HomeMy WebLinkAbout20050769.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST HOMER GRINDE FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Homer Grinde,VI#0400299, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 8th day of February, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, at which time this matter was continued to March 8, 2005, WHEREAS, on the 8th day of March, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Homer Grinde, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until September 13, 2005,to allow adequate time for the property owners to complete all inspections and a Certificate of Occupancy issued to bring the subject property into compliance. Sincerely, 4.1 kph t� Pe regory � o Building Compliance pc: BCS-020601 SERVICE,TEAMWORK,INTEGRITY,QUALITY Page 1 of 1 Peggy Gregory From: David Williamson Sent: Thursday, February 03, 2005 8:36 AM To: Peggy Gregory Subject: FW: BCS-020601 Peggy, If I read the file correctly, this project has three different(BCS-020601, BC-9800229, BP-44337) permit numbers issued, two violations (VI-0200537, VI-0400299).As I read the inspection reports this structure HAS ONLY had rough electrical (5/2/96) , courtesy truss inspection (no framing)for roofing purpose(3/11/99), water service (10/16/98), rough plumbing corrections (10/15/98), underground gas piping correction (10/15/98), setbacks (9/29/95),footings (9/29/95), rebar (10/12/95), underground plumbing (12/18/95). The pictures speak for themselves, I did gain access to the basement where the Mr.Grinde is living after exerting our authority under the permit with the assistance, if needed, from the sheriffs dept. In the basement there is a gas fireplace operating with a fan placed behind the vent pipe blowing heated air into the room. The gas line is not supported properly in the basement as well as no air test has been done for line tightness. Numerous electrical violation. The exterior gas line from the propane tank is suspended in the air (see picture), as well as the propane tank is within 10 feet of the structure. Numerous electrical violation exist as well. I asked Mr.Grinde to put together a plan of completion (funds, dates, etc)for his meeting with Board of Commissioner on February 8, 2005 at 10am. Mr.Grinde is very evasive as to any setting any schedule for completion citing future and past personal problems. Mr.Grinde has requested a inspection on the garage exterior sheeting today (2/3/2005). Mr.Grinde is only paying attention to the dwelling at this point because of the Weld Counties attention to the expiration of the permit. When I started this project I worked 12 hour night shifts in construction. With that plus the farm and the house it was more than I could handle physically. Three going on four years ago I was laid off. Not a problem, thought I was set financially and would be able to get project completed. Still had a farm in Minnesota that the only option was to debt settle with the government on the mortgages. Didn't realize what one branch of the government gives, there's another one waiting. The debt written off was considered income and the IRS cleaned out my savings. I still had the house/farmstead to sell. Found a buyer,was assured they could get the financing if I could carry them for six months. I've worked with them for over a year. It's obvious I need to find another buyer. Two years ago picking up first load of hay, squeezed and tore my right arm up in the bale wagon. $5000 dollars plus (no insurance) and arm in sling for part of summer. Last year my mother had to go to a nursing home (Minnesota). I'm the only heir. I had to spend time there cleaning out, repairing and renting out her house when I could. The house is mine through a life estate after she passes on. But now the rent goes towards nursing home care. NOW My plan is to finish siding and get the house totally enclosed now. I have about a month of farm related work to finish. Then should be able to complete rough in and other necessary work as time permits when not haying. FINANCING I'm just getting back on my feet financially. I am debt free, own 170 irrigated acres, two houses in northern Minnesota. In June income starts coming in from hay and cattle. I also rent 300 acres of dry land for wheat and pasture. I don't see any problem finishing the house then. Also would hope the one house would sell for a minimum of$75,000, should bring more.
