Dear Kim:
We are writing in response to your initial Nissen Farm Resource USR-1435 review letter of
February 2, 2004 and follow-up letter of October 25, 2004. The following correspond to the
conditions listed in the Resolution and items listed in your letter:
1. We have included the approved Development Standards on the Plat drawings. Mylar copies
of the Nissen Farm Plat drawings have been provided to Hall-Irwin for property owner
signature and will be forwarded to the County under separate cover.
2. Prior to Recording the Plat:
A 1. A final set of plat mylars will be submitted to the County by Hall-Irwin. The
drawings have been prepared in accordance with Section 23-2-260 D. The plans:
are 24 x 36; include signature blocks for appropriate certification; include a
vicinity map; include a plot plan identifying the existing features, ROW,
structures, property lines, adjacent property owners, water features, topography,
soil types, stormwater management, traffic circulation, proposed berms,
floodplain limits, proposed mining features, and site reclamation. As required by
Section 23-2-270, the Development Standards have been included on the plat
drawings and the font size increased as requested.
The road improvement plans have been approved by CDOT and Weld County.
Pursuant to our telephone discussion, bond paper plansets of the Road
Improvements will be submitted to the County with the Nissen Farm Plat mylars.

A 10. The plans for the WCR 47.5 / Highway 34 intersection improvements have been
approved by Gloria Hice-Idler of CDOT, and Weld County Department of Public
Works (please refer to the enclosures).

The Department of Planning Services has reviewed the submitted paper plats and required documents to
meet the Conditions of Approval for the Nissen Farm Application. Staff offers the following comments:
Item 2.A.1 The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code.
Please review the criteria listed in the referenced Section and verify that all items have been
delineated on the plats. The Font size on Sheet 2 of 3 appears to be quite small. The
minimum font size for all sheets in all locations is 8 point. Please verify that this standard has
been met.

should be widened to accommodate trucks turning westbound on to U.S. Highway 34. There
is a deceleration lane and a left turn slot in place;the applicant shall verify with the Colorado
Department of Transportation(CDOT)for any additional requirements. Upon approval from
CDOT and the Department of Public Works, this shall be delineated on the plat. The

Item 2.A.11 All proposed lanes and turning radiuses shall be widened to accommodate trucks. The
intersection design improvements shall take into consideration the right-of-way, drainage,
utility, and other such issues. The applicant shall provide written evidence of approval from
CDOT and the Department of Public Works, as required.

Item 2.F The Colorado Department of Transportation (CDOT) has jurisdiction over all
accesses to the State Highways. Please contact Gloria Hice-ldler or Tess Jones
at the Greeley office to verify the access permit or for any additional requirements
that may be needed to obtain or upgrade the permit. Gloria Hice-Idler has been
given the Traffic Impact Study for review and comments. Coordinate any Weld
County widening improvements at Weld County Road 47.5 and U.S. Highway 34
with both CDOT and the Weld County Department of Public Works. The applicant
shall provide written evidence of approval from CDOT and the Department of Public
Works.

Item 3.E The applicant shall provide evidence from CDOT that an access permit has been
obtained and all Conditions of Approval have been met. Written evidence of

Item 4.A Prior to installation of the concrete and/or asphalt batch plants and/or landscape
materials operation, an individual sewage disposal system is required for the
proposed office and shall be installed according to the Weld County Individual
Sewage Disposal System (I.S.D.S.) Regulations. The septic system is required to
be designed by a Colorado registered professional engineer according to the Weld
County I.S.D.S. Regulations. The installation of the septic system shall comply with
the Weld County I.S.D.S. Floodplain Policy. The applicant shall provide written
evidence of approval from the Department of Public Health and Environment.
Item 4.B The applicant shall provide evidence that the facility has an adequate water supply
for drinking and sanitary purposes. The applicant shall provide written evidence of
approval from the Department of Public Health and Environment.

WCR 59 is designated as a collector status road requiring additional right-of-way for future build out. The
applicant's representative, Tetra Tech RMC, has provided future right-of-way legal dedication exhibit and a plat
map identifying that location adjacent to WCR 58.
The legal description and the plat map showing the dedication should be recorded as a part of the master file.
Is this something that Planning Services would be associated with or do we need to schedule a resolution to
accomplish this item? Please respond on the status of this item.

A 5. Pursuant to your conversation with Danna Ortiz, the applicant cannot add
landscaping (i.e. tress and/or shrubs) to the berms around the landscape sales yard
and batch plant. The berms are temporary for the life of the mine and will be
removed during reclamation. Landscaping, such as tress or plantings, near the
slurry wall is not desirable.

A 10. The enclosed plans for the WCR 47.5 /Highway 34 intersection improvements

Upon receipt of approval from CDOT and the Department of Public Works, the
applicant will submit evidence to the Department of Planning Services.
A 11. The enclosed road improvement plans have been submitted to Weld County
Public Works for review and final approval. Upon receipt of approval from the
Department of Public Works, the applicant will submit evidence to the
Department of Planning Services
B. The applicant has submitted a Minimal Wastewater Discharge from an Industrial Facility
(MINDI) application to the Colorado DPHE Water Quality Control Division. Enclosed is
a copy of the application for verification.
C. The enclosed Mining and Reclamation Plan Maps serve as the Landscape Plan for this
project. The Plans identify the number, size and species of plants. The plans include
specifications for the proposed berms. The berms have been designed to allow for
floodwater to pass through the site, as described in the approved Flood Hazard
Development Permit issued by Weld County.
D. Attached is a legal exhibit as submitted to Leon Sievers and Lee Morrison.
E. A copy of the Long-Term Road Maintenance and Improvements Agreement is enclosed
for reference. The enclosed Plat drawings indicate the traffic disbursement.
F. We are waiting for final approval from CDOT for the Hwy 34/WCR 47.5 road
improvements design. Pursuant to condition 1.B.b. of the Road Maintenance Agreement,
the right turn lane and taper will be installed in the future if the right or left turn
movements onto State Highway 34 drop below LOS C as determined by Weld County
Public Works. A copy of the CDOT Access Permit will be provided to the Weld County
Planning Department prior to construction of any improvements at the intersection.
3. Prior to Operation:
A. The approval letter from the Colorado Division of Minerals and Geology was provided
with Danna Ortiz's letter of November 13, 2003.
B. Building permit applications will be submitted prior to operations.
C. Condition met.
D. As allowed by the Weld County Department of Public Works, the entrance road and
small parking area adjacent to the scale house will be constructed using stable

construction material, such as pit run or road base. Please refer to Danna Ortiz's letter of
November 13, 2003.
E. Please refer to Condition 2.F. above. A State Highway Access Permit has not been

Department a copy of the Access Permit and evidence that the conditions have been
satisfied.

We are writing in response to the Nissen Farm Resource USR-1435 Condition 2.D. The
condition states "The applicant shall dedicate an additional 10-foot right-of-way adjacent to CR
58 to accommodate improvements at this location. This should be shown on the plat drawing.
(Department of Public Works)"
To satisfy this condition, we have enclosed the Alta Survey for the Water Resources, LLC parcel
and a legal exhibit identifying the area to be dedicated for Weld County Road 58 Right-of-Way.
The Alta Survey shows that the property line for the parcel is greater than 40 feet from the
centerline of WCR 58, except at the southwest corner of the parcel. The attached legal
description and exhibit provides the requested 40 ft from the centerline of the existing WCR 58.

Dear Mr. Nieland:
On behalf of Hall-Irwin Corporation, we are submitting the following discharge permit
application documents for a vehicle wash pond:
• Minimal Wastewater Discharges From Industrial Facilities Permit Application Form
• Site Plan Map (11x17) showing the site discharge points
• Vicinity Map
The applicant is planning a vehicle wash retention pond at the sand and gravel mine site. The
wash pond will be located within the perimeter bentonite clay slurry wall which surrounds the
proposed mining area. The slurry wall creates a barrier between groundwater outside the mining
area and inside the mining area. The retention pond will dissipate by evaporation. The site
currently has a CDPS permit, which requires monitoring and sampling prior to discharge from
the site.

Dear Mr. Carroll:
On behalf of Hall-Irwin Corporation, Tetra Tech RMC is submitting for review two sets
of road improvement plans for the Nissen Fann Gravel Mine project. One set of plans is
for the U.S.-34 improvements, also submitted for review by the Colorado Department of
Transportation (CDOT), and the second set of plans is for the improvements on Weld
County Road(WCR) 58 and WCR 47 Vz. A set of U.S.-34 improvement plans was first
submitted to Weld County for preliminary review on January 22, 2004, while a set of
WCR 58 & WCR 47 `/z plans was submitted to the County for review on January 19,
2004. Both plan sets arc revised to address CDOT's and Weld County's comments from
the submittals in January. In addition to the improvement plans, the Pavement Design
Report for U.S.-34 is also included.
The revisions to the U.S.-34 plans reflect the comments received from Gloria Hice-Idler
with CDOT on March 17, 2004. The changes include corrections and additions to the
construction notes, additional information for the typical section to reflect the results in
the Pavement Design Report, and the addition of ajoint layout plan.
The revisions to the WCR 58 & WCR 47 %z plans address the comments from Weld
County. Sheet 3 of 3 in the plans shows the addition of two "BUS STOP AHEAD" signs
with flashing beacons. A letter from Platte Valley Schools stating their approval of the
signs was faxed to Weld County on April 14, 2004. An additional copy of the letter from
Platte Valley Schools is also included with this letter.
Weld County also requested equipment crossing locations be provided for the dairies
along WCR 47 Yz. Tetra Tech RMC met with the two dairy owners on May 28, 2004.

Mr. Andrew (Jay) Hop and Mr. Mark VanEarden approved of placing two farm
equipment warning signs and approved of the locations as indicated on Sheet 3 of 3 in the
WCR 58 & WCR 47 V2 plans. However, both dairy owners highly expressed their desire
for Weld County to lower the speed limit along WCR 47 % to 35 mph.

On behalf of Hall-Irwin Corporation,Tetra Tech RMC is submitting the U.S.-34 Improvement Plans
for the Nissen Farm Gravel Mine project for a second review. The improvements arc located at the
intersection of U.S.-34 and Weld County Road 47 'h. A set of plans was submitted to the Colorado
Department of Transportation on January 22, 2004 for a preliminary review. Comments were
received via email on February 13, 2004 and March 15, 2004. The plans were returned to Tetra Tech
RMC on March 17, 2004 with additional comments written on the plans. This submittal addresses
all of the comments from the January submittal.
The changes to the plans include the addition of a joint layout plan, as requested in your February
13th, 2004 email message. Also included is the additional information on the cross-sections you
requested in your email on March 15, 2004. The cross-sections now clearly show the 6:1 side slopes
for 12 feet along with the right-of-way line. The typical section also shows the side slope
information, along with additional information from the Pavement Design Report. Changes were
made to the construction notes according to your comments on the returned construction plans.
In addition to the improvement plans, the Pavement Design Report is also included. As requested,
the original plans with your comments are returned as well. Please feel free to contact me if you

The Department of Planning Services has reviewed the submitted paper plats and required documents to
meet the Conditions of Approval for the Nissen Farm Application. Staff offers the following comments:
Item 2.A.1 The plat shall be prepared in accordance with Section 23-2-260.D of the Weld County Code.
Please review the criteria listed in the referenced Section and verify that all items have been
delineated on the plats.

Item 2.A.5 The Landscape, Screen and Berm Plan. Staff requests additional landscape materials be
placed on the berm that surrounds the Landscape sales yard and the Batch Plant, resource
storage area to mitigate the intensity of the use to surrounding property's. The proposed
plant palette is acceptable to Staff.

Item 2.A.10 The intersection of State Highway 34 and Weld County Road 47.5: The right turn radius
should be widened to accommodate trucks turning westbound on to U.S.Highway 34. There
is a deceleration lane and a left turn slot in place; the applicant shall verify with the Colorado
Department of Transportation(CDOT)for any additional requirements. Upon approval from

CDOT and the Department of Public Works, this shall be delineated on the plat. The
applicant shall provide written evidence of approval from CDOT and the Department of Public
Works.
Item 2.A.11 All proposed lanes and turning radiuses shall be widened to accommodate trucks. The
intersection design improvements shall take into consideration the right-of-way, drainage,
utility, and other such issues. The applicant shall provide written evidence of approval from
CDOT and the Department of Public Works, as required.
Item 2.6 The applicant shall provide evidence that any vehicle washing area will be designed and
constructed to capture all effluent and prevent any discharges from drum washing and the
washing of vehicles in accordance with the Rules and Regulations of the Water Quality
Control Commission and the Environmental Protection Agency. Evidence of approval shall
be submitted to the Weld County Department of Planning Services. The applicant shall
provide written evidence of approval from the Department of Public Health and Environment.
Item 2.C The applicant shall submit a Landscape Plan identifying the number,size, and species of all
plant material to the Weld County Department of Planning Services for review and approval.
This plan shall include specifications of any proposed berms. The proposed berms will be
extended to mitigate impacts to surrounding properties and adjacent road rights-of-way. Any
berm placed in the 100-year floodplain of the South Platte River cannot obstruct passage of
flood flows. The applicant shall use breaks in the berm with landscaping to fill the void,
culverts, or some other method that will allow water to flow freely. Please refer to previous
comments under heading of Item 2.A.5.
Item 2.D Condition met.
Item 2.E The applicant shall enter into a Road Maintenance and Improvements Agreement for the
designated haul route. The site plan disbursal indicates that 100 percent of the traffic will
travel east to Weld County Road 47.5 then south to U.S. Highway 34 and disburse east and
west. From this disbursement, the designated haul route appears to be Weld County
Road 58 east to Weld County Road 47.5 and then south to U.S. Highway 34. The applicant
shall provide written documentation of a change in the haul route for traffic to the west on
Weld County Road 58 to the Department of Public Works at least two weeks prior to project
operations. The applicant shall provide written evidence of approval from the Department
of Public Works.
Item 2.F The Colorado Department of Transportation(CDOT)has jurisdiction over all accesses to the
State Highways. Please contact Gloria Hice-Idler or Tess Jones at the Greeley office to
verify the access permit or for any additional requirements that may be needed to obtain or
upgrade the permit. Gloria Hice-Idler has been given the Traffic Impact Study for review and
comments. Coordinate any Weld County widening improvements at Weld County Road 47.5
and U.S. Highway 34 with both CDOT and the Weld County Department of Public Works.
The applicant shall provide written evidence of approval from CDOT and the Department of
Public Works.
Item 3.A The applicant shall provide evidence of being in receipt of the Division of Minerals and
Geology Mined Land Reclamation Permit 112 to conduct surface extraction of construction
materials and reclamation of said lands identified as the Nissen Site. The applicant shall
provide written evidence of approval to the Department of Planning Services.
Item 3.6 Proper Building Permits shall be obtained in accordance with the referral response from the
Weld County Department of Building Inspection, dated September 5, 2001, prior to any
construction, demolition, or excavation. Part of the permit application process includes a
complete plan review. The applicant shall submit the appropriate permits to the Department
of Building Inspection and the Department of Planning Services.

Item 3.D The approach road and the small parking area adjacent to the office/scale house shall be
paved to accommodate customers and vendors. It shall conform to all standards of the
Americans with Disability Act (ADA). Each space shall be equipped with guards where
needed to prevent vehicles from extending beyond the boundaries of the spaces and from
coming into contact with other vehicles, walls, fences, or plantings. The applicant shall
delineate the parking associated with the Landscape Sales Yard on the Plat. A detailed
drawing may be required to accurately delineate the parking, circulation and location of the
structures within the sales yard.
Item 3.E The applicant shall provide evidence from CDOT that an access permit has been obtained
and all Conditions of Approval have been met.Written evidence of approval from CDOT shall
be submitted to the Department of Planning Services.
Item 3.F Condition met.
Item 4.A Prior to installation of the concrete and/or asphalt batch plants and/or landscape materials
operation,an individual sewage disposal system is required for the proposed office and shall
be installed according to the Weld County Individual Sewage Disposal System (I.S.D.S.)
Regulations. The septic system is required to be designed by a Colorado registered
professional engineer according to the Weld County I.S.D.S. Regulations.The installation of
the septic system shall complywith the Weld County I.S.D.S.Floodplain Policy.The applicant
shall provide written evidence of approval from the Department of Public Health and
Environment.
Item 4.B The applicant shall provide evidence that the facility has an adequate water supply for
drinking and sanitary purposes. The applicant shall provide written evidence of approval from
the Department of Public Health and Environment.
Development Standards
Item 32. The applicant shall modify the existing note of the plat to state:
"Pursuant to Section 23-4-290.C of the Weld County Code, the hours of operation for sand
and gravel operations will be limited to the hours of daylight, Monday through Saturday,with
no operations on Sunday, except in the case of public or private emergency, or to make
necessary repairs to equipment. Hours of operation may be extended with specific
permission from the Weld County Board of County Commissioners. This restriction shall not
apply to operation of administrative and executive offices,or repair and maintenance facilities
located on the property."

Dear Mr. Gregg:
On January 22, 2004 the Division of Minerals and Geology found Hall-Irwin Corporation to have satisfied the
applicable requirements of C.R.S. 34-32.5-101 et seq. for obtaining a mining and reclamation permit. Therefore,
a permit is being issued. Two signed originals of the permit have been executed. We have kept one copy for our
files and are enclosing one copy for your use. It is your responsibility to comply with all of the terms of the
permit.
1. All of the original application materials, as amended and supplemented, are an integral part of your
permit. They have been incorporated into the permit by reference. We presume that you have a copy of all of
these materials; therefore, none have been enclosed with this mailing, We suggest that you keep a copy of the
permit and the permit application at the mining operation as a reference for operating personnel, to help ensure
compliance with the terms of the permit.
2. Changes in the mining and reclamation operations that differ from those described in the permit may
require a modification to the permit. We suggest consulting the Construction Materials Rules and Regulations
and/or contacting us to determine if a revision to the permit is necessary. Rule 1.10 pertains to Amendments,
Rule 1.9 to Technical Revisions, and Rule 1.11 to Conversions.
3. On your permit anniversary date each year, January 22, 2004, you must submit an annual fee and an
annual report to us. The annual fee for this permit is $688.00. Please consult the Act, Rules and Regulations,
and your permit for specific annual report requirements applicable to your mine.

Dear Kim:
We are writing to provide information required by the Board of County Commissioners Resolution
conditions for the Nissen Farm Application USR 1435. This letter is supplemental to Danna Ortiz's
November 13, 2003 letter to Weld County, attached for your reference. The following correspond to the
conditions listed in the Resolution:
1. We have included the approved Development Standards on the enclosed Plat drawings. The enclosed
Nissen Farm Existing Conditions, Mining and Reclamation Plat drawings are submitted for your
review and approval. Currently we have surveyed the areas and developed preliminary design plans
for the WCR 58/WCR 47.5 intersection and WCR 47.5/SH 34 improvements. These plans are in the
review process with Weld County Public Works and Colorado Department of Transportation
(CDOT). Upon final approval of theses agencies, plat plans will be submitted to the Weld County
Planning Department.
2. Prior to Recording the Plat:
A (1-11). These conditions have been, or will be satisfied as described in Danna Ortiz's letter of
November 13, 2003.
B. Please refer to Danna Ortiz's letter of November 13, 2003. It is our understanding that no
additional approvals are required for the vehicle wash facility. We have requested verification
from Char Davis of Weld County Health Department and will forward documentation to the
Department of Planning Services upon receipt.
C. The enclosed Mining and Reclamation Plan Maps serve as the Landscape Plan for this project.
The Plans identify the number, size and species of plants. The plans include specifications for the
proposed berms. The berms have been designed to allow for floodwater to pass through the site,
as described in the approved Flood Hazard Development Permit issued by Weld County.
D. This will be submitted under separate cover.
E. A draft Road Maintenance Agreement has been developed. Hall-Irwin is currently working with
Weld County Public Works to finalize the Agreement. The enclosed Plat drawings indicate the
traffic disbursement.

F. We are currently working with Gloria Hice-Idler on the Hwy 34/WCR 47.5 road improvements
design and access permit.
3. Prior to Operation:
A. Please refer to Danna Ortiz's letter of November 13, 2003.
B. Building permit applications will be submitted.
C. Site drawings were submitted to the Platte Valley Fire Department on November 13, 2003. We
have attempted to contact the Fire Department on several occasions, however have not received
any response. As evidenced by the enclosed certified mail receipt, we re-submitted the plans and
letter of explanation with a request for response.
D. As allowed by the Weld County Department of Public Works,the entrance road and small
parking area adjacent to the scale house will be constructed using stable construction material,
such as pit run or road base. Please refer to Danna Ortiz's letter of November 13, 2003.
E. A State Highway Access Permit has not been issued. Upon approval by CDOT,Hall-Irwin will
provide the Weld County Planning Department a copy of the Access Permit and evidence that the
conditions have been satisfied.
F. We have enclosed a copy of the FAA approval for the project.

The Federal Aviation Administration has completed an aeronautical study under
the provisions of 49 U.S.C. , Section 44718 and, if applicable, Title 14 of the
Code of Federal Regulations, part 77, concerning:
Structure Type: Silos

Heights: 80 feet above ground level (AGL)
4689 feet above mean sea level (AMSL)
This aeronautical study revealed that the structure does not exceed obstruction
standards and would not be a hazard to air navigation provided the following
condition(s) , if any, is (are) met:
Based on this evaluation, marking and lighting are not necessary for aviation
safety. However, if marking and/or lighting are accomplished on a voluntary
basis, we recommend it be installed and maintained in accordance with FAA
Advisory Circular 70/7460-1 AC70/7460-1K.
This determination is based, in part, on the foregoing description which
includes specific coordinates, heights, frequency(ies) and power. Any changes
in coordinates, heights, and frequencies or use of greater power will void this
determination. Any future construction or alteration, including increase to
heights, power, or the addition of other transmitters, requires separate notice
to the FAA.
This determination does include temporary construction equipment such as cranes,
derricks, etc. , which may be used during actual construction of the structure.
However, this equipment shall not exceed the overall heights as indicated above.
Equipment which has a height greater than the studied structure requires
separate notice to the FAA.
This determination concerns the effect of this structure on the safe and
efficient use of navigable airspace by aircraft and does not relieve the sponsor
of compliance responsibilities relating to any law, ordinance, or regulation of
any Federal, State, or local government body.
A copy of this determination will be forwarded to the Federal Communications
Commission if the structure is subject to their licensing authority.
