Dear Kim: -
The referenced letter requested approval of an increase in the truck visits to the Lyster well from
20 to 30 per day as measured by a 30-day rolling average. You have verbally indicated that such
a change is a major change to the USR and, therefore,must be addressed by the USR amendment
process.
Today we are submitting the USR amendment request. In the meantime, we ask that we be
exempted from the 20-load limit and it be raised to 30 (on a 30-day moving average basis)until
the amendment process is completed.
Kim, as you know, the oil and gas activity in Weld County is increasing daily and action such as
this is necessary to ensure that the activity continues without problems.

Dear Chris:
As you are aware, the oil and gas activity in Weld County has increased significantly over the last
year. Our facilities are being stretched to capacity nearly every day. In our search to increase the
capacity available to meet the needs of our customers and the taxpaying entities that make up a
large portion of the County's tax base, we have looked at many options. The most significant and
viable of those options is to build a new facility near US 85 and Colorado Highway 60. A USR
application has been submitted to the Planning Department for such a facility,however, that well
won't be available for nearly a year.
In the meantime, a good partial solution is to take more loads of water to the referenced Lyster
well. Under our current Amended USR, the facility may receive up to 20 trucks per day,while
the well is easily capable of taking 30 loads each day. Therefore,we request that the Lyster USR
be amended to allow up to 30 trucks per day to visit the facility and that the number of loads per
day be measured by a 30 day rolling average.
A truck attempting to use the Lyster well that is turned away due to our daily load restriction will
travel more miles on county roads to get to another of our facilities. In essence, the load
restriction causes more truck traffic,not less.
In addition, Mr. Lyster the landowner, is very supportive of this request and will put his feelings
in writing if you desire. Mr. Lyster and his tenant now have an understanding about the facility
and you should not be receiving any more calls from the tenant.
Finally, we request that this change to the USR be considered to be "minor" and therefore can be
implemented by the Planning Staff.
