HomeMy WebLinkAbout20051811.tiff HEARING CERTIFICATION DOCKET NO. 2005-46 RE: SITE SPECIFIC DEVELOPMENT PLAN AND THIRD AMENDED USE BY SPECIAL REVIEW PERMIT #996 FOR AN OIL AND GAS SUPPORT FACILITY (BRINE WATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT - MARCUM MIDSTREAM 1995-2 BUSINESS TRUST, DBA CONQUEST DISPOSAL SERVICES, LLC, C/O CONQUEST OIL COMPANY A public hearing was conducted on June 22, 2005, at 10:00 a.m., with the following present: Commissioner William H. Jerke, Chair Commissioner M. J. Geile, Pro-Tem Commissioner David E. Long Commissioner Robert D. Masden Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Kim Ogle Health Department representative, Cindi Etcheverry Public Works representative, Donald Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 3, 2005, and duly published June 8, 2005, in the Fort Lupton Press, a public hearing was conducted to consider the request of Marcum Midstream 1995-2 Business Trust, dba Conquest Disposal Services, LLC, c/o Conquest Oil Company, for a Site Specific Development Plan and Third Amended Use by Special Review Permit#996 for an Oil and Gas Support Facility(brine water disposal) in the A(Agricultural)Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He gave a brief description of the location of the site, which is within the three-mile referral area for the Town of Kersey; however, the Town indicated no concerns. He stated the original permit was approved in 1992 and amended in 1993. The Second Amendment was approved to allow increased capacity, including the expansion of six storage tanks for a total of 24 tanks. He stated the Third Amendment is for the drilling of a second disposal well, an increase in the 30-day moving daily average maximum volume limitation to 12,000 barrels, and the addition of one 800-barrel fresh water tank. Mr. Ogle described the surrounding land uses and stated potable water and sewage disposal will be provided by bottled water and an existing septic system. He stated the site is accessed from Weld County Road 46, and he gave a brief description of the haul route. He further stated 11 referral agencies reviewed this proposal, seven responded favorably or provided comments that have been addressed in the Conditions of Approval and Development Standards, and staff received no correspondence from surrounding property owners. In response to Chair Jerke, Mr. Ogle stated the facility has been owned by Conquest since 1992, and he reiterated this amendment request is to add one injection well, increase tank storage capacity, and add one 800-barrel fresh water tank. 2005-1811 PL0897 PC 1-k-( ) 07_67,-e7S- HEARING CERTIFICATION - MARCUM MIDSTREAM 1995-2 BUSINESS TRUST, DBA CONQUEST DISPOSAL SERVICES, LLC, C/O CONQUEST OIL COMPANY(3RD AMUSR#996) PAGE 2 Cindi Etcheverry, Department of Public Health and Environment,stated the applicant has provided a design of the new receiving pad; however, she has not had an opportunity to review the information. Donald Carroll, Department of Public Works, described the location of the facility, which has had a Road Improvements Agreement since March 23, 1993,and he stated the applicant provides dust abatement as requested by the Department of Public Works. He stated he has no concerns with the amendment request, nor has he received any complaints from the public. Responding to Chair Jerke, Mr. Carroll stated Weld County Road 53 is paved and Weld County Road 46 is gravel. He stated the facility entrance is approximately 1,000 feet west of Weld County Road 53,the operation generates 80 to 100 truck trips per day, and the average daily traffic count east of the facility is well below the 200-vehicle benchmark. Dale Butcher represented the applicant and stated the oil and gas business is very busy,therefore, they are in dire need of the ability to dispose of water acquired through oil drilling activities. In response to Chair Jerke, Mr. Butcher stated this injection well will be approximately 10,000 feet deep, in accordance with the Colorado Oil and Gas Commission regulations. In response to Commissioner Masden, Mr. Butcher stated this will double their existing pumping capacity of 5,000 to 6,000 gallons per day. No public testimony was offered concerning this matter. In response to Chair Jerke, Mr. Butcher stated he and the applicant have reviewed and concur with the Conditions of Approval and Development Standards as proposed. Responding to Commissioner Geile, Mr. Butcher stated they take in water faster than they can pump it, so they use the storage tanks to hold it until they can pump, which also provides a means of separation. He further stated they will add one more storage tank, for a total of 25. Commissioner Masden moved to approve the request of Marcum Midstream 1995-2 Business Trust, dba Conquest Disposal Services, LLC, c/o Conquest Oil Company, for a Site Specific Development Plan and Third Amended Use by Special Review Permit #996 for an Oil and Gas Support Facility (brine water disposal) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Vaad, and it carried unanimously.
