HomeMy WebLinkAbout20053017.tiff RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST DAMARIS AND MARCO CALDERON FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Damaris and Marco Calderon, VI #0500230, are allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 11th day of October, 2005, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Marco Calderon, property owner, was present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until January 11, 2006, to allow adequate time for the property owners to submit a Use by Special Review application, to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. I must speak out on a potential zoning violation that I believe is occurring.Not Long ago I was sighted by Weld County for a zoning violation.After expenditures exceeding 7,000 dollars,my violation was resolved. The system had worked and Weld County was happy.Looking back,I am glad I took care of the matter.I believe in a level playing field. If someone does not want to put the time and money to use their property legally,they should be taken to task. Practices such as this lowers the value of my property. To the best of my knowledge the location in question is zoned residential. In my view parking,repairing and maintaining gravel trucks is not in compliance with Weld County residential zoning code.There are at least eight tractor trailer trucks kept and maintained at this address.
