Site Specific Development Plan and Use by Special Review (USR)
Questionnaire
In 2004, Marcum Midstream 1995-2 EC Holding, LLC, purchased the Lyster
disposal well which operates under USR 729. The facility is an Oil and Gas Class
II Waste Disposal Facility. Under the current terms of the USR, the well may
accept 20 truck loads of waste water per day. The purpose of this application is to
request that the restriction on the maximum number of truck loads allowed at the
facility be increased to 50 per day. In addition, we request that the number of
loads received per day be measured using a 30-day moving average calculation.
We are also requesting the addition of five 500-barrel tanks.
2. This is an amendment to an existing USR which was deemed to be consistent with
the county's comprehensive plan at the time it was approved.
3. At the time of the approval of the existing USR, the facility was deemed to be
consistent with the county's zoning requirements.
4. All surrounding areas are zoned for agriculture and there are two residential
dwellings within approximately one-half mile of the facility. The closest residence
is the Lyster family home. The Lyster Family Trust is the lessor of the property on
which the facility sits. The facility is primarily surrounded by farmland.
5. A. On a typical day twelve to fifteen truck drivers will visit the site.
B. We normally have two employees on site when trucks are being accepted.
One employee is on site at all times when the pumps are operating.
C. The hours of operation during which we can accept waste water are from
7:00 a.m. to 9:00 p.m. The pump may run 24 hours per day if necessary.
D. There are currently 13 tanks and three buildings on site; we are proposing
the addition of five 500-barrel tanks.
E. No animals will be housed at this site.
F. Transport trucks weighing up to forty tons will visit the site up to the
maximum limit on the numbers of loads we can accept.
G. Fire protection for this facility is provided by the Eaton Fire District.
H. Bottled water is used for domestic purposes at the site.
I. A portable toilet is used for sewage disposal. The toilet is cleaned weekly.
J. No warehousing or storage is performed at the facility.
6. No additional landscaping will be added to the site.
7. When abandoned, the property will be returned to farmland. Equipment and tanks
will be removed and the well will be plugged and abandoned in accordance with
COGCC rules and regulations in effect at the time of abandonment.
8. The existing storm water drainage is adequate and will not be changed.
9. The only proposed physical change to the facility is the addition of five 500-barrel
tanks (construction would begin within six months of final approval of this
request) as well as the requested increase in the number of trucks allowed.
10. Waste created at the facility is a direct result of water filtration. This waste
(bacterial residue and particulates) is stored and transported to an approved waste
disposal site. Any other waste material is disposed by the use of trash bins and
hauled away on an as-need basis.
