439 RESOLUTION RE: ACTION OF BOARD AT SHOW CAUSE HEARING CONCERNING USE BY SPECIAL REVIEW PERMIT#1456 FOR A KENNEL(25 CATS)IN THE A(AGRICULTURAL)ZONE DISTRICT - BARBARA SCHOTTELKOTTE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,on April 6,2005, a Show Cause Hearing was conducted to consider revocation of Use by Special Review Permit#1456 for a Kennel (25 cats)in the A(Agricultural)Zone District, issued to Barbara Schottelkotte, P.O. Box 1129, Brighton, Colorado 80601, and WHEREAS, Barbara Schottelkotte is the current owner of the facility located on property being further described as follows: Lot 7, Block 20, Aristocrat Ranchettes; being part of Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, at said hearing of April 6, 2005, the Board deemed it advisable to continue the matter to July 6, 2005, at 10:00 a.m., to allow the respondent adequate time to earn additional funds to complete the outstanding compliance issues, and WHEREAS, at said hearing of July 6, 2005, the Planning staff advised the Board that the respondent has not completed Conditions of Approval #1.B, #1.C, #1.D, #1.G, #1.1, #1.J or#2 for Use by Special Review Permit#1456, and WHEREAS, after hearing all testimony presented, the Board deemed it advisable to find that sufficient evidence has been provided to indicate numerous Conditions of Approval have not been met for Use by Special Review #1456 for a Kennel (25 cats) in the A (Agricultural) Zone District, issued to Barbara Schottelkotte and to revoke said permit. The Department of Planning Services recommends that this Show Cause Hearing be continued until July 6, 2005 (90 days) for the following reason: * Staff has been in contact with Ms. Schottelkotte on multiple occasions. Ms. Schottelkotte has been working on the site. The Department of Planning Services was informed that Ms. Schottelkotte has obtained a job at a landscaping company through September of this year. Staff believes that Ms. Schottelkotte will be able to complete USR-1456 over the next six months primarily because of financial reasons. Condition 1.6 —Screening on the north side of the property. Ms. Schottelkotte has installed orange farm fencing as a temporary fence. This fence does not screen the material on site but she has informed us that she will install a solid fence as money becomes available. Ms. Schottelkotte has planted numerous saplings on site to aid in the screening of the site. Condition 1.C — Garbage removed from the site. Ms. Schottelkotte has submitted written evidence that on a weekly bases that three grocery bags of cans and three cat litter boxes are disposed of in the residential trash services. Condition 1.D— Mobile home permits. Ms. Schottelkotte has not recently applied for any permits on the mobile home to be installed or the mobile home to be demolished on site. Ms. Schottelkotte has indicated that as money becomes available these permits will be applied for. Condition 1.G —State Kennel License. Ms. Schottelkotte has been in contact with the State and has stated that she intends to obtain the appropriate permits as money becomes available. Condition 1.H —Waste Handling Plan. Ms. Schottelkotte has submitted a Waste Handling Plan to the Department of Public Health and Environment for review. The Department of Public Health and Environment is reviewing the Waste Handling Plan as submitted by the applicant. Condition 1.1, 1.J, and#2 — Plat amendments. The Department of Planning Services will help Ms. Schottelkotte complete the final Mylar once all the conditions of approval have been met. Staff therefore requests that this hearing be continued for three months (July 6, 2005) in order to allow Ms. Schottelkotte adequate time to obtain the financial funds that are needed to complete USR-1456. The site is located at Lot 7 Block 20 Aristocrat Ranchettes Section 27, Township 2 North, Range 66 West of the 6th P.M., Weld County CO. Aristocrat Ranchettes subdivision is located south of and adjacent to CR 18 and east of and adjacent of CR 31. Lot 7 Block 20 is located North of and adjacent to Caroline Ave. and approximately 1/8 mile west of Richard Ave. The Use by Special review is not in compliance with the following Conditions of Approval number 1.B, 1.C, 1.D, 1.G, 1.H, 1.1, 1.J, number 2 and 4 of the Board of County Commissioners Resolution. A signed copy of the Board of County Commissioners Resolution is attached. • 1.6 The applicant shall provide the Department of Planning Services with evidence that appropriate screening has been installed along the north property line or enter into a private Improvements Agreement according to policy regarding collateral for improvements and post adequate collateral for all landscaping and non-transportation (plant materials, fencing, screening, water, signage etcetera). The agreement and form of collateral shall be reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the USR plat. • 1.C The applicant shall provide the Department of Planning Services with evidence that the garbage (tires, soda bottles, cans, etc.)on site have been removed. • 1.D The applicant shall schedule the required inspections needed for one of the mobile homes to be installed (PRS-033042) and the other to be demolished (BCS-030284). Paul Svendson and Judy Svendson are totally against such a permit for cats. There are enough cats in the world. Cats come into heat at the age of 4 months and can reproduce at the rate of 2 to 3 litters per year. In 7 years, a pair of cats could create 400,000 cats. Now, I would hope that these 25 cats would be neutered or spayed in order to prevent such an outburst of cats. My concern is also that these cats would need to be confined and not let off of her property. Would this be possible? I know we have a dog ordinance out here, but what about the cats? Dogs hate cats and they would rather kill them. So to prevent overpopulation of cats and the cats getting the advantage to tempt dogs, please discourage or attempt to let this particular individual not keep so many cats.
