal Code,
Ordinances,and Rules.
Your offer sounds to me like the old chicken and egg theory argument, which comes first? At
any rate you do not have any commitment of a reasonable time or procedure to accomplish
sanitary service. So the Town of Mead wants to hold the area until it pays. Sounds like
blackmail and extortion. You have never had a system to provide the capacity needed nor the
solution to provide service unless I paid all cost. Even then you have always told me you cannot
handle the capacity. I have tried to deal with the Town of Mead at least six times over the past
ten years.
Per the action of the Weld County Commissioners,they do not believe you are sincere about
providing the service to the East 1-25 area in any reasonable time. The 1-25 Business Park, now
developed by Zeek Partnership,LLLP,was approved by the Weld County Commissioners in
1983. Zeek Partnership purchased the property in 1986. The Town of Mead prohibited Zeek
Partnership from getting service in 1997 from the St.Vrain Sewer District and promised to
provide adequate service. At the time of development,I spent over$100,000 installing sewer
lines with the promise from the Town of Mead that they would allow us to connect to the St.
Vrain Sewer District. One-half of the 148 acres of the I-25 Business Park has been developed
using septic systems as approved in 1983 by the Weld County Commissioners, so if you are
waiting for development to start,you are seven years behind.

I have lived in the Town of Mead for the last nine years and do not believe you are sincere about
providing service to the East I-25 area. In fact,my house which is on the West side of I-25 only
one mile from the Mead sewer pond,was built ten years ago with a septic system. No effort has
been made to provide Sanitary Sewer Service to the area and hundreds of homes have been built
since with septic systems.
Clean water is not a concern of Mead. In fact,you are under a time limit by the State of Colorado
to repair or replace the present Pond System by 2009. Even to the day of February 14,2005,
before the Weld County Commissioners,the Mayor of Mead,Mr.Richard Kraemer, reiterated
that the council of Mead wants to maintain a"Rural Atmosphere"and control growth in the area.
Based upon your past history and present plans for little or no growth,your"Will Serve" letter is
not acceptable.

Dear Mr_Williamson:
The Town of Mead is aware that you are a proponenthpetitloner for creation of the East 1-25 Sanitation
District proposal that is presently pending before the Weld County Board of County Commissioners. As
you may know, the Town of Mead is the designated wastewater system operator for most of the
property included within the boundaries of the proposed district"ultimate service area", pursuant to the
Area Wide Water Quality Management Plan 2003 Update as adopted by the North Front Range Water
Quality Planning Association ('NFRWQPA).This designation was made pursuant to Section 208 of the
Clean Water Act and the area for which Mead is designated is referred to as the Town of Mead 208
Service Area. As such, the Town of Mead is fully committed to planning for and providing sanitary
sewage collection and treatment within the Town of Mead 208 Service Area. For this reason, the Town
has recently adopted the Town of Mead W WTP Facilities Study dated February 4.2005.
This letter will confirm that the Town of Mead is able and willing to provide sanitary sewage collection
andlor treatment services to your property within the Mead 208 Service Area when and as development
approvals that cannot be served by septic systems are vested and development proceeds with respect
to your property, and following receipt of approval from the Colorado Department of Public Health and
Environment to construct necessary facilities. This "Will Serve' commitment is subject to all of the
requirements of the Town of Mead, including Mead's Land Use Code, General Municipal Code,
Ordinances,Rules and Regulations,including but not limited to annexation of the subject property to the
Town of Mead; compliance with the Town of Mead Comprehensive Plan;agreement to pay the cost of
construction and installation of necessary sewer collection and transmission facilities into the-then
existing Town of Mead wastewater treatment system; engineering
